Accused Malibu Creek shooter back in LA court

    June 3, 2021
The public will have to wait several more weeks to learn if L.A. County can carry out its case against Anthony Rauda, the man charged with killing Tristan Beaudette at Malibu Creek State Park Campground in June 2018.

At a May 24 hearing to determine if Rauda is mentally fit to stand trial, his case was continued to June 17.
    [.....]
The question of Rauda’s mental competency arose late last year when court officials made a preliminary finding that he might not be able to stand trial. His mental acuity must be determined before a trial can commence and is a matter for the court to decide, legal experts said.

If he’s deemed unfit, Rauda will be remanded to a mental health facility, and the criminal charges against him will be suspended until such time as he is able to participate in his own defense.

The issue differs from an insanity plea defense, in which Rauda’s attorneys would have to prove to a jury that he can’t be held responsible for his actions.
