Missing mother 'probably in a ditch'

THE former partner of murdered mother Carly McBride said her accused killer, Sayle Newson, paid him three visits in the 24 hours after she disappeared, including one where Mr Newson allegedly said Ms McBride was "probably dead in a ditch somewhere".


Mr Easton said Ms McBride seemed "preoccupied and distant" during the visit before she suddenly left "out of the blue".
 
No argument before Carly vanished: ex

THE ex-partner of murdered mother Carly McBride has refuted claims the pair argued immediately before she suddenly left his home at Muswellbrook and disappeared. Andrew Easton, the father of one of Ms McBride's children, gave evidence for a second day on Thursday during Sayle Kenneth Newson's murder trial in Newcastle Supreme Court.


Mr Easton gave evidence on Wednesday that Ms McBride came to visit their daughter, but decided to leave "out of the blue" before the young girl came home from day care.

Mr Easton claimed Ms McBride had said she was headed to the nearby McDonald's to be picked up.

But Ms McBride never made it and it is the prosecution case is that Mr Newson, jealous and on an ice binge, intercepted Ms McBride and killed her by inflicting a number of blows to her head and back. Her body was found in bushland about 25 metres from Bunnan Road at Owens Gap on August 7, 2016.

Under cross-examination from Mr Newson's barrister, Philip Massey, Mr Easton denied he and Ms McBride argued at his home on the afternoon she disappeared.

"It's not the case that you told her you had a girlfriend and she got angry and left," Mr Massey asked Mr Easton.

"It's not the case, no," Mr Easton replied.

"Ms McBride had come some distance to see her daughter, hadn't she?" Mr Massey asked. "And just all of a sudden between 1.45pm and 2pm, just out of the blue she said I'm going."
 
'You're looking for a body'


AGITATED and jittery as he repeatedly gesticulated and paced around the reception area of Muswellbrook police station, the man accused of murdering Carly McBride became frustrated and before leaving the station told a police officer "you're looking for a dead body", a jury has heard.

"I just found Mr Newson was going above and beyond to find Ms McBride and [inquiring about how many missing persons are found]... I personally had never had anyone ask that before
 
Carly McBride's murder trial aborted, jury discharged after seven weeks of evidence

THE trial of Sayle Kenneth Newson, accused of murdering his girlfriend, mother-of-two Carly McBride in 2014, has been aborted and the jury discharged after they inadvertently heard "highly prejudicial" evidence earlier this week.

"On Wednesday afternoon I gave you a direction to disregard certain evidence that involved an allegation against one of the accused that was irrelevant to the charges faced by both of them," Justice Mark Ierace told the 15 jurors.

"I'm sure it would come as no surprise to you that it was highly prejudicial in its nature."

Justice Ierace said the evidence was led mistakenly.
On Thursday, defence barrister Phil Massey, for Mr Newson, and Public Defender Peter Krisenthal, who represents James Cunneen, who is accused of accessory after the fact in the murder of Ms McBride, made applications to have the jury discharged.

"Even if you think that you as the jury could put that evidence out of your mind it was so prejudicial in its nature there would reasonably be question of whether it was capable of being put to one side," Justice Ierace told the jury.

"At the end of the day the paramount consideration is that the accused trial is fair.

"Accordingly, I have come to the conclusion that the appropriate course is to discharge you.

"To say this turn of events is regrettable, particularly, after seven weeks is an understatement."

Justice Ierace thanked the jurors for their diligence before they left the courtroom for the final time.

Trial of the man accused of killing Carly McBride to restart in 2020

The case was sent back to the Sydney Supreme Court arraignment list, where on Friday the trial was listed to begin again on May 4, 2020 - nearly a year after the first trial commenced.

This time around the trial was given a slightly shorter estimate of eight to 10 weeks.

Both Mr Newson, who is represented by barrister Phil Massey and solicitor Mark Ramsland, and Mr Cunneen, who is represented by Public Defender Peter Krisenthal and solicitors Chris O'Brien and Kristy Winter, have retained their legal representation. Justice Ierace will again preside over the trial in Newcastle Supreme Court.

It'd make sense that seeing it's the same judge & legal teams that maybe they should have gone with a judge alone trial & just picked up from where it ended ( they have all heard the evidence ) .......

Anyone know if that's even possible??

Alleged NSW body dumper granted bail

James Anthony Cunneen, from Muswellbrook in the Hunter region, was on Tuesday granted bail in the Sydney Supreme Court.

The 29-year-old was granted strict bail by Justice Mark Ierace including that he report to police daily and undergo twice-weekly drug tests.

He said Mr Newson put on "a very, very public display of concern" over Ms McBride being missing, which included doorknocking local homes and showing her photo to local businesses.

But he said within days of her disappearance, Mr Newson was privately messaging other women asking for sex and saying he was single again.

The jury of 10 women and five men will travel to the Upper Hunter on Wednesday and Thursday this week to view several locations significant to the trial.

I like the fact there are 10 women on the Jury in this day's current climate of Women being harassed, targeted, abused etc etc.

Revealed: Carly McBride’s alleged killer’s sex messages hours after disappearance

following the discovery of her remains in 2016, Mr Newson phoned Ms McBride’s father Steve.

During the call Mr Newson mentioned that “somebody was in possession of the deceased’s hand”, Mr Carr told the court.

Mr Carr said at that point it was not public knowledge that her skeleton was intact apart from her hand and a forearm bone, which were missing.

“That call wasn’t caught on a (police) telephone intercept,” Mr Carr said.

“But in a later conversation that was recorded, he acknowledged such a conversation.

“The only persons who knew about the hands were the police, Steven McBride, the deceased’s mother and the forensic medicine department at the John Hunter Hospital.”

Mr Carr said that when police searched Mr Newson’s mobile phone, they discovered he had deleted Google location services between September 18 and October 2, 2014.

After kicking off on Tuesday last week, where two days were spent showing jurors points of interests in the case across Muswellbrook and Scone, the trial came to a halt just a week later, with defence barrister Phil Massey unable to continue.

Justice Mark Ierace told the jury over the Easter weekend Mr Massey had a “serious medical issue” and was in hospital awaiting an operation and was expected to make a full recovery.

“The trial is delayed until alternate arrangements can be made by another barrister,” Justice Ierace said.

“I ask you to come back to court on Friday, we cannot sit until that is addressed.”
