GUILTY CA - Anthony Avalos, 10, possibly died after abuse by mother, Lancaster, 20 June 2018 *arrests*

Would anyone know why she is charged with murder, torture, and child abuse while he is charged with murder, torture, and assault on a child causing death?

Rachel Bond (Bella Bond's Mother) comes to mind... She testified against boyfriend (alleged he was the physical killer) and is walking free.

Arraignments postponed for pair accused in torture and slaying of 10-year-old Anthony Avalos

AUG 03, 2018

"The arraignment of a Lancaster mother and her boyfriend facing felony charges in connection with the death of 10-year-old Anthony Avalos was delayed Friday after a judge approved new attorneys for the two.

Superior Court Judge Richard E. Naranjo granted a continuance after permitting new counsel to defend Heather Barron and Kareem Leiva, accused of torturing and murdering the boy, whose small body was bruised and wounded from head to toe.

Barron, 28, who faces an additional count of child abuse and Leiva, 32, who also faces a count of assault on a child causing death, stared at the floor during the Friday hearing in a Lancaster courtroom.

Prosecutors say Anthony was whipped, beaten and body-slammed into a dresser in the days before he died....

Barron faces 22 years to life in prison and Leiva faces 32 years to life in convicted. They were scheduled for arraignment on Oct. 3."

The case of 10-year-old Anthony Avalos, allegedly abused and killed by his mother and her boyfriend Lancaster, nearly two months ago, on June 21, is “very dissimilar to the notorious and awful 2013 death of Gabriel Fernandez,” according to a new report from Judge Michael Nash, head of the Los Angeles County Office of Child Protection.

In June, the LA County Board of Supervisors approved a motion from Supervisor Kathryn Barger to commission a report seeking information on the circumstances surrounding Anthony’s death, especially considering the boy had repeatedly been on the radar of the LA County Department of Children and Family Services.
[.....]
Tuesday’s report, however, said Anthony’s case was dissimilar to Gabriel’s in that there were at least 12 social workers (not including supervisors) involved with the Avalos family, and that those social workers responded to more than a dozen calls from family members and others about suspected child abuse of Anthony and his siblings (including sexual abuse, in Anthony’s case).

The last visit by social workers to check on Anthony was two years before Anthony’s mother and her boyfriend, Kareem Leiva, allegedly murdered Anthony.

Many 'Red Flags' but No One to Save Him: Inside the Short Life and Slow Death of 10-Year-Old Anthony Avalos

October 05, 2018

"Ten-year-old Anthony Avalos loved playing sports and being outdoors. He was known for his kindness and inclusive spirit, and he stood up for people who could not stand up for themselves.

“If someone was getting bullied, he would tell the bully that it wasn’t nice, to leave them alone,” Anthony’s uncle David Barron tells PEOPLE.

But while Anthony was protecting others, who was protecting him?...

According to prosecutors, Anthony’s mother only reported the injuries — bruises, cuts and a brain injury among them — once he could no longer take any more pain.

Speaking with PEOPLE, his uncle David wonders darkly if his death was not some kind of mercy.

“Because he was on summer vacation … who knows how much he would have had to suffer if he were still here?” David says.

“Maybe passing was better for [Anthony],” he explains, “because he didn’t have to suffer anymore.”...

The abuse in Anthony’s home, which dates back at least to 2013, exposes the rending question at the heart of such cases: Could something — could someone — have been done differently to save this child?

According to a review of how social workers handled Anthony’s case, completed by the L.A. Office of Child Protection, “That question cannot be answered.”..."

From the article Eleven_11 posted:

At a July 17 news conference, an attorney representing the boy's family called for a criminal investigation into social workers who investigated allegations of abuse in the household. Brian Claypool said there were red flags and the house was "replete with horror."

Hoping Social workers get charged as in Gabriel Fernandez' case!!! Guessing their names haven't been released?

Lancaster mother, her boyfriend indicted in murder of young son

LANCASTER, Calif. (KABC) -- A Lancaster mother and her boyfriend have been indicted in a case stemming from the torture and killing of the woman's 10-year-old son, Anthony Avalos, and the abuse of two other children.

The grand jury indictment was unsealed Wednesday morning in court, where Heather M. Barron and her boyfriend Kareem E. Leiva each pleaded not guilty to the capital murder and torture of Anthony, abuse of a child named Rxxxx, and abuse of a child named Dxxxx.
I *advertiser censored*'d out the 2 childrens' names.

[.....]
Barron and Leiva are scheduled to appear at a pretrial hearing Dec. 3. On that day, prosecutors are expected to announce whether they will seek the death penalty for the defendants.
[.....]
Claypool (family's attorney) went on to call for "holding the L.A. County DCFS responsible for the murder and the torture of Anthony and these other kids as well," making reference to the death of 8-year-old Palmdale boy Gabriel Fernandez after prolonged, horrific abuse at the hands of his mother and her boyfriend.

TOTALLY agree with the last paragraph above!!!

The articles says Dec. 3rd for pretrial, but the court site still says 11/27.

Judge unseals grand jury transcript in Anthony Avalos' death (with clip)

DEC 03 2018

"FOX 11/CNS) - The grand jury transcript was unsealed on Monday in the case of a Lancaster woman and her boyfriend, who are accused of torturing and murdering her 10-year-old son.

Heather Maxine Barron, 29, and Kareem Ernesto Leiva, 32, have pleaded not guilty to charges that they killed Anthony Avalos and tortured him in the days leading up to his June 21 death.

Los Angeles Superior Court Judge Kathleen Kennedy heard arguments from lawyers for the Los Angeles Times and members of the victim's family before ordering that the transcript be made available to the public, though some exhibits that both the prosecutor and a defense attorney agree could be prejudicial will remain sealed pending a hearing set for Jan. 11.

Leiva's attorney, Dan Chambers, had objected to the release of the transcript, saying it could hurt his client's chance for a fair trial, while Avalos family attorney Brian Claypool said the boy's relatives had been waiting seven months for access to the autopsy report and other information and deserved to know what happened...

The charges against Barron and Leiva include a special circumstance allegation of murder involving the infliction of torture. Hatami said a decision whether to seek the death penalty might be settled in March...."

Eyewitness News has obtained a copy of the lengthy document, which describes in detail what happened to Anthony during the last day of his life.

Anthony's mother, Heather Barron, and her boyfriend, Kareem Leiva, are charged with torturing and murdering the 10-year-old boy. The grand jury heard the evidence the prosecutor has against the defendants and decided to indict them....

The grand jury also heard from Anthony Avalos' 8-year-old younger sister. According to Hatami, she too was abused by her mother Heather Barron, and her mother's boyfriend Kareem Leiva...."

Uncle loses Avalos custody fight
Appeal planned for slain boy’s siblings

1/12/19

"LOS ANGELES — A man who reported that his 10-year-old nephew was being abused before the Lancaster boy was allegedly tortured and murdered is planning to fight a decision by the Los Angeles County Department of Children and Family Services that denied him and his wife custody of two of the boy’s half-siblings, the couple’s attorney said Friday.

“They deprived this loving couple of two beautiful kids, who were also abused, of having a loving home. The sole reason why L.A. County DCFS did not allow this family to take in these two kids is because they posted a negative picture on social media that made DCFS look bad,” attorney Brian Claypool alleged. “That’s how evil and wicked this Department of Children and Family Services is.”

In a statement, the Department of Children and Family Services said, “Given the sensitivity of our work and the privacy of the children involved, we cannot comment on the particulars of any family. But in all cases, the Department of Children and Family Services makes every effort to place children with family whenever possible. Through a department-wide commitment to maintaining family connections there are often multiple relatives that come forward to care for the children. It is a comprehensive process that is guided by the best interests of the children. And ultimately, it is the court that determines the most appropriate placement.”

Claypool — who is planning to file two lawsuits including a wrongful death complaint in connection with the June 2018 death of Anthony Avalos — told reporters at the downtown Los Angeles criminal courts building that he also intends to file a petition seeking a court reversal of the DCFS decision and to grant custody to the children’s aunt and uncle, Maria and David Barron.

Meanwhile, the boy’s mother, Heather Maxine Barron, 29, and her boyfriend, Kareem Leiva, 33, remain jailed without bail while awaiting trial on torture and murder charges, along with the special circumstance of murder involving the infliction of torture....

The Los Angeles County District Attorney’s Office is expected to decide by April whether to seek the death penalty against the two, who were indicted last Oct. 30...."
