12:22PM By Tuck Thompson EXCLUSIVE: LAWYERS are gagged from confirming indications that Gabe Watson has been ordered to stand trial in the US charged with killing his wife on their honeymoon.

If the grand jury did charge Watson, he would likely be deported under guard from Queensland when his sentence expires mid-November and be arrested by US authorities once his plane lands on American soil.

He would then likely face a trial in Alabama next year.

Two lawyers for Watson, Brett Bloomston and Joe Basgier, held a press conference outside the Jefferson County Courthouse where the grand jury sat and blasted Mr King and Mr Valeska for attempting to try Watson despite the case being finalised in Queensland.

"Today is a very sad day for the state of Alabama and for our judicial system," Brett Bloomston told reporters.

American Gabe Watson is expected to be deported when he leaves jail next month after completing a sentence for the death of his wife.

Watson, 32, a bubble-wrap salesman from Alabama, pleaded guilty to contributing to the death of his wife of 11 days, Tina, who died on a scuba diving trip to the Great Barrier Reef off Townsville in 2003. The decision by the Queensland Director of Public Prosecutions to charge Watson with a relatively minor manslaughter charge instead of murder provoked outrage in US, particularly from the friends and family of the victim.

Gabe Watson was released from prison today in Brisbane and quickly put on a flight to Melbourne where he will sit in a detention centre while Australian officials do what they do best- officiate. The Australian Gov claim they are seeking FURTHER assurances from Alabama that Gabe Watson will not face the death penalty, when he is deported from Australia. Gabe Watson is expected to be arrested and charged (the moment his feet touch American soil) with the murder of Tina Watson, his wife, when they were on their honeymoon on The Great Barrier Reef.

This has been a very long time coming and I know that Mr Thomas, Tina's father does not blame the Australian public for the absolute travesty of justice that was done to his daughter by the Qld Government.

It won't be long now Mr Thomas.

Gabe Watson tried to forget about Tina but we never did.

Australia is the place to commit murder I guess! Shocking how short a sentence for death is???? Wow.

It does seem odd though if you are tried and sentenced in one country (and assuming you received a fair trial/sentence and paid your "time") you can be tried in another country and have to go through it again in another country for the same crime? Now, I'm not saying i don't want this guy in prison, because I do feel he should be there a long time. Just doesn't seem fair (not for murder cases but for other crimes).

I think when he plead out to the manslaughter charge all he plead guilty to was a failure to provide assistance - that's basically what it boiled down to, which was complete BS, because the Qld detectives were ready to prove their case that Gabe Watson actually turned off Tina's air supply. So originally he recieved a 12 mth sentence but due to the outraged cries of the Australia public it was then increased to a whopping 18 mths - whoopy doo!

You are absolutely correct - Come to Australia and murder your wife of 10 days on your honeymoon and the Justice system in this country will make a mockery of your life.

I understand what you mean but there is no double jeopardy involved (I think) due to what Alabama are going to arrest and charge him with. I believe he will be charged with conspiracy to commit murder whilst on US soil, which is a different crime.

Mr Braithwaite said his client was upset about being held in immigration detention and was looking forward to returning home.

He said he saw Watson, a former bubblewrap salesman, last night.

"He is upset about the process, there is no doubt about that," Mr Braithwaite told AAP.

"He was looking forward to going back to the States."

Immigration officials have told Mr Braithwaite it could be some time before his client was released from detention.

"When I spoke originally to immigration about that issue they basically said it could be weeks but it could be months - they didn't know," he said.

HA! I bet Watson is unhappy with the detention centre, I don't think it is a cushy as his prison cell. Watson has a wonderful welcoming committee ready for him (Alabama LE) who can't wait until they welcome him home with open arms, and then it will be straight back to jail until he awaits trial.
 
I have a hard time invoking any sympathy for this guy....too bad he's homesick! I hope he's absolutely miserable in his new surrounding at the detention center!

That photo of Tina laying dead on the ocean floor is one of the most haunting images I have ever seen.
 
Although I am eager to have Watson return to Alabama and stand trial, I am glad to hear that his misery continues in Oz at the detention center.

I grew up in Alabama. When I was a kid we would travel 60 miles to Birmingham to visit relatives. I remember seeing the 'chain gangs' cleaning the sides of the interstate complete with corrections officers armed with rifles keeping watch. I don't know if Alabama corrections still use 'chain gangs' ( I moved away 23 yrs ago) but I keep envisioning a chained Watson in the stifling Alabama heat picking up trash on the side of the interstate. Hey a girl can dream, eh?

The 32-year-old former bubble wrap salesman is expected to be deported from Melbourne on Thursday in time for American Thanksgiving celebration, after two weeks at the Maribyrnong Immigration Centre.

YW :) I'm dreaming there with you Waltzing! Nothing will ever erase the memory of Watson using bolt cutters to remove flowers from Tina' grave that her family had laid there.

Not long now till Watson is on US soil to be arrested again. I have a bottle of Champagne with his name on it just waiting to be popped.
 
It is prolly just me, but I find it creepy that Watson is a bubble wrap salesman, considering he 'allegedly' turned off Tina's air supply! This guy really creeps me out!!!

So he's facing murder charges but, per agreement with AU, he will not, if found guilty, be sentenced to death. In this case I think that LWOP would be even worse for him than the death penalty, which (IMO) would be too kind (lethal injection) compared to how he killed his wife. For a guy who loves scuba diving, and obviously enjoys his freedom TOO much, LWOP will be perfect! Justice for Tina and prayers for her family and friends during this next, difficult phase.
 
I live in the Birmingham area, and have followed this case closely. Three specific things about Gabe's actions bother me: 1. he asked Tina to sign a life insurance policy just before their wedding - according to the local news here she did not sign the papers, but left them at her parents' house. (The media has made not comment that I have seen regarding whether Gabe was aware the papers were not signed prior to the honeymoon.) 2. Gabe was a certified rescue diver, yet he did not stay to help his new wife, but instead said he went for help; 3. A videocamera at the cemetery where Tina is buried captured pictures of Gabe removing flowers from Tina's grave. His attorney said he did that because the cemetery did not allow any flowers on the grave, but if it were my spouse I would let the cemetery remove them as I could not, for sentimental reasons. I will look for the article links for the above info and will put them in a subsequent post. But those three specific things make me lean heavily toward "guilty", IMHO.
 
Thanks for the update on this Passionflower! This news must be an immense relief to Tina's family - I know they have fought tirelessly to get justice for her. I don't think I will ever forget that eerie photo taken of Tina as she was lying on the ocean floor....gives me chills everytime I think of it.

And that was news to me about Gabe removing flowers from Tina's grave - what a jackass! Thank God he's behind bars - where he should be.

This has finally left our shores. I can't express to people how much this means to us. The drinks are flowing, let me say that.

Honeymoon killer Gabe Watson is on a flight to the United States, where he is expected to face a murder charge over the killing of his wife Tina, during a scuba dive seven years ago.

The 33-year-old American had been held at Melbourne’s Maribyrnong Detention Centre following his release from a Brisbane jail on November 11, as immigration officials scrambled to secure an assurance from the US that he would not face the death penalty upon his return.

Watson finally boarded a plane bound for the US from Melbourne about midday today (AEDT), under the escort of federal immigration officials and Queensland Police.

It is expected he will be immediately taken into custody by US authorities upon his arrival.
