On Oct. 24 in Denver at the U.S. District Court for Colorado, his attorneys filed a one-sentence notice of an appeal.

Appeals to the federal appeals court in Denver typically take many months before an appeal is concluded.

"For all its infuriating flaws, … the prosecution of Plaintiff (Morphew) was not unlawful," U.S. District Judge Daniel D. Domenico wrote Sept. 24 in a 33-page decision. It is that decision that Morphew is appealing.

Whose decision is this likely to be? Is it Barry, having a temper tantrum and insisting his lawyers do this or is it likely that his lawyers have advised him to pursue this?
It seems ridiculous and more and more like a stalling tactic, which on one hand is good I think because it could imply they're worried about what could happen but on the other, it continues (or seems to) to delay the justice that is long overdue for Suzanne.

We know that nobody plays media better than IE, and yet none of her favorite MSM reporters have touched the news of BM's appeal. No appearances, no press conferences, etc.,.... IMO, this is no accident.


I agree with @Lyanna -- this defense antic to use the higher court is likely a desperate attempt to stall the 12th Judicial District Court from moving forward with refiling criminal charges against BM. We know it's not for a reversal on Judge Domenico's decision!

Just waiting on the court transcript can take months! I don't know about this federal court but IME, court reporters in state courts generally file up to three extensions before producing the transcript!

IMO, unless 'Team BM' can find a crafty way to broadcast BM the perpetual victim, and the wrong allowed by the state legislature for not legislating blanket ban on prosecutorial immunity, I think they already used up their media time misrepresenting the Final Judgement Dismissing the lawsuit.

What I find infuriating is the continued narrative that the investigation was flawed. I’m hard pressed to recall what those flaws are that are real, and not manufactured by IE. The only thing I can think of is missing out on collecting whatever Barry disposed of in his Scenic Tour of the Dumpsters of Colorado.

The prosecution and trial preparation is a different story of course, but IMO Sheriff Spezze and Johnny Grusing did an outstanding job.

And I don’t know why I am surprised that they are appealing, because by now I should know IE will always double down even when she has a garbage hand.

I’ve thought that an investigative flaw might be the failure to collect video from around the time of Suzanne’s disappearance. Since there was never a trial, I’m not 100% convinced it was a flaw. After all these years, there’s still so much we don’t know.

Still waiting for an arrest. Seems time is slipping away. I fail to understand.
I'd much rather they take their time and get it right.
Barry's not going anywhere.
There is no Statute of limitations on murder in Colorado.
I'll wait, confident the wheels of justice are silently and productively turning.

We'll all rejoice when the arrest and charges come, and they ARE coming!

This was one of the most incredible investigations I've ever seen, especially the dozens of interviews that were conducted with Barry (Grusing's especially). I'm following the Delphi trial right now and that one was a disaster. One missed opportunity was the final interview with Allen, in which the strategy was to basically scream and him instead of having a calm conversation that got him to address the evidence.

There are actually people who suggested law enforcement use a similar tactic here (haul Barry to an interrogation room and grill him). Can you imagine?!

If mean an actual grill then I agree.

This is one of the most open and shut cases I have followed. The defendant corroborated all of the physical evidence needed to link him to the crime in his own words.

I want him to face justice. I have been waiting. But forcing him into a room and playing bad cop won’t work. Grusing and others built a strong case. And when BM is charged again, the case should be locked in. They now have Suzanne’s body. And for all we know, others are coming forward to testify.
I am anxious. The day he is charged will be exciting.

My hope is that BM is having to pay for this, that it is not on a contingency basis. Go ahead and spend all that money.

Remember the baby killer (William Jacobs, 22) who Judge Turner dismissed the charges against for "outrageous government conduct" when LS talked to KRDO reporter about the fatal abuse he suffered under his care?

Docket had him up for sentencing yesterday after he assaulted a 64 yr man in July who asked him to leave when he was found trying to choke the baby momma, four weeks after his murder charges were dismissed! Then, less than 2 hours after he was released on bail for the assault, he returned to the victims residence in violation of a mandatory protection order!

While Jacobs case and name was big news as long as it could be used to flame LS, funny how his criminal charges and resultant punishment, doesn't make any local MSM. Hey KRDO...

Talking to a reporter wasn't the best idea, granted, even 'off the record' or 'in good faith' or whatever the term was, but what about the EVIDENCE?
I just can not fathom how the judge reached that decision, there had to be another option.

Turner had other options including a change of venue as suggested by Judge Murphy but chose the worst for County residents, AND LS. Turner lost her bid for re-election as DA when she was defeated by LS. IMO, this was more politics at play.
