Defense attorneys for a traveling nurse charged with killing six people when she barreled through a busy Los Angeles intersection at 130 mph said they plan to call an expert who will testify she had a seizure and “froze” at the wheel to explain the horror smash.


Nicole Linton appeared before a Los Angeles judge on Thursday with her attorney, Jacqueline Sparagna, who told the judge they plan to call a neurologist who specializes in epilepsy and seizures.


“We are going to put on a defense at the preliminary hearing, which is rare,” Sparagna told The Post.

Read this drivel and weep: she was psychotic, she was unconscious, blah blah blah when she was driving 122 mph and killed 4 (or 5) people. This was according to her expert physician. Prosecution basically says hogwash.

Linton’s attorney, Jacqueline Sparagna, told The Post she plans to ask the judge to vacate an order that allowed her client to speak with a psychologist without her knowledge or consent. Sparagna claims she was not informed that Linton was seen by the prosecution’s expert psychologist Robert Schug. The defense attorney said Schug’s report isn’t relevant to the case & should be excluded. The District Attorneys’ behavior is an underhanded & unconstitutional dirty trick to gain advantage over Nicole, which the Court should immediately sanction.” Greg Risling, spokesman for the Los Angeles County District Attorney’s Office, refuted Sparagna’s claims. “On April 17, 2023, the judge hearing the matter, Eleanor Hunter, signed an order appointing Dr. Robert Schug to examine the defendant. 5/10/23 Update: Neurologist Dr. David Millett, who specializes in epilepsy & seizures, examined Linton and provided a four-page report that said the nurse sometimes loses consciousness & doesn’t remember her actions. He pointed to two prior incidents where Linton suffered “episodes” where she fell into a “dream-like state” for hours. Millett said those behaviors, including the stresses Linton experienced prior to the August car crash, could have been caused by a frontal lobe seizure. “Although there were no eyewitnesses to Ms. Linton’s behavior while driving just prior to the accident of August 4, 2022,” Millett wrote. The neurologist said Linton was anxious before the crash & had severe insomnia over stress from her duties as a nurse. Millett explained sleep deprivation could cause seizures in patients with epilepsy. “The most compelling explanation for this abrupt loss of consciousness, including loss of both memory & awareness of her immediate circumstances for a matter of only minutes, is that Ms. Linton experienced a seizure. Dissociative amnesia is a less likely differential diagnosis.” However, prosecutors claimed a separate psychiatric evaluation showed no indication that Linton suffered a seizure. This case is similar to the case of the Waukesha Parade massacre, the perpetrator had a similar defense, "mental illness". He is now serving six consecutive life sentences.

The focus should be on the victims here, especially children whose lives were taken from them. See this for what it is, a woman who was driving under the influence and killed people.

My husband had a seizure (1st one he'd ever had) while driving. During the seizure he loss consciousness and his foot came off the gas pedal. When he came too the car had stopped.
Let's say she did have a seizure while driving her Mercedes, would she be able to maintain a constant speed and would she still be able to drive the car in a "straight" line?
Seems like if she was having a seizure her foot would have come off the gas pedal, or she would have been driving all over the road at a non-constant rate of speed.

Didn't she also have her had out the driver's side window up in the air? I don't think she would do that if having a seizure.

I agree she drives as if she were aware. Unless witnesses saw her seizing when the car stopped, or she had postictal confusion, high prolactin, abnormal EEG when she was in the hospital, it is likely unproven. If she had a prior history of seizures, the decision to stop the drugs was hers, and it only worsens her situation.

Seizures, however, are a good example because there are certain rules. A seizure mandates no driving until they are stabilized and seizure-free. Usually 6 months. So if she had a prior history of seizures, she was in violation of some rules. Not taking meds and driving.

I suspect she had a mere episode of a mood disorder - but it is the same as if she had prior history of seizures, was stabilized on the medication, them stopped it by random advice of a nonmedical specialist , continued driving and had a seizure when driving. The analogy is the same, only she got manic and psychotic. Her own responsibility.
