No second trial for Chapo. In a 45-page order, judge Cogan denied the defense’s request and said jurors lied about following media coverage out of fear of getting in trouble not “because they harbored any biases against defendant or in favor of the Government.”

"NEW YORK (Reuters) - U.S. authorities said on Friday they were seeking a court order requiring Mexican drug lord Joaquin “El Chapo” Guzman to forfeit $12.7 billion following his conviction for racketeering and drug trafficking crimes earlier this year.

The sum represents the total amount of cocaine, marijuana and heroin that a jury found Guzman to have trafficked, multiplied by the average prices of those drugs, according to a filing by prosecutors in Brooklyn federal court.

It was not immediately clear what assets, if any, the United States could seize to satisfy the judgment....

“This is largely an academic exercise as the government has never located or identified a penny of this $12.7 billion in proceeds supposedly generated by Mr. Guzman,” said Jeffrey Lichtman, a lawyer for Guzman...."

The memo holds no surprise. When a jury found that Chapo was a leader of the Sinaloa cartel, who had “trafficked 150 kilograms or more of cocaine and obtained $10,000,000 or more in gross receipts within a twelve-month period” he was guaranteed life in prison.

"Mexican drug lord Joaquin “El Chapo” Guzman should be sentenced to life behind bars — plus 30 years, according to prosecutors.

Guzman, 62, already faces a mandatory minimum of life behind bars at sentencing following his February conviction on various drug trafficking charges — including operating a continual criminal enterprise.

Prosecutors say Brooklyn federal court judge Brian Cogan should tack 30 years onto the baseline sentence because a jury found Guzman guilty of the unlawful use of a firearms, including machine guns, while running the Sinaloa Cartel....

n their five-page filing, prosecutors also reveal that at least one unnamed Guzman victim will make a victim impact statement at next week’s sentencing — and another at least one more is seeking restitution.

“At least one of the victims who survived a murder plot initiated by the defendant intends to make a victim-impact statement at the sentencing hearing on July 17,” the document reads. “All but one of the victims the government was able to contact indicated that they would not seek restitution in this case. The government is awaiting a victim loss affidavit from the single victim who has indicated s/he would like to seek restitution.”

While it’s not clear from the filing who that victim is, former associate Miguel Angel Martinez Martinez testified at trial he survived at least three attempted murders ordered by Guzman while he worked for the Sinaloa Cartel, including an incident in which grenades were lobbed into his jail cell...."

"The only victim expected to speak before the sentencing of Joaquin “El Chapo” Guzman is the former head of a modeling agency he once tried to have killed, The Post has learned.

Guzman ordered the murder of the woman, whose name The Post is withholding, after she attempted to bribe a high-ranking law enforcement official with $10 million on the kingpin’s behalf — but the man refused. When the attempted murder victim told the Sinaloa Cartel leader the man had turned down the money, Guzman didn’t take it well.

“[Guzman] was angry and he said she was a liar, he ordered her killed,” former cartel associate Alex Cifuentes testified at the drug-lord’s trial...."

The hearing is more or less a formality: Guzman, the 62-year-old former leader of the Sinaloa cartel, was convicted in February of crimes spanning a quarter of a century including trafficking hundreds of tons of cocaine, heroin, methamphetamines and marijuana to the United States.
