Plead not guilty. $45K bond for accessory ($15K for each count). Must wear GPS monitor upon release. In custody.

The three defendants in the July 2020 Frostproof triple homicide case have all appeared in Polk County 10th Circuit Criminal Court in Bartow in recent days as each of their three separate cases moved closer toward a trial.

The accused shooter Anthony Lee “T.J.Wiggins, 28, appeared in court Friday before Judge J. Kevin Abdoney. His defense attorney Debra B. Tuomey had filed a motion to reschedule the April 3 trial, which Abdoney granted. The judge also set a status hearing for 8:15 a.m. Jan. 27 to go over deadlines for both sides as they prepare their cases. A new trial date could also be set.

On Tuesday, Wiggins' brother, William Wiggins, appeared before Judge Lori A. Winstead and his case was continued. His defense attorney Cory Chastang said he and his client needed more time to prepare for a trial.

No trial date has been set. The younger Wiggins, 24, is charged with three counts of accessory after the fact in a capital felony and one count of tampering with evidence.

The third defendant, Mary Wittemore, 29, also appeared Tuesday before Winstead. Her attorney Jonathan Mills said more time was needed before he expected the trial to start.

It's been nearly 3 years and yet Mary W. and Bill W.'s lawyers need more time?? Trials delayed is Justice delayed for the victims and their families.

*Arrested & charged (3/14/20) & arraigned (6/5/20) with 2nd degree aggravated battery (person uses a deadly weapon) & 3rd degree aggravated assault (deadly weapon w/o intent to kill). Plead not guilty. Bond $6K. Bonded out on 3/16/20. Bond was cancelled (7/22/20).

The judge also set a status hearing for 8:15am on 1/27/23 to go over deadlines for both sides as they prepare their cases. A new trial date could also be set. 1/20/23: Notice of taking deposition. Status hearing was changed to Case Management hearing.

The case in which Tony "TJ" Wiggins is charged in connection with the July 2020 murders of three people in Frostproof won't get underway until July 2024.

Wiggins, 29, appeared Friday before Judge J. Kevin Abdoney, who chastised the defense for the slow pace of the case, but set a new trial date for July 22, 2024. Prior to the judge's order, jury selection for what was anticipated to be a four-week trial was set to begin April 3.

Judge Abdoney also ordered a final list of defense experts be disclosed to the court within two months and their expert reports are due within three months of Friday’s hearing to give time for prosecutors and the defense to prepare for trial.
Abdoney did not rule on a change of venue requested Dec. 5 by defense attorney Debra Tuomey. To a reporter outside the courtroom, she said, “There is no way that TJ Wiggins would get a fair trial in this county.”

"The pre-trial publicity in Mr. Wiggins Jr. homicide prosecution continues to be so great that attempts to obtain impartial jurors in Polk County for any criminal matter would be futile and a change of venue should be granted,” Tuomey said.

In other filings, Tuomey said the defense has also asked the judge to suppress evidence collected following a search of the 0 Sarver Road residence in Frostproof, where the Wiggins family was living at the time of the killings.

The judge did not rule on any of those motions regarding the Wiggins case at the status hearing. The next hearing in the case was set for March 10 at the Polk County Courthouse in Bartow.
 
@PayrollNerd - just wondering if there are any updates yet for TJ's aggravated assault & assault on LE charges? Last hearing was on 1/24/23. I have his murder case on 3/10/23 per article above.
Also have Robert & Mary's new dates.
