Miles of evidence and lines of people to testify?

I was a juror on a murder trial and it lasted 11 weeks (including our 4 days of deliberation). A post above mentioned that part of the evidence in this case is “hours of surveillance footage” (which was similar to mine) and it’s amazing how evidence like that can eat up time IMO.

While much of what will be presented at trial over the next couple months remains unknown, there are some things that will certainly happen.

There will be multiple child witnesses. In addition to Orrin and Orson, the Wests were caring for two other adopted children and two biological children. At least some will be called to the stand to testify. Included in the indictment is an allegation the Wests induced a minor to commit a crime.

The jury is going to hear from Department of Human Services officials and how the foster and adoption process works. Prosecutor Eric Smith said during jury selection multiple officials will testify.

Smith also told jurors to expect “hours upon hours” of surveillance footage. This will likely include footage both in California City and Bakersfield, where the Wests and the children previously lived.

Law enforcement dug at locations in both cities, and the jury will visit locations in both. Judge Charles R. Brehmer informed them they’ll spend about half a day at one or more locations in Bakersfield, and a full day at locations in California City.

Of course, many members of law enforcement will testify. There will be witnesses from California City and Bakersfield police departments, and likely others that took part in the investigation.

While most witnesses will testify in person, Brehmer said some will give testimony through Zoom.

BAKERSFIELD, Calif. (KGET) — With attorneys, investigators and court records subject to a gag order, there is still little publicly known about what happened to siblings Orrin and Orson West more than two years ago.

That’s about to change.

On Tuesday, the trial of the boys’ adoptive parents begins. Trezell and Jacqueline West are charged with second-degree murder, involuntary manslaughter and other offenses and face life terms in prison if convicted.

Finally, details that have remained hidden from the public will start coming to light, among them the evidence that led prosecutors to conclude Orrin, 4, and Orson, 3, are dead and that the Wests are responsible.

The defense, for its part, will argue the couple didn’t kill the boys. During jury selection last week, Timothy Hennessy, one of the attorneys representing Trezell West, said the boys may not even be dead, just still missing.

All non-confidential court proceedings have been open to the public and fully accessible to the participants and the public since February 18, 2022.

The Court originally implemented audio livestreaming as an emergency and temporary measure to provide the public with remote access to non-confidential proceedings during the pendency of the COVID-19 pandemic, when in-person access to court facilities and proceedings was restricted due to social distancing and other public health measures.

Now that Court proceedings may take place in person, without restriction, livestreaming access is no longer required.

Conducting proceedings in person and without livestreaming helps (1) ensure that witnesses feel free to testify uninhibited and without interruption; (2) maintain the security of court proceedings against unauthorized recordings and leaks; and (3) ensure the dignity and decorum of the courtroom setting.

1. If, despite the fully accessible nature of the courthouses, a member of the public has a need to access the proceedings remotely via audio livestreaming or video, the individual may submit mandatory Local Form KRN SUP CRT MI-0315 no less than five (5) court days prior to the date of the scheduled matter. Forms can be emailed to [email protected] Forms filed outside the five (5) court day window will be considered if good cause for the delay in submission of the form is shown. * If you are a party in a case, you must contact the division. 2. A judicial officer will issue an order on the request for audio livestreaming and/or video remote access. If the request is granted, the audio livestream for the particular courtroom will be available on the court’s website under “Remote Court Hearings,” under the courtroom (Department or Division) for which access was granted.
3. Even after a court order is issued, each judge retains the discretion and authority to refuse, limit or terminate audio live streaming, for portions of proceedings, pursuant to the factors and prohibitions articulated in California Rules of Court, rule 1.150 and in consideration of other statutory and constitutional provisions.
4. The livestreamed court proceedings may not be photographed, recorded (audio or video), or re-broadcast by anyone without prior written judicial authorization consistent with California Rules of Court, rule 1.150, and Kern County Superior Court Standing Order 19-0005.
5. Violation of this order of the Court is punishable as contempt pursuant to Code of Civil Procedure § 1209.
