Colorado Chancellor Suspended, Athletic Director And Head Coach Fined Over Assistant's Alleged Domestic Violence

Colorado chancellor Phil DiStefano will be suspended 10 days and athletic director Rick George and head football coach Mike MacIntyre will each be required to donate $100,000 to domestic violence awareness for their handling of domestic violence allegations against former assistant coach Joe Tumpkin.

A law firm found the university responsible for three failures:

* a failure to report domestic violence allegations;
* a failure to report the information to law enforcement officials; and
* a failure of supervision of coach Tumpkin.

Of course, MacIntyre had first brought the allegations to George’s attention nearly a month before. George ultimately decided to suspend Tumpkin—but a week after Colorado had played (and lost) its bowl game.

CU suspends chancellor; AD, football coach ordered to make donations after handling of Joe Tumpkin case

University of Colorado chancellor Phil DiStefano will serve a 10-day suspension and athletic director Rick George and football coach Mike MacIntyre must donate $100,000 each to benefit domestic violence awareness for their “failures” in responding to allegations against a former assistant coach, the school announced Monday.

The announcements followed a closed meeting of the CU Board of Regents in which members discussed an investigation into officials’ response to a claim of domestic violence by the ex-girlfriend of former assistant football coach Joe Tumpkin.

In concluding its report, the O’Connor firm wrote of that failing: “The failure to do so, in and of itself, however, deprived the University of the opportunity to evaluate the report, to make a reasoned, factual determination consistent with University policy and values, to more promptly evaluate any impact on campus constituencies, to provide the Complainant with access to available information about resources and to take appropriate and responsive employment action.

Joe Tumpkin criminal case stalls as attorneys fight over access to ex-girlfriend's cellphone

According to the original appeal filed by Tumpkin's lawyers in Broomfield District Court, "the disclosure of the cellphone data has been an ongoing dispute between the parties."

Defense lawyers wrote that Tumpkin's ex-girlfriend turned her phone over to police knowing the evidence obtained on it would have to be shown to the prosecution.

But prosecutors filed a motion seeking permission to review, in a closed hearing, the information on the phone in order to restrict access to information that they deemed not relevant to the case.
