San Antonio police plan to search landfill for missing Tempe baby

From day one they have been tight-lipped about the case, but Friday night the San Antonio police chief confirmed they're still operating under the assumption that baby Gabriel is alive.

"We have not opened a homicide case," said Chief Bill McManus. "We're still considering it a missing persons case. And we're meeting to determine how to proceed in the next couple days."

The chief said the case will take a major step forward next week by searching a San Antonio landfill. The chief called the landfill "a place of interest" in the baby Gabriel search.

His officers are still in the planning process, but they've cordoned off a section of the landfill, staked it out and figured out how deep they'll have to dig and prevented any more garbage from being dumped on the site.

The day after missing baby Gabriel Johnson was last seen by anyone, Elizabeth Johnson boarded a bus in San Antonio, Texas, headed to Florida. She traveled without the child. That same day she texted Gabriel Johnson's father, Logan McQueary and told him she had killed the child. Part of the text message read: "When I'm safe, I'll email you the exact location of dead Gabriel's little blue body, if the garbage don't come first," which has led authorities to believe that Baby Gabriel was placed in a dumpster while Johnson was in San Antonio. Investigators have searched in and around the two hotels where Elizabeth Johnson stayed to no avail. But they still haven't searched the area landfill.

Investigators have been considering searching a portion of a San Antonio landfill for several days. They have cordoned off an area of the Tessman Road landfill and are referring to it as a "place of interest."

Now all that has to be done is search the cordoned off section.

World renowned investigator offers to help find baby Gabriel

Jay J. Armes, otherwise known as "The Investigator," has been finding missing people for 40 years. He was made famous for finding Marlon Brando's son in the 70's.

Armes sometimes charges up to $1 million a case, but for baby Gabriel Johnson, he and his team are offering to do it for free.

"Because of the way it happened and the way the girl started lying from the beginning," Armes told ABC15 on a phone interview from Texas. "At first she had given it to a couple, and then she didn't know who the couple were. The harder the cases are, the more challenging they are to me." "There's got to be a reason why she's throwing everybody off," said Armes.

Meanwhile, Gabriel's father, Logan McQueary, is getting his own team together to retrace Elizabeth Johnson's steps. They plan to make a road trip to Texas, passing out flyers along the way, and searching for any possible places Johnson may have spent the night before reaching San Antonio.

Armes said he thinks Gabriel was "adopted underground," and that he and his team have recovered hundreds of children who went missing in such arrangements around the world.

The investigator said he solves cases by following every lead, like the rumor that a woman on the other side of the country adopted a baby named Gabriel the same day Gabriel Johnson went missing.

rmes said another key to his success is tough interrogations and deeper probes of "persons of interest," like Jack and Tami Smith, who were friends with Elizabeth and had hoped to adopt Gabriel.

"I think there's something there," said Armes about the Smiths. "Where there's smoke, there's fire, and I think they should be doing a background on them since the day they were born."

McQueary said he has not agreed to work with Armes yet, but does plan to meet with him in the near future.

Nearly a dozen members of the McQueary family were huddled in a hotel room Monday. All of them were working laptops, cell phone, printers, and maps tacked to the wall.

Logan McQueary will set out for San Antonio Tuesday with his cousins, Lisa and Joe Peters. Lisa just flew in from Egypt to help in any way she could.

But their task is made harder by the fact that Elizabeth Johnson is the only one who knows where she stopped and who she met on the way. And Elizabeth is not talking.

"I wish she would tell Logan the truth, all of us the truth, but we'll find Gabriel without her if that's what we have to do," said Sandy Peters.

Officers have arrested person-of-interest Tammi Smith on Tuesday morning in connection with the disappearance of baby Gabriel Johnson, authorities said. According to a statement from the Tempe Police Department, Smith will be charged with conspiracy to commit custodial interference, custodial interference and forgery.

Upon hearing of the arrest, a thrilled McQueary said it was a long time coming, and he has always maintained that Smith knows more than she told police.

He and his family, who are on a road trip to San Antonio to retrace Johnson's steps, said they believe the arrest is another clue that may ultimately help police find Gabriel. Nevertheless, not all are optimistic that Gabriel is still alive.

The father of a missing Arizona infant last seen in San Antonio in December is en route to El Paso, where he plans to meet with internationally-known private investigator Jay J. Armes.

Armes said he and Logan McQueary of Tempe, Ariz., the father of 8-month-old Gabriel Johnson, will discuss the investigation Tuesday evening and plot their route to San Antonio, where they will retrace the baby's mother's steps.

&#8220;We will decipher every iota of information,&#8221; Armes said Tuesday morning, adding both he and McQueary are hopeful they'll find Gabriel. &#8220;Right now, I feel that Gabriel is still alive, because there haven't been any sightings of a cadaver.&#8221;

Armes said he will work with three other private investigators in California, Austin and Houston. Combined, the team has more than 135 years of experience, said Armes, who runs a company called The Investigators.

Already, investigators with the Tempe Police Department, FBI and San Antonio police tried to find Gabriel, but Armes said he plans to look into claims other agencies already determined to be false.

&#8220;We have to interview everyone that they've talked to,&#8221; he said. &#8220;The more investigators on the case, the better.&#8221;

Smith was arrested at 11:10 a.m. at her home in north Scottsdale. Police arrived at the house in an unmarked car and handcuffed her in front of her 4-year-old daughter, Tammi Smith&#8217;s husband, Jack Smith, told the Tribune Tuesday.


Jack Smith said he is &#8220;mad&#8221; about his wife&#8217;s arrest, that Tammi and he have done nothing wrong, and that there will be a &#8220;day of reckoning.&#8221;

&#8220;We have been bullied, and I&#8217;m tired,&#8221; he said. &#8220;They&#8217;ve thrown the gauntlet down. We&#8217;ve done nothing, so how could there be a conspiracy? Police are trumping up these stupid and idiotic charges, and they have no proof. They can&#8217;t connect dots A and B, much less B and C. &#8220;We&#8217;ve done nothing but try to help enlist in this fight to get that girl and the baby back here after she took off, and to find the child.&#8221;

Jack Smith said that Tammi made a mistake about writing Cherry&#8217;s name on the court document, but that she didn&#8217;t sign the document and didn&#8217;t file it. &#8220;Tammi was in the wrong place at the wrong time,&#8221; Jack Smith said. &#8220;She had no business being a part of that girl&#8217;s fight. We&#8217;ve done nothing but try to be good people through all this.&#8221;

Tempe police concluded their role in the case of missing Baby Gabriel Johnson hours after arresting a Scottsdale woman Tuesday on charges of trying to pressure the child's father into signing over his rights to the boy. Authorities still say they do not know the whereabouts of the 9-month-old baby. The investigation is now in the hands of police in San Antonio, where Gabriel was last seen.

"We've done nothing; we did nothing wrong," Jack Smith said Tuesday after his wife's arrest. "They have bullied us from the beginning. And they're bullying us now . . . We have nothing to do with Gabriel being gone. There is no proof."

Tammi Smith is accused of providing the baby's mother with contacts for a place to stay and adoption advice after Elizabeth Johnson fled with the child in mid-December. At the same time, police said, Smith called and texted the boy's father, trying to bully him into signing over his custodial rights. Her goal, said Tempe Lt. Mike Horn, was to adopt the baby.

According to Smith's arrest documents, she texted McQueary and told him "The only way she'll come back is if my attorney faxes the signed papers to her so she won't get in trouble and Gabriel (would be with us)."

Two days later, police interviewed Tammi Smith and asked how she would "handle the fact that Logan McQueary refused to sign over his custodial rights."

She replied by telling police she intended to use her attorney to pressure McQueary to pay past child support and future support in the hopes that it would be enough to make him concede his rights. She told police then that she hoped that pressure would be enough for her to eventually adopt Gabriel. :furious:

Tempe police said in a news conference Tuesday that they started forwarding any new leads on the whereabouts of the baby to San Antonio police. Tempe police have said in the past that any additional charges, including homicide, would have to come out of Texas since that's where the boy was last seen alive.


Tempe police initially thought the baby was still alive because Tammi Smith continued communicating with the mother about adopting the child even after he disappeared, Lt. Horn said. But when Johnson began to spurn Smith's help during her trip through Texas, Smith began begging her to return to Arizona.

Smith was initially being held at the Tempe Police Department, but has since been transported and booked into the Maricopa County Jail.

As the 37-year-old was being escorted into the jail, she told reporters, "We all knew this was going to happen. I am innocent and God is with me."


Smith has been arrested for three charges including:
*1. Conspiracy to Commit Custodial Interference (A class four felony)
*2. Custodial Interference (A Class four felony)
*3. Forgery (A Class four felony)


ABC15 learned Tuesday afternoon that Jack is no longer considered a person of interest in the case.

However, Jack Smith said he is outraged at the charges against his wife. "Those are trumped up charges. Those have no substance to them whatsoever," he said.

Jack Smith said he and his wife both have been cooperative with police and have even reached out to them several times during the investigation to share information. "I feel betrayed because we have done everything," said Jack Smith. "I feel so bullied right now. I feel like there's a bully in the yard that's doing everything they can to try to provoke me into something."

In a text message to ABC15's Corey Rangel, McQueary said Tuesday about Smith's arrest, "I am very happy. Maybe this is what we need to get her to tell the truth and find Gab, stir things up a bit and see what comes out of it."

"It is a very real possibility that Elizabeth killed Gabriel," said Tempe Lt. Mike Horn said. "We are holding out hope that he's alive, but we have to look at every aspect and investigate everything."

Tempe police have arrested Tammi Smith for a list of charges related to custodial interference in the case of a missing Tempe baby.

She is facing conspiracy to commit custodial interference, custodial interference and forgery charges. Smith was booked into the Maricopa County Jail for these three charges.

Tempe police said Smith has not been truthful during the investigation committing forgery when she filled out custodial court documents for Johnson, claiming that Craig Cherry, Smith's cousin, could be a potential father to baby Gabriel. According to police Smith tried to recruit several people as potential fathers. Smith also allegedly reached out to a family court judge and made several false statements to investigators.

Tempe police said Tuesday they do not believe the Smiths have any idea where baby Gabriel is.

Tammi Smith, 37, was being taken to Tempe police headquarters and later will be booked into Maricopa County jail on charges of custodial interference, conspiracy to commit custodial interference and forgery, Sgt. Steve Carbajal said.

Jack Smith did not answer his cell phone, and his voicemail box was full. It's unclear whether they have a lawyer.

Tammi Smith told The Associated Press last week that she had nothing to hide.

"Since the beginning I've been asking police to look through our computer and get whatever they want because it proves my innocence, so I'm not concerned," she said.

Managers of a San Antonio landfill have blocked off an area that might be searched for the baby, but police said they hadn't yet searched the site and decline to say whether they plan to do so. As late as last week Tammi Smith was saying she had nothing to do with Gabriel's disappearance, inviting the police to search her computer saying she had "nothing to hide."
