STAMFORD — Seeking to avoid a hearing into whether police misled a judge to obtain an arrest warrant against Michelle Troconis in connection with the disappearance of Jennifer Dulos, prosecutors on Thursday wrote that any attempt to review the evidence presented in police affidavits would be a “meaningless” waste of time.


The filing came one day before Troconis’ attorneys and prosecutors are set to appear before Superior Court Judge John F. Blawie to discuss pending motions, including one to dismiss evidence tampering charges. Troconis will not appear in court on Friday.


Troconis’ attorney, Jon Schoenhorn, filed the motion to dismiss those charges in January, arguing that State Police Detective John Kimball “recklessly disregarded the truth” and omitted facts in an affidavit used to secure charges against his client for allegedly helping to dispose of evidence in the case, court records show...

At the end of the article, JS contends MT proclaiming she didn't kill Jennifer and doesn't know where JFD is should exonerate MT.

MT's child still has both of her parents alive and well. It infuriates me that MT continues to contend via Attorney JS that "she doesn't know where Jennifer is" -- as if she voluntarily abandoned her 5 children and is sunbathing on some tropical island. Grrrrrr! :mad::mad:

*Franks Hearing (@ 9am ET) & Pretrial Hearings (all cases for both hearings) (@ 10am ET) – CT – Jennifer Rebecca Farber Dulos (50) (May 24, 2019, New Canaan) – for *Michelle C. Tronconis (44/now 47) (Dulos’ GF) arrested & charged (6/1/19) & arraigned (6/3/19) with tampering with or fabricating physical evidence & hindering prosecution. Plead not guilty. $500K bond. Posted bond (on 6/3/19). These charges were dismissed (8/28/20) & recharged below.
*Charged (9/5/19) & arraigned (10/4/19) with tampering with evidence involving the borrowed car from work colleague. Plead not guilty. $100K bond. Posted bond (on 9/5/19).
*Charged (1/7/20) with conspiracy to commit murder. Plead not guilty. $2M bond. Bond reduced (1/8/20) to $1.5M & bonded out (on 1/9/20).
*Charged (8/28/20) with 2nd degree hindering prosecution, tampering with physical evidence & conspiracy to commit tampering with physical evidence. No plea entered yet. $500K bond. Posted bond.

4/28/21: The judge ruled that Troconis no longer has to be part of the Intensive Probation supervision program, but all other conditions of her release are subject to a written decision that is expected to be made in two weeks. Cases #0167364T, #0148553T & #0241178T hearing has been moved to 5/25/21.
5/25/21 Update: Judge John F. Blawie takes up the defense’s request to get the sealed custody study in Dulos divorce case. Blawie says he will release a copy to the defense BUT says Schoenhorn is not to turn it over to the media. Blawie says the five Dulos children’s well-being should be considered first & foremost. He says he doesn’t think the report is relevant, but because law enforcement got during the investigation through a search warrant, he’ll let the defense see it. Blawie says a request has been made for a jury trial date, but he can’t give one yet because jury trials aren’t restarting till next month & there is a backup since March 2020. Blawie takes up renewed motion by Schoenhorn for removal of GPS monitoring. Blawie again denies it. State’s Attorney Paul Ferencek now arguing his motion regarding the defense turning over discovery to the media—documents & video clips. Ferencek says Attorney Schoenhorn should need permission before making that discovery public or file it under seal. Ferencek says it will taint the jury pool & make it impossible to get a jury when the time comes for jury. Attorney Schoenhorn says he thinks that’s unconstitutional, and he doesn’t believe anything he’s filed is prejudicial. Blawie says he’ll take this under advisement before making a ruling. He says his concern is that Schoenhorn has released things to the media before filing with the clerk. Schoenhorn says that is absolutely false. He’s never sent anything to the media until after filing. Schoenhorn’s request for a bill of particulars regarding the three conspiracy charges (two for alleged tampering & one for alleged murder). The two conspiracy to evidence tampering charges were added without additional warrants/arrests, which is allowed. Blawie says both sides can make an additional filing before he rules. Next hearing will be the Franks hearing before Judge White 9/14/21. The trial won’t happen until 2022.
8/23/21: The attorney for Troconis filed: Motion to return seized property & suppress evidence derived from the defendant's Apple iPhone Model X. And has asked a judge in a court filing Monday to ensure that his client’s cellphone is returned & any information taken from it not be used in the case filed against her in the disappearance of Jennifer Dulos. Troconis’ attorney, Jon Schoenhorn, contends in the latest motion that the Apple iPhone Model X was seized by state police detectives on May 31, 2019, a week after Dulos, a New Canaan mother of five went missing. There was no probable cause to take the phone & a search warrant for the device signed a week later by a judge was so overly broad it was a “general search of stored data,” said Schoenhorn in a motion filed with the court Monday.
9/10/21 Update: Hearing has been moved to 10/7/21 for all cases. 9/22/21: Motion to Suppress Statements (Consolidated): The attorney for Troconis wants the court to suppress all statements made by Troconis during police interrogations over the course of the Jennifer Dulos investigation.
10/6/21 Update: Frank Hearing has been rescheduled for 12/3/21 for all cases. A Franks hearing is a proceeding before a judge where a defendant contests the veracity for a search warrant. 11/10/21: The State filed motion to dismiss Schoenhorn's case against the court reporter for not giving him a transcript of the sealed divorce hearing (re psychologist's testimony). 11/27/21 Update: Franks hearing has been rescheduled to 12/3/21 for all cases.
*Kent D. Mawhinney (54/now 55) – Murder: Pretrial hearing on 1/18/22. Court hearing re disposition (Violation) on 12/22/21 & (Spousal assault) pretrial hearing on 12/22/21. *Fotis Dulos (52) – Committed suicide on 1/28/20 & declared dead at 5:32pm on 1/30/20. 3/3/20: Charges dismissed. The case against Dulos will be officially dismissed in about a year, unless the state decides to reopen it.
 
I don’t understand why this “privileged character” as my father would call her, does not have to present herself in court. I don’t believe it is because of Covid; plenty of people have to be in “front” of the judge (she doesn’t even have to be present via “zoom”? This really is outrageous that she gets to think of herself, and present herself all through the state of CT as a person who is being persecuted, and not prosecuted.

And they're right, maybe she didn't kill Jennifer and doesn't know where Jennifer is [doesn't know where her remains are], but IMO she could have prevented what happened to Jennifer. She knew and she didn't stop it, and that makes her, in my eyes wholly complicit.

Her fingerprints on trash bags containing bloody anything -- she was no back-turned spectatator.

That made me happy, too. He may make some rational accomodation, if requested, but he won’t put up with the BS we have seen in the past. MT doesn’t seem to be able to manipulate him as well.

During the hearing, which was President over by Judge White, Troconis had her motion to amend the conditions of her bail denied, meaning that she will continue having to hear an ankle monitor.

White did not issue a ruling into whether he will order a hearing at which police will testify about several affidavits which led to Troconis’ arrest. Her attorney called those affidavits a “disgrace” and “unethical.”

Prosecutors say the affidavits are substantially true — the only certain error being the number of places Troconis and Fotis Dulos stoped in Hartford while he dumped trash bags. Affidavits said 30, it was actually 3. They say arguing over those affidavits is a waste of time.

Also at this hearing--Attorney Jon Schoenhorn again asked for Troconis' GPS ankle monitoring to be approved, saying she has never once not been in compliance for the past 1.5 years. "So you're saying it's working?" replied Judge White. White denied the request.
In addition--a lot of you asked why Troconis wasn't here today. Her appearance was waived. We learned she no longer lives in Connecticut and is spending her time in Florida with her family and Colorado where she has a place.
