Boy beaten to death after baby brother died the same way; dad charged now, mom last time​


ANNISTON, Ala. (TND) — A second child in an Alabama family has been beaten to death and this time his father is charged with the murder.

The Anniston Police Department said officers were called to the hospital last Wednesday for a child abuse case.

Jessie Taylor McCormack, 6, was unconscious and being treated. He was later taken to a hospital in Birmingham.

Officers at the scene spoke to his father, 29-year-old Joshua Clark, and then arrested him for aggravated child abuse.

Jessie died in Birmingham, two days later, and the charge against his father was upgraded to capital murder.

Joshua Clark is being held without bond.

The Blount County Sheriff's Office confirmed to WBMA Jessie's brother, an 18 month old named Enzo, was murdered back in 2019.

The boys' mother Samantha McCormack, and her boyfriend Robert Elmore, were charged with capital murder, felony murder, reckless manslaughter, and two counts of aggravated child abuse in that case.

Samantha McCormack had actually lost custody of her children but got them back before Enzo’s death, on the condition she keep them away from Elmore.

Oneonta, Ala. — The Blount County couple charged with capital murder in a toddler's death were indicted in late September.

The indictments, which were made public on Wednesday, charged both 24-year-old Samantha McCormack and her boyfriend, Robert Elmore, 28, with capital murder, felony murder, reckless manslaughter and two counts of aggravated child abuse for the death of McCormack's son, Enzo McCormack.

The toddler was found wrapped in a pizza blanket at a Locus Fork gas station on September 6th as employees attempted to warm up the severely injured child.

Elmore eventually admitted to police that he accidentally dropped the boy after he grabbed Elmore's chest hair. He said he then tried to shake the unconscious child to wake him up. Investigators office did not believe his story.

The couple has been held without bond in the Blount County Jail since their arrest.

Moon said the Blount County mother's three children taken were taken away by DHR officials earlier this year. Moon said McCormack's children were returned to the mother's custody with a very specific order from Judge Sherry Burns: Stay away from Elmore. Court records showed McCormack filed a protection from abuse in March. The request was dismissed in June according to court records.

"There's no way this could be a surprise to his (Elmore's) family. There's no way. I don't care what they told you because he has a history of abuse," said a frustrated Moon. "He has physically harmed his sister and other people in his family so there's no way this was a surprise."

Moon said police discovered McCormack's other child was also discovered to have suffered a fractured skull. The three-year-old was treated and now is in DHR custody with McCormack's other child.

McCormack found herself back in Burns' courtroom three days after the incident for a new custody hearing. Moon could not comment about what happened inside the hearing. The sheriff defended county officials handling of McCormack's custody hearings. He said the mother lied to DHR investigators about living with Elmore. Deputies said the house they were living in had dog feces on the floor and was clearly not fit for a child to be living in.

That poor little boy. His short life was miserable and painful. May he finally be at peace.
