    But of course. Unfortunately I can't read the article despite living in the Boston area thanks to the pathetic payment policies just to read the Boston Globe online. Not surprised. The smell of money and notoriety is intoxicating to some.

    Tsarnaev Jurors' Answers On Death Penalty, Islam Released

    "Newly released court documents show at the start of the trial of Boston Marathon bomber Dzhokhar Tsarnaev, jurors were split on which was a worse fate — life without parole, or the death penalty.

    That's one of several revelations in juror questionnaire answers made available to WBUR on Monday. This is the first time the answers to all 100 questions the seated jurors were asked during jury selection nearly four years ago have been made public.
    More than 1,373 people called for jury service filled the questionnaires out, and Judge George O'Toole ordered on Dec. 13 that the answers of just 18 — the 12 deliberating jurors and six alternates who sat through the trial — be released. (Tsarnaev's attorneys had asked for all the questionnaires filled out be released, but O'Toole denied that.)

    "BOSTON (AP) — Boston Marathon Bomber Dzhokhar Tsarnaev’s convictions or death sentence should be tossed because it was impossible for him to get a fair trial in the same city where the shrapnel-packed, pressure cooker bombs exploded, his lawyers told a federal appeals court on Thursday.

    In a 500-page brief filed in the 1st U.S. District Court of Appeals, Tsarnaev’s legal team outlined a host of other problems with his 2015 trial, during which the defense admitted from the outset that he and his older brother carried out the attack. His appellate lawyers are also pointing to issues with jurors, certain testimony from surviving victims and the defense’s inability to tell jurors about links between Tsarnaev’s brother and an unsolved triple killing in 2011.

    His lawyers argue the trial court judge’s “first fundamental error” was denying the defense’s repeated requests to move the case out of a city that was “traumatized by the bombings, ordered to shelter in place during the manhunt, saturated by prejudicial publicity and united in the Boston Strong movement.”

    "...“When police arrested 19-year-old Jahar Tsarnaev, crowds flooded the streets in relief and jubilation. The community’s trauma and catharsis birthed Boston Strong, a movement that at once proclaimed defiance, resilience, and solidarity,” lawyers wrote. “The bombings united a region broken but brave. And as Tsarnaev’s trial began, ‘Boston ha[d] not yet fully recovered, and . . . every resident—whether or not they were at the [M]arathon that day, knew a victim, or were subject to the shelter-in-place order—was deeply and personally affected by the tragedy.'"

    The court "deprived Tsarnaev of an impartial jury and a reliable verdict, in violation of the Fifth, Sixth, and Eighth Amendments,” lawyers wrote.

    Juror 286 had tweeted two dozen times about the bombings, calling Tsarnaev a “piece of garbage” and describing being locked down with her family. She swore in her jury selection that she had not commented on the attack or been forced into a “shelter in place.”

    Another person on the jury - Juror 138 - participated in a Facebook conversation about the case “where one of his friends urged him to ‘play the part,’ ‘get on the jury,’ and ‘send’ Tsarnaev ‘to jail where he will be taken care of,’” according to lawyers. This was a violation of the court’s order, and stood in contrast to his sworn testimony that none of his Facebook friends had been commenting on the trial, lawyers argued...."

    "The National Association of Criminal Defense Lawyers is offering to throw its might behind convicted terrorist Dzhokhar Tsarnaev on the belief that a new jury equipped with deeper insight into his relationship with his older brother would be reluctant to condemn him to death.

    “In short, there simply is no set of facts too barbaric and no defendant too unsympathetic or lacking in remorse for a capital sentence to become inevitable. Even in the most aggravated cases, mitigation far less compelling than what Dzhokhar Tsarnaev would be able to present at a new trial has moved jurors, and it only takes a single juror to prevent a death sentence,” the advocates argue in a proposed amicus brief it wants the U.S. Court of Appeals in Boston to consider as part of the 25-year-old’s bid for life....

    Dzhokhar Tsarnaev’s public appellate lawyers filed their 1,124-page opening brief in support of a new trial Thursday. It has since been sealed by the court. A date has not been set by which federal prosecutors must respond...."

    BOSTON BOMBING AMPUTEE 'THROWN INTO THE AIR' AFTER BEING HIT BY CAR :(

    "A dancer who survived the 2013 Boston marathon bombing, losing part of her leg, was hit by a car this weekend.

    In an Instagram post, Adrianne Haslet-Davis wrote that she had been struck by a car on Boston’s Commonwealth Avenue while using a crosswalk.

    “Thrown into the air and landed, crushing the left side of my body. Yesterday,” she wrote in a caption to a picture of herself in a hospital bed Sunday.

    “I’m completely broken. More surgery to come.”

    Police told the Boston Globe that the accident happened at 7.15 p.m. Saturday, and the driver claimed that he did not see Haslet-Davis on the crosswalk because it was dark and she was wearing dark clothing.

    The driver remained at the scene and was cited for failing to stop at a pedestrian crosswalk, police told the newspaper.

    They added that Haslet-Davis's injuries are not believed to be life-threatening...."

    "Eight prominent Boston-area lawyers are on the record in support of a new trial for Boston Marathon bomber Dzhokhar Tsarnaev, arguing that he didn't get a fair trial in the city.

    Although Tsarnaev admitted to his role in the deadly bombing, his defense team is looking for a second chance.

    In a recent filing, the self-described "distinguished local citizens" argue the court "made a grievous error in insisting this case be tried in Boston."

    They believe the jury was too traumatized by the bombings to impartially decide his fate....."

    CAIR still fighting Boston Marathon bombing Ibragim Todashev case, attacking FBI agent Aaron McFarlane

    "Prosecutors have asked U.S. District Court Judge George A. O’Toole Jr. to provide Boston Marathon bomber Dzhokhar Tsarnaev’s lawyers, who are working on an appeal of his conviction, to keep the evidence secured. An appeals case regarding the murder of one suspect tied to the bombers, Ibrahim Todashev/Ibragim Todashev has also been dismissed. The claim in that case is that the student attacked the federal agent, but CAIR and other Islamic groups are defending the man. See their press release below...."
