Scott Nelson’s brother testifies about childhood abuse as jury weighs death penalty for Jennifer Fulford slaying
JUL 02, 2019 | 1:51 PM
[...]
Nelson’s attorneys have argued his difficult upbringing and lifetime of substance abuse issues, imprisonment and mistreatment should give jurors pause about recommending that he be sentenced to die. Prosecutors say the cruelty of Fulford’s slaying weighs in favor of capital punishment.

By the time Scott Nelson was born in Massachusetts in 1964, his mother Joan had already suffered several nervous breakdowns and was medicated on powerful psychiatric drugs, James Nelson said. Their father, Lawrence Nelson, once beat her when she was seven months pregnant with Scott Nelson, his brother said.

James Nelson described his father as a “good provider,” who was highly regarded in the community. But inside their home, he said Lawrence Nelson was “extremely emotionally abusive, verbally abusive and physically abusive” toward the three brothers and their mother.

“He would call people derogatory names and make fun of us,” James Nelson testified. “I was hit with a two-by-four on more than one occasion. He would throw things at you. He would get you in a corner and he would beat you with a belt. ... He punched me in the face.”

Court has resumed with Thomas Broderick, Nelson's stepbrother, on the stand. So far, he's provided fairly perfunctory details of his own background. #WFTV
^^

My note: During LIVE testimony, I heard Thomas Broderick state that he is the cousin of Scott Nelson (not stepbrother).
Yes, he said cousin!

In 1994, when Scott Nelson was about 30, he was convicted and sentenced to 14 years in prison for robbing his father with a gun of $10,000 and a car. James Nelson said his brother had previously asked Lawrence Nelson to stay with him, but their father refused. Thomas Broderick, Nelson’s cousin, said after the robbery, Scott Nelson told his father, “You’re never going to hurt me or my mother again.”
[...]
Jurors also heard Tuesday from neuropsychologist Robert H. Ouaou and neurologist Mark Rubino about how Nelson’s multiple head injuries over the decades, alcohol abuse and heart problems could have affected his memory and cognitive skills. Nelson’s IQ is 82, and he exhibits short-term memory loss as well as behaviors like impulsiveness, inattention and poor planning, according to the doctors.

The defense is continuing to present its case today. The first witness is Tim Gravette, formerly an associate warden with the Federal Bureau of Prisons. #WFTV

^^ My note: Witness identified himself as Roy Gravette and stated he goes by the name of Tim. I found this:

Gravette is discussing Nelson being viewed as a narc: “He stayed in the special housing unit because he was one of those inmates, and I’m trying to be kind here, who couldn’t keep his mouth shut.” #WFTV
  2. Field Sutton‏Verified account @FSuttonWFTV 4m4 minutes ago
Gravette: “I didn’t see where he made the Hispanics mad, but he had everybody else mad at him.” #WFTV
  3. Field Sutton‏Verified account @FSuttonWFTV 4m4 minutes ago
Gravette: “He had issues with the white gangs, particularly the dirty white boys, which is a big group in the federal prison system. And if you make the dirty white boys mad, you make a lot of white groups mad.” #WFTV
  4. Field Sutton‏Verified account @FSuttonWFTV 4m4 minutes ago
Gravette: “Out of 19 years, he had spend 95% of his time in the special housing unit, and that’s kind of unique.” #WFTV

Gravette has been explaining prisons' special housing units, which are special areas used for segregating inmates. In this case, largely for Nelson's protection. #WFTV

Nelson, to the judge, referring to Nunnelley: “He’s bastardizing the process of this trial.” To his lawyer: “He’s called me a racist. Mistrial. Now!” The judge strongly rebuked Nelson for his outburst and then allowed Nelson's lawyer to speak with him privately. #WFTV

Nunnelley: “Mr. Nelson has shown no adverse effects from his time in special housing, as shown in the records, has he?” Nelson yells from the defense table: "He's out of control!"

Scott Nelson: I am demanding that we have a mistrial right now. We’ve been through enough. He called me a racist in front of five jurors." He then tells his attorneys, "When do I get to testify? Put me up there." We're in a recess now.

During testimony, Nelson yelled, "Stop it, he's out of control" at Assistant State Attorney Kenneth Nunnelley. After jury leaves, Nelson says, "I’m not going to have that man cackling like an idiot and bastardizing the process of this trial."

  1. Field Sutton‏Verified account @FSuttonWFTV 4m4 minutes ago
Judge White: “At this point you’ve had two outbursts. Are you confident that you can continue to follow the court’s orders and remain silent?” Nelson says yes. #WFTV
  2. Field Sutton‏Verified account @FSuttonWFTV 4m4 minutes ago
Judge White: “If you violate the court’s orders and you can’t follow the court’s orders, then you could forfeit your right to be present here in court.” #WFTV

  3. Field Sutton‏Verified account @FSuttonWFTV 5m5 minutes ago
Court is resuming. Judge White asks Nelson if he has any issues. Nelson: “No, I don’t have any issues at all sir. I’d just like to proceed. I was just getting into my feelings, I guess, and I’d like to move on.”

This is interesting. At about 15 minutes in, this attorney says the prosecution should bring someone from prison in to testify and it would make SN lose his cool and the defense had someone in from the prison today and SN lost it

Well here I thought his outburst was like - jumping out of his chair & yelling! LOL!

Thanks for all the tweets on the trial SeesSeas!!

Let me take you out for a virtual pizza!
