I don't remember anyone testifying to that. Also, he was wearing a gas mask which would have muffled any speech. And remember that the movie was still playing while this was happening. I can't see how anyone could have heard him say anything.

One of the major issues people have at movies are other people talking. Yet you think they couldn't hear shouting? And one can easily hear what someone is saying behind a gas mask:

Also, not everyone who was there that day testified.

Please do not downplay the evil of this person. This guy ordered people to stand up to be murdered. It was widely and repeatedly reported and I will never forget that.

Maybe they were unanimously for the life without parole.

No, they were NOT or else that would've have been the verdict!!!!!!!!!!
They were not unanimous EITHER WAY. They were hung, no verdict.
Hung jury = LWOP sentence by judge.

Why are people saying this incorrectly?

One would think if he did this in the throes of a mental break upon stabilization he would feel awful for what he had done and would want to apologize.

This is what I was thinking. Even Luka Magnotta, another evil person who tried to play the mental illness card at trial, wanted to write his victim's mother a letter to apologise.

Count me in as someone who doesn't remember hearing about JH saying anything to anyone in the theater. I will have to scroll back to see that link that was posted about it.

"Stephanie Davies, 21, who was in the Century 16 cinema in Aurora, Colorado during the rampage, said: "He would shout 'What are you doing? I said stand up!' And he would pick people up. I saw him stand over someone. I just see hair and him holding the shirt and – boom."

Miss Davis and her friend Allie Young, 19, who was shot in the neck, ended up lying in an aisle."

I don't mean to be difficult but I have not heard this testimony in court. In fact I've heard the exact opposite. The shooter didn't approach anyone. He shot from a distance.

I am definitely not downplaying this shooting whatsoever and I'm offended that you think I am. If you had followed this thread here you would know exactly how I feel about this horrific crime.

This sort of testimony would have been extremely powerful so why didn't she come and tell the court? She's been on TV to tell it so I don't think she's afraid to speak out.

Some weather moving in here during press conference. #theatershooting

Starting to rain now. #theatershooting

Just maybe God is shedding some tears for those victim families and want them to know he embraces them in HIS ARMS!!

Disregard for those that don't believe in GOD..I just felt it was something that would show those who do believe some solace!!

DA should have just taken the plea deal.

Yep -- When you make a plea, you cannot appeal.

Well, fooey. The hold-out(s) must have been pretty darn firm...

I do have one worry about Ms. Brady -- I hope she won't break her arm from patting herself on the back...

I have a genuine question for you- if eleven people on this jury decided on LWOP and one juror could not be swayed from DP, would that lone juror also be a stealth juror?

It wouldn't matter with LWOP....that's the default sentence when DP is not agreed to?

They shouldn't have been on the jury if they were set against death penalty, since this is a death penalty case.

I have never heard that you have to be pro-death penalty to be on a jury.

2 of the alternate jurors don't wish to speak to the media and 10 of the deliberating jury.

So hopefully the 2 that are willing will speak out and give us an insight into what went on.

Death Qualification
Death Qualification

Jury selection in death penalty cases poses serious problems not found in typical criminal cases. During the "voir dire," jurors in capital cases are questioned about their views regarding capital punishment in order to discover whether they will be able to follow the law in deciding what sentence to impose. In order to be "death-qualified" to serve on a capital jury, a person must be willing to consider all of the sentencing options - usually death and life imprisonment without parole. If their opinions would prevent them from considering any of the sentencing options, then they are not "death-qualified" and are stricken from serving on the jury. This culling of potential jurors based on their moral views may produce a jury that looks quite different from the community at large and also, as some studies show, may bias the jury towards a verdict of guilt for the defendant.

So, why would you ever be on a death penalty qualified jury? If truthful, you would never be.

I would never be on one, but I was just pointing out that if I was on one, forcing me to deliberate longer would not change my mind, and I don't think it would change most peoples minds, no matter which side they are on.

After seeing her name in that NYDN article, I found this article with more quotes from her:

http://www.dailymail.co.uk/news/art...ss-says-Aurora-killer-handpicked-victims.html

I wonder why there weren't any witnesses in the entire trial who described anything similar to what she did. I would think that would have been very powerful testimony.

I don't know why she has a different recollection from the many many other witnesses who testified about the shooting. And I'm assuming she might not have testified because her account was so very different.
