    he is still professing his innocence, IMO he will never admit guilt, so far he has moved his case from DP to LWOP, and a new hearing is going to look into him getting a possible new trial due to juror issues in February 2022, why would he suddenly say he did it,

    just getting off death row is a big win for him. He will be moved to San Matteo County jail for the time being until 2022, what happens after that depends on whether he gets a new trial.

    *Review Hearing (re probation report) (Stanislaus & San Mateo County) (@ 10am PT) – CA – Laci Denise Peterson (27) & Connor (unborn) (missing Dec. 24, 2002, Modesto; found April 13, 2003 in the San Francisco Bay) - *Scott Lee Peterson (30 @ time of crime/now 47) convicted & found guilty (11/12/04) of 1st degree murder (Laci) & 2nd degree murder(son) & sentenced (3/16/05) to the death penalty.
    He was found guilty on 11/12/04 of the 1st degree murder of his pregnant wife, Laci, & the 2nd degree murder of their unborn son, Connor, & in 2005, he was sentenced to death by lethal injection. His case is currently on automatic appeal to the Supreme Court of California. Sits on San Quentin's death row. Calif. Supreme Court denied a new trial in the guilt phase but reversed the death penalty sentence for Stanislaus County. Also the San Mateo Superior Court will now consider whether there was jury misconduct. Stanislaus County district attorney’s office said it won’t seek the death penalty if there is a new trial.

    10/20/21 Update: During the nearly hour-long hearing on Wednesday, Peterson’s attorneys and prosecutors also argued over whether lawyers with Habeas Corpus Resource Center could stay on as his counsel for Peterson’s new trial. Peterson was denied bail ahead of a December hearing where he will be re-sentenced to life without the possibility of parole, Superior Court Judge Anne-Christine Massullo ruled Wednesday. Prosecutors on Wednesday said since Peterson is no longer facing death, his appellate attorneys should no longer be able to represent him because, by law, they only handle death penalty cases. Michael J. Hersek, executive director of the Habeas Corpus Resource Center, which has represented Peterson in his appeal, said the lower court judge does not have the jurisdiction to determine if Peterson’s attorneys should be vacated from the case. The judge ordered Peterson’s attorneys to speak to their client to determine if he would agree to sign a "waiver of irregularities" that could allow them to stay on as his counsel. Both sides will come back on 11/10/21 to discuss the waiver issue. Formal sentencing to ‘life without the possibility of parole’ on 12/8/21.
    11/10/21 Update: On Wednesday, Peterson appeared via a live video feed from San Quentin while Stanislaus County District Attorney Birgit Fladager, defense attorney Pat Harris & Superior Court Judge Anne-Christine Massullo sparred over who will be allowed inside the courtroom when Peterson is re-sentenced to life in prison without possibility of parole. Judge Massullo said, “I have to follow the rules of this courtroom. That’s six feet of distance & masks. That leaves very few options for the court.” The judge said she plans to have 16 seats for Laci’s supporters, 6 seats for Peterson’s supporters & the remaining 15 seats for the public & media combined. A lottery system will be used to decide who sits in those 15 seats. In addition to preparing for the sentencing hearing, on Wednesday Judge Massullo set a date for an evidentiary hearing as part of Peterson’s battle for a whole new murder trial. The evidentiary hearing will begin on 1/25/22 & end on 3/4/22. There will be about 5 hours of testimony each day. Nice will be called to the witness stand as the primary witness. Legal experts said Nice pleading the fifth will help strengthen Peterson’s case. Media cameras will not be allowed in the courtroom for the evidentiary hearing, the judge said. Peterson’s next court date is set for 11/17/21 at 10am so that the judge can review Peterson’s probation report from San Quentin State Prison. He will likely be transferred to the San Mateo County Jail within the next couple weeks. The district attorney has made sure that Peterson will not be granted bail when he arrives as an inmate in Redwood City.

    He gets to address the court on the 8th I think it will be interesting to see what he has to say, anybody know if these hearings will be live streamed

    11/17/21 Update: For new trial: Next evidentiary hearing will begin 1/25/22 & end on 3/4/22 about 5 hours each day for testimony. 11/29/21: Peterson has left death row in San Quentin & was moved to the San Mateo County Jail, officials confirm. He was transferred Monday morning ahead of his re-sentencing hearing next week. He will remain in Redwood City through March because of a second upcoming hearing that will determine if he gets a new murder trial. Peterson’s defense team is fighting for a retrial based on juror misconduct.

    What is all this about? The plaintiff is going back over evidence that led to conviction, that was presented at trial in the first place.

    Ugh! Another defense attorney citing "the wonderful family" connected to the defendant.....If anyone believes that a "great" family ensures a great offspring, that individual would be making the same type of insinuation the defense counsel mentions as unfair.

    So sad for Lacy's family....IMO...MOO
