BBM Or is it actually a victory for justice? She was not very good or effective at her job. Multiple cases dismissed is enough to say she wasn't good or effective, hopefully the next DA is good at the job.

I thought my post was self evident, I guess it wasn't since you're asking this question. Stanley's mismanagement has NOT resulted in justice for many families. Because she doesn't know what she's doing. So, when I refer to her not seeking reelection as a victory for justice, I am talking about all of those families who have been affected by her mismanagement because she's failed to deliver justice. I trust the next DA can deliver justice, including for Suzanne's friends and family.

IMO I agree. The problems existed before Linda arrived on the scene and the problems will not disappear when she does. The Eleventh does not seem to prioritize justice.

As I think back on this case - it was obvious from thousands of miles away by just reading the media reports/court filings that the prosecutor's office was being buried by Iris et al. Prosecutors kept missing deadline after deadline.
Where was the calvary? Why was the prosecutor's office being hung out to dry with no life line time after time and so publically. They did not keep missing deadlines and getting sanctions bc they are morons who don't know the rules.

Was everybody just so hell bent to watch Linda fail? Politics over justice. Tragically, Suzanne's voice was deafened in all this mess and her case thrown out the window.

I understand it's Linda job to manage the workoad. IANAL so help me out. If I am arrested and I have a right to a speedy trial per CO law, doesn't that mean that I manage the time clock ? Or can the prosecutor say that my timetable does not work for them, while they prioritize cases they feel are more important than mine etc ? Or is there another way other than more adding personnel for the DA to get things managed and handled?

If you can only juggle three balls and you need to juggle 13 - you have a problem.

As far as I can tell - That's the problem the Eleventh has.
And until that problem gets worked out it does not matter who the DA is.

To my knowledge, Judge Kaitlyn Turner's sanction imposed against the DA's office is the only case pending review... and I also can't think of another Judge who would be so anxious ('pick me, pick me, please pick me') to be a witness here! JMO

That seems like a pretty big mischaracterization of what's happening here.

There's an ethics investigation going on into LS and how her office has handled a number of cases. Some of the cases being investigated were heard by Turner. So the investigators "sought the judge's testimony as a witness to an elected district attorney's alleged misconduct and the misconduct of some employees." Instead of immediately complying, the judge then asked the ethics advisory board whether she could cooperate with the investigators and still hear cases that LS's office was bringing. To me, it's kind of the opposite of 'pick me, pick me.' It's someone trying to make sure that they're not doing anything unethical by cooperating with the investigation.

In my area, 2 parishes have one judicial district/one district attorney. Each parish has judges and a lead assistant DA. Our system works well.

DA Stanley was elected to serve as the Prosecutor for the 11th Judicial District comprised of the Combined Courts located in four counties including Chaffee (Salida, CO), Custer (Westcliffe, CO), Fremont (Canon City, CO), and Park (Fairplay, CO).

The 11th Judicial District has four District Court Judges, four County Court Judges, one District Court Magistrate, and two County Court Magistrates.

DISTRICT COURTS

Each county in the state is served by a district court. Colorado is divided into 22 judicial districts, many encompassing more than one county. Unlike county courts, where there is at least one judge per county, district judges are assigned to the judicial district and may serve more than one county within that judicial district, particularly in rural areas of the state, where as many as seven counties may be included in a district.

District courts have authority to handle many types of cases, including dissolution of marriage (divorce), civil claims in any amount, juvenile matters, probate (estates), mental health, and criminal matters. You may appeal a district court decision to the Colorado Court of Appeals and/or to the Colorado Supreme Court.

JMO, but I don't see what IE or the 'concerned citizen' have to do with Turner.

Turner didn't hold a press conference announcing she'd been asked to be a witness. The only reason this is even an article is because ethics opinions get published by the advisory board so that they can be guidance for other lawyers and judges.

From the advisory opinion: "The judge has been asked by the Office of Attorney Regulation Counsel (“OARC”) to provide information as a potential witness on a district attorney the OARC is investigating."

OARC sought the judge's testimony. She did not go to them trying to give it. And once it was requested, rather than immediately cooperating with the investigation, she then asked the ethics advisory board whether she was required to comply with their request given that two of the cases were still pending and one was on appeal. And if she was required to comply, did that then necessitate recusing herself from all future cases brought by LS's office.

The advisory board responded that "Pursuant to Rule 2.16, the judge must cooperate with and be honest with OARC."

Translating that chain of events into the judge being anxious to testify and saying "pick me, pick me, pick me" seems a bit unfair to me. But agree to disagree I guess.

The "pending review in the Colorado Supreme Court" is actually an Order against Judge Turner where the High Court ordered her to show cause, in writing, on or before May 24, 2023, why the relief requested by the petitioner (LS/People) should not be granted.

Turner acting as a witness for a case where the Supreme Court is questioning the very actions that she took is no better example of the fox watching the hen house. The OARC is such a joke. MOO
