Nelson’s attorneys have argued his difficult upbringing and lifetime of substance abuse issues, imprisonment and mistreatment should give jurors pause about recommending that he be sentenced to die. Prosecutors say the cruelty of Fulford’s slaying weighs in favor of capital punishment.

By the time Scott Nelson was born in Massachusetts in 1964, his mother Joan had already suffered several nervous breakdowns and was medicated on powerful psychiatric drugs, James Nelson said. Their father, Lawrence Nelson, once beat her when she was seven months pregnant with Scott Nelson, his brother said.

James Nelson described his father as a “good provider,” who was highly regarded in the community. But inside their home, he said Lawrence Nelson was “extremely emotionally abusive, verbally abusive and physically abusive” toward the three brothers and their mother.

“He would call people derogatory names and make fun of us,” James Nelson testified. “I was hit with a two-by-four on more than one occasion. He would throw things at you. He would get you in a corner and he would beat you with a belt. ... He punched me in the face.”

My note: During LIVE testimony, I heard Thomas Broderick state that he is the cousin of Scott Nelson (not stepbrother).
Yes, he said cousin!

In 1994, when Scott Nelson was about 30, he was convicted and sentenced to 14 years in prison for robbing his father with a gun of $10,000 and a car. James Nelson said his brother had previously asked Lawrence Nelson to stay with him, but their father refused. Thomas Broderick, Nelson’s cousin, said after the robbery, Scott Nelson told his father, “You’re never going to hurt me or my mother again.”

Jurors also heard Tuesday from neuropsychologist Robert H. Ouaou and neurologist Mark Rubino about how Nelson’s multiple head injuries over the decades, alcohol abuse and heart problems could have affected his memory and cognitive skills. Nelson’s IQ is 82, and he exhibits short-term memory loss as well as behaviors like impulsiveness, inattention and poor planning, according to the doctors.

*Penalty Phase continues (Day 3) (@ 9am ET) - FL - Jennifer Lynn Fulford (56) (missing Sept. 27, 2017, Winter Park; found Sept. 30, 2017) - *Scott Edward Nelson (53) arrested & charged (10/1/17) & indicted (12/12/17) with 1st degree murder, kidnapping, burglary, assault & battery, (1st degree) car jacking with deadly weapon, (1st degree) robbery with firearm & (3rd degree) tampering with a witness. Plead not guilty. No bond on all counts. DP case.
Trial started 6/10/19 with Jury selection & ended on 6/21/19. Trial started 6/24 & ended on 6/27/19. 12 jurors & 3 alternates. 7/1/19: 1 juror excused, 2 alternates left.
Verdict after about 3 hours of deliberations on 6/28/19: GUILTY of First-degree murder with a weapon. GUILTY on all other counts. Penalty phase begins Monday morning, 7/1.

7/2/19 Penalty Phase (Day 2): Defense witness: James Nelson (Nelson's older brother). Tense moment in the courtroom as state keeps objecting to parts of James Nelson's testimony about childhood. Scott Nelson says, "Shut up" to a prosecutor, then tells the judge, "I object to all these interruptions." We're on a break now. Defense witnesses continued: Clifford Benson (Nelson's childhood friend). Thomas Broderick (Nelson's cousin). Dr. Robert Ouaou, Neuropsychologist. Mark Rubino, Neurologist. Trial continues on 7/3.

This is interesting. At about 15 minutes in, this attorney says the prosecution should bring someone from prison in to testify and it would make SN lose his cool and the defense had someone in from the prison today and SN lost it
