Testimony began Wednesday in a hearing that could result in the dismissal of manslaughter charges against 70-year-old Trevor Dooley, if the judge grants the defense motion seeking immunity from prosecution under the 2005 Florida "Stand Your Ground" law. The statute says people don't have to exhaust all avenues of retreat before using deadly force to defend themselves against an aggressor.

I hope to H, the jury sees through this old man, and comes back with the verdict he deserves, guilty on all counts!

A judge on Friday requested written arguments from lawyers on a motion to dismiss charges in the September 2010 shooting death involving two neighbors at a Valrico playground.
Hillsborough Circuit Judge Ashley Moody set March 16 and March 29 deadlines for the defense and prosecutors, respectively, to file their arguments. The judge set April 26 for a hearing on the disposition of the motion.
On Thursday, defendant Trevor Dooley, 71, testified during a hearing on a motion to dismiss charges against him in the death of David James, 41, based on the state's "Stand Your Ground Law."

Dooley received an eight year prison sentence for killing Valrico father David James after the two argued over a skateboarder being on a neighborhood basketball court. David James' daughter was there when the shooting happened.

A judge allowed Dooley to post bail and go free for a time due to his age and the fact that he hasn't been in trouble with the law. The bond amount is $100,000, which means Dooley had to give a bail bondsman $10,000.

After exhausting his appeals, Trevor Dooley, 73, has finally begun serving his prison sentence for manslaughter in the shooting of David James, 41, on Sept. 25, 2010...

Dooley lost his attempts to invoke the state’s “Stand Your Ground Law.” Although he was allowed to remain free while he appealed on that issue, a state appellate court curtly dismissed his petition last month. On Nov. 17, his lawyer said he had surrendered to authorities to begin serving his prison term.

Dooley’s case will be back in court Tuesday in Tampa as three appellate judges hear arguments about whether he might be entitled to a new trial.

He has been free on bond, awaiting the outcome, since late 2016.

His latest effort to have his conviction overturned has to do with what his defense says were flawed jury instructions about the justifiable use of deadly force.

Dooley, now 77, was found guilty in 2013 of manslaughter in the death of David James.

Danielle James was only eight years old when she watched her father, David James get gunned down by neighbor Trevor Dooley.

Now, 11 years later, she's watching the man who pulled the trigger walk away with a sentence of probation.

During a plea hearing Tuesday for Dooley, Tampa judge Michael Williams wanted to hear from James' family before accepting the state offer of probation with no prison time.
