FERAL animals could not explain the distance Daniel Morcombe's remains were found from where Brett Peter Cowan pointed them out ...
Defence barrister Angus Edwards said testimony from wild animal experts maintained a whole body was unlikely to have been moved the 50 to 75 metres...
"This is thick bushland, dogs didn't drag the carcass from where Mr Cowan said he went," he said... "There's not a bone left behind in the area where he says he put Daniel. "The spread of bones in the area suggests that is where the bones were put by whoever put it there...

Justice Atkinson said it should not be assumed that because Cowan did not give evidence, it would add weight to the case against him.

She said the jury could draw logical and rational inferences from the facts.

“You are not to indulge in intuition or guessing,’’ she said.

Justice Atkinson told the jury in order to convict the accused of murder it needed to be satisfied of four things: that Daniel Morcombe was dead, that Cowan caused his death, that the killing was unlawful and that the defendant did so intending to cause his death or grievous bodily harm.

She said there was a possibility the death was an event that Cowan did not foresee, that is it was an accident.

In that event, it would need to find Cowan not guilty, she said

The lawyer for Daniel Morcombe's accused killer Brett Peter Cowan has continued to point the finger at a convicted child sex offender, saying he was like a "snake passing a wounded mouse".

Mr Cowan's defence counsel Angus Edwards continued his closing address to the jury on Tuesday, detailing Jackway's criminal history.

"The best predictor, you might think, of future behaviour is past behaviour," Mr Edwards said
