''While Wuschenny admitted the semen on the T-shirt was likely his, he denied ever having been in the house. His lawyer during trial argued it was possible Wuschenny’s semen got onto the T-shirt while worn by one of the victim’s roommates at another time and the victim wore it to bed without washing it first.
The bedding in the victim’s bedroom also had DNA of three other men on it. The intruder could have been one of those three men, Telford-Keogh had argued during the trial.
“(Pomerance) basically summarized the issue was to identify who was the intruder,” said Telford Keogh following the verdict.
“She didn’t have a doubt the victim was assaulted, the question was ‘who was the intruder?’ The DNA itself without collaboration of other evidence borders on an erroneous conviction.”
