I hope you are right----
I listened to the other jury member testify the day the hearings ended until March 16th. He said Richelle came into the jury room and said 'Scott has to pay for what he did' or something like that. Because she was an alternate. The jury member explained they had a process and they had to start their deliberations from the beginning because she was new to the deliberations. After that she went along with the established process for deliberations. I don't see this as grounds for a new trial. He would just get convicted again, but the judge did not seem very impressed with the defense, and she is the one that will decide, I don't see it happening.

Supreme Court denied a new trial in the guilt phase but reversed the death penalty sentence for Stanislaus County. Also the San Mateo Superior Court will now consider whether there was jury misconduct. Stanislaus County district attorney’s office said it won’t seek the death penalty if there is a new trial.
Re-Sentencing Hearing on 12/8/21. Peterson was moved to San Mateo County jail on 11/29/21 for sentencing hearing. Ordered Peterson to serve life in prison without the possibility of parole for the 1st degree murder of Laci & a concurrent sentence of 15 years to life for the 2nd degree murder of Conner.

3/1/22 Update: Day 3: In an effort to convince a San Mateo County judge to overturn Peterson’s 2004 murder conviction & order a new trial, his lawyers tried to show Tuesday that controversial juror Nice was biased against him from the start & showed an unusual attachment to the unborn child by calling him “little man.”
Defense witness: former juror Greg Beratlis. As the former juror put it, “I just felt she was pretty strong willed & had her opinion.” Beratlis also described her demeanor during the trial as an “emotional wreck,” & that during the trial she looked “tired, worn out.” Under cross examination from Dave Harris, Stanislaus County’s senior deputy district attorney, Beratlis acknowledged that a number of jurors were emotional during the trial that involved the killing of a 27-year-old woman who was eight-months pregnant. Also Tuesday, the judge postponed until March 24 the remainder of the evidentiary hearing that was supposed to end this week, giving Peterson’s lawyers more time to determine whether Nice first discussed a book deal before the trial concluded. When the hearing concludes, Judge Anne-Christine Massullo will have 90 days to decide whether to grant Peterson a new trial, which would bring renewed attention to a blockbuster case that became a national obsession & drew nearly 1,000 people to the courthouse steps to cheer the verdict. A status hearing is scheduled on 3/16/22 & evidentiary hearing continues on 3/24/22 & 3/25/22.

So-called new evidence from a witness that led to a two-week hiatus in Scott Peterson’s evidentiary hearing won’t make it into testimony after all.

Peterson’s attorneys said in a statement filed with the court Monday and confirmed during a hearing Wednesday that they no longer are seeking to question documentary filmmaker Shareen Anderson about a conversation she had with Peterson juror Richelle Nice.

Anderson interviewed Nice for the A&E documentary “The Murder of Laci Peterson” and was scheduled to testify March 1 about a photo she saw in Nice’s home. But during a Zoom trial-preparation session with Peterson’s attorneys Feb. 28, she said Nice had mentioned getting into a possible book deal before the 2004 trial concluded, which would impeach Nice’s testimony that she didn’t discuss a book deal until after the trial.

However, in an interview with a San Mateo County District Attorney’s Office inspector on March 3, Anderson says her memory about the timing of the book deal is “fuzzy” and she is “not certain” it was during the trial.

Consequently, Peterson’s attorneys withdrew their request to the court to question Anderson about this aspect of her interview with Nice. Judge Anne-Christine Massullo agreed on March 1 to continue the remainder of the hearing to March 24 and 25 to give time for the prosecution to prepare for cross examination. When the new information came up at that March 1 hearing, Stanislaus County Special Assistant District Attorney Dave Harris called it “extremely late (and) highly suspect.” Peterson’s team maintained that while Anderson in previous interviews had mentioned the book deal, Feb. 28 was the first time she’d suggested it occurred during the trial. Nice and other jurors did, after the trial, co-author a book about the blockbuster case in which they convicted Peterson of murdering his wife, Laci Peterson, and their unborn son, Conner.

Gregory Beratlis, who served on the jury and co-authored the book with Nice and other jurors, said that on Nice’s first day in the deliberation room, she sat down and blurted out “that (Peterson) should basically pay for killing the ‘little man.’” While Anderson won’t be questioned about any mention of a book deal, she is expected to testify about a photo she saw in Nice’s home of a young child wearing pajamas with the words “little man” printed on them. Nice has testified that she nicknames most children and that “little man” was not a nickname she used for her own sons.

In addition to Anderson, others left to testify include the cameraman who was with Anderson for the interview and possibly, but unlikely, Whiteside, as well as another former juror. The former juror is Justin Falconer, who was excused several months into the trial. Prosecutor Dave Harris said in court Wednesday that the trial judge determined Falconer lacked credibility and called him a “cancer in the jury room.”

Peterson’s attorneys want Falconer to testify about conversations he had with Nice during the trial. They say Falconer said Nice talked about Conner and called him “little man,” told him she was having money problems during jury service but that she wanted to stay on anyway, and that the two of them laughed about getting a book deal once the trial was over.

Massullo said Falconer’s credibility will be considered if he is allowed to testify but she wouldn’t allow testimony about any book deal. “If you are withdrawing your request to have Ms. Anderson talk about the book deal then it seems Mr. Falconer’s statement about a book should fall under that same umbrella and that they are not relevant to this (juror misconduct) claim,” the judge told Peterson’s attorneys.

She said the book deal information could present a new juror misconduct claim at some point in the future but not for the purposes of the issue the California Supreme Court directed her to consider.

Massullo also denied a request by Peterson’s attorneys to allow Falconer to testify remotely as he is “involved with the military” and currently in Iraq.

“It is important that if the court is going to allow this testimony that the court is able to observe him in the same way the court has observed all the other witnesses,” she said. Pat Harris said he would contact Falconer and find out when he plans to return to the United States.

Massullo didn’t give an exact deadline but said he would need to be here “in the next month.”

Unless the hearing is again delayed to give time for Falconer’s return, it is scheduled to resume March 24.

I think the hearings are still a go, as it doesn't say cancelled/vacated. I will check it later today to see if there is an update. :)

So far, these hearings seem like a dumpster fire. Lots of confusion and chaos about whAt testimony will be allowed and if and when certain witnesses will be allowed.
 
The hearing is expected to continue into Friday.

Scott Peterson Back in Court as Lawyers Fight for New Trial
Peterson’s attorneys want her to testify because she allegedly saw a photo of a child hanging on Nice's wall with the words, “Little Man.”

That’s the same nickname the defense claims Nice used when talking to other jurors about Laci Peterson's unborn son.

An attorney for the filmmaker says her client has refused to take the stand.

I don't understand the reasoning behind this. What is the big deal about Nice using the term 'Little Man?'--- I use that term a lot myself.

Maybe it is a Cali thing?

But what does it matter that she had a pic on the wall saying Little man? How does that make a difference in her being a juror in that trial?

3/24/22 Update: Three people were slated to testify Thursday, but the court was still sorting through the day’s plan by the time it took a lunch recess. Thursday's proceeding centered on whether a documentary filmmaker, Shareen Anderson, can be compelled to testify regarding former juror Richelle Nice. An attorney for the filmmaker says her client has refused to take the stand. “Shareen wanted to assert her rights, First Amendment rights of the constitution, not to testify because she is a journalist & journalists have quite important right that protect them from being called on a regular basis,” said Anderson’s attorney Tenaya Rodenwald. The judge is reviewing two cases to see if they provide precedent upon which to proceed. If Peterson gets a new trial, new evidence can be introduced. The judge will have up to 90 days to decide if Peterson gets a retrial or not. The evidentiary hearing is expected to continue into Friday, 3/25/22 (Day 5).

Convicted Killer Scott Peterson Continues Fight for New Trial

On Friday, the Judge ordered Stanislaus County prosecutors and Peterson’s attorneys to submit written arguments by May 25 and reply briefs by June 9. They will return to court June 29 to provide oral arguments before Massullo takes the case under submission for a later decision.

A California home once owned by convicted murderer Scott Peterson and his late wife Laci sold for $50,000 over asking, the Sacramento Bee reported.

The three-bedroom, two-bathroom house at 523 Covena Ave. in Modesto was listed for $459,888 on March 31 and sold for $510,000 on April 21, Zillow said.

Laci and Scott bought the 1949 bungalow with 1,700 square feet for $177,000 in 2000. There have been several owners since then, including real estate agent Gerry Roberts, who bought the house in 2005 for $390,000, the Bee reported. The home sold again in 2007 for $280,000 and in 2013 for $180,000, records posted on Zillow show.

Modesto is one of the many places in California where home prices are rising. The average home value in the Central Valley city was $442,285 in March 2022 and has gone up 22% over the past year, Zillow said.

With a vast front lawn and tall shade trees, the home is located in Modesto's La Loma neighborhood was advertised on Zillow as "move-in ready" with a swimming pool and hot tub, a freshly painted interior and a remodeled kitchen featuring stone countertops, a six-burner gas stove and a built-in wine rack.
