    Yes, there also doesn't seem to be any confusion about the cellphone evidence or difficulty showing that both PF's and Kelseys phone were travelling together after the murder.

    At one point I think there were some that felt that was going to be a problem and that the fact that the phones pinged off the same tower did not prove that PF had her phone with him.
    Or something like that. Something about the math not adding up and they would need a technical expert to explain.

    Either way, I haven't heard the defense address this so I'm assuming it turned out not to be a problem, after all.

    This trial and the guilt of the defendant aside, why would any prosecution object to both sides observing DNA testing? If I were a defendant, I would want someone representing me to observe.

    I'm not too worried about getting a guilty verdict, but I am worried about ineffective counsel.

    I still don't really understand why LE let the Berreth's spend night(s) at kb's.
    I know it's water over the bridge... but I'm still annoyed. It's almost like (maybe not just almost) they're saying, "No worries, she's probably just on a long walk".

    That's being very logical! The defense simply didn't want any chance of the truth to come out and was going to do whatever they could to delay it. Don't forget they also asked the judge to delay the trial (citing too much evidence given to them at the last hour). MOO

    I have had a thought on my mind for 2 days. The fact that the police didn't find blood in the Townhome until Kelsey's family found it, makes me wonder about that burn spot... Could there still be teeth out there??? That really bothers me.

    Yes, although I'm not sure what else they could have done except to point out all the lies KK told and make her look unbelievable.
    I'm still waiting to hear their explanation of where Kelsey was murdered and when.

    I was furious about this too!

    IMO, WPPD was buying PF's good ole boy story that KB was an unstable, drug/alcohol abuser that was prone to taking off and leaving her child.

    Reportedly they saw no signs of foul play and did not consider the condo a crime scene until after CB2 discovered blood.

    Upon confirmation of the blood evidence -- CB/CB2 were immediately escorted out of the condo without their personal effects.

    I worried about it some but I can't imagine any future attorneys reviewing this case would be able to zero in on fault by these defense attorneys.

    I guess they could discover they were deaf or something but the evidence spoke and if they couldn't get Patrick to plea, whatcha' gonna' do?

    Of course, we know he could still plead while the jury is out and that wouldn't surprise me!

    I agree---I think they bought PF's story at first. I am sure PF pulled out the 'my brother's in LE' card too.

    They probably thought she was a drunk who wandered off on a binge. :(

    I remember our early threads in this - we had a hard time determining when she was reported missing / when the welfare check(s) occurred etc? I hope now LE enters the residence of a missing person searching for evidence as if it were a crime scene - I don’t recall this was done right away and since there wasn’t a horrible crime scene they let them stay in her condo
    JMO and FWIW I have no problem calling tip lines on missing persons asking if they have checked out their residence

    I think this exact issue is sadly present in so many missing cases that I wish LE protocols would change to accommodate the fact that they may have to pivot quickly in the event that foul play has occurred.

    So often critical hours/days are lost due to the initial look at the scene in a missing case not being treated as if it were a crime scene.

    Curious why you'd like to Ma testify, MG. I don't see where she would add much. So she witnessed the fire but that's already well established that it happened, contained plastic and tooth fragments. If she actually knew PF was going to or did kill Kelsey, don't you think she'd just lie and say she didn't? As for anything implicating herself, she'll take the 5th.

    Personally, I'd be way more excited if PF testified knowing he'd totally bury himself.

    I’d love for PF to testify, and would take that over Ma any day.

    I just think there is zero chance of him testifying, and that her testifying is more realistic.

    I still think it’s an outside possibility, but I want her exposed for what she is, and what she did. You’re right though, she’s not necessary at this point.

    We know PF was late for Thanksgiving. We know he spent half the time outside. And that fire is not in question.
