    *Preliminary Hearing (@ 10am PT) – CA – Nikko Lee Perez (approx.. 3 mos. when found; b. Nov. 8, 1996 in Fresno, found March 29, 2007 east of Woodland in an irrigation slough & was wrapped in a Winnie the Pooh blanket & a layer of plastic before being placed in a metal cooler. The cooler was weighed down with heavy objects & submerged in the slough, located about 15 miles northwest of Sacramento. He suffered a fractured skull & other blunt force trauma. He also had healing fractures, including broken ribs, that showed a pattern of abuse), Kato Allen Perez (b. 1992 in Merced, known to be dead), Mika Alena Perez (b. 1995 in Merced, not found), Nikko Lee Perez (b. 1997 in Fresno, not found) & Kato Krow Perez (b. 2001 in Fresno, not found) - *Paul Allen Perez (30 @ time of first crime/57/now 59) arrested (1/21/20) & charged (1/22/20) & arraigned (1/28/20) with 5 counts of premeditated murder with special circumstances of lying in wait, torture & multiple victims, 4 counts of assault on a child under 8 with force likely to produce great bodily injury resulting in death & criminal enhancements for his prior convictions.     OMG!! I can't believe that a mother would allow this to happen time and again and not tell somebody!! I am not victim bashing...It's just so hard to understand. She must have been terrified of him.. But...Those poor babies!!!

    Yolo DA won't seek death penalty in local infanticide case - Davis Enterprise

    May 27th:

    WOODLAND — The Yolo County District Attorney’s Office filed court documents Thursday saying prosecutors will not seek the death penalty against a former Yolo County man accused of killing his five infant children.

    Paul Allen Perez, 59, was ordered last month to stand trial on multiple first-degree murder charges with special circumstances in connection with the deaths of his four sons and one daughter, who prosecutors say were brutally abused and killed between 1992 and 2001. The remains of one infant boy were found in Yolo County in 2007.

    If convicted, Perez faces life in prison without the possibility of parole. Attorneys in the case are scheduled to appear Tuesday [6/1/21] in Yolo Superior Court to set a trial date.

    Capital Punishment (The Death Penalty) in California (shouselaw.com)

    The most common crime that can earn the death penalty in California is a particular variant of California murder law (Penal Code 187) known in California law as “special circumstances murder.” .27

    Special circumstances murder (also known as capital murder) is first-degree murder where one or more special circumstances are present. These include:

    • Prior murder convictions or more than one murder conviction,28
    • Murder by use of a bomb or poison,29
    • Murder of a law enforcement officer, firefighter, witness, judge, prosecutor, or jury member,30
    • Murder involving torture,31
    • Murder in connection with gang activity,32 and
    • Murder in connection with another serious felony.33
    There are several other, less common crimes that can be punished with the death penalty in California. These are:
    1. Treason (going to war against the state, or supporting others who do),34
    2. Committing perjury in order to cause the execution of someone who is innocent,35
    3. Sabotaging a train with the result that someone is killed,36
    4. Assaulting someone with a deadly weapon and killing them while serving a life sentence in state prison,37 and
    5. Intentionally interfering with preparations for the U.S. to go to war, with the result that someone is killed.38
    3. Death sentences in California: factors to consider
    If a jury decides that a defendant committed special circumstances murder, or one of the other capital crimes we listed above, that doesn’t mean that s/he will necessarily receive the death penalty.

    The punishment for these crimes is EITHER the death penalty OR life in prison without the possibility of parole.39 It is up to the jury to decide which one the defendant will receive.40 This will be decided by the jury after the defendant has been found guilty, in a separate “penalty phase” of the trial.41

    5/27/21 Update: The Yolo County District Attorney’s Office filed court documents Thursday saying prosecutors will not seek the death penalty against a former Yolo County man accused of killing his five infant children. Next trial setting conference hearing on 6/1/21. 6/1/21 Update: The trial setting conference was postponed for six weeks due in part to the fact that the primary investigator in Perez’s case abruptly retired. Perez is due for a trial setting conference on 7/12/21.
