On Wednesday Paul Martikainen went before a judge at Federal Court in Ft. Myers. He was appointed a public defender and told a judge he wanted the case moved to Orlando. On Tuesday night U.S. Marshals took 35 year old Paul Martikainen into custody. When asked if he felt bad about what he did, he simply replied, "No".

If convicted Martikainen could face the maximum of 3 years in jail and a $250,000 fine. While DCF says there's proof that Martikainen abused his son in the past, his attorney says those claims are unfounded.

Google search says this article is supposed to say "No bond for dad accused of taking son," but I could find it nowhere in the article, just the really offensive quotes from the perp's attorney. There should be complaints to the media for publishing this maligning of the victims.

No where could I find in the link where it says "No Bond". Was the story changed from No Bond for kidnapper to one that shows the perp in a more positive manner? This guy and his public defender are doing all the same crap that they pull in almost EVERY case in FL.:furious:

They claim mom is making false allegations...

They say the abuse allegations are unfounded (even though they are substantianted and have been substantiated publicly in the news, not just on their supersecret reports)...

2:28 P.M. — Martin DerOvanesian, the federal public defender assigned to alleged kidnapper Paul Martikainen, said this afternoon the man who took his son on a sailboat into the Gulf of Mexico, was motivated to protect his 3-year-old boy, Luke Finch.

“The only thing he wanted me to let everybody know, the only thing he thinks of and cares about is taking care of his son,” DerOvanesian said.

The suspect’s attorney compared the case to other parental abductions.

“I think people need to understand this is a typical child custody battle between two former spouses,” DerOvanesian said. “My understanding is that the ex-wife (Christa Finch) has made allegations about abuse to children and family services and these have been investigated and unfounded. It’s just back and forth all the time. These are fairly typical custody situations.”

“You take the sailboat from e-Bay out of it and the international waters out of and you see this all the time,” DerOvanesian said.

I agree! Since when is kidnapping 'typical'? It's a crime, parental or not.
Maybe Mr. DerOvanesian will tell us it's 'typical' for fathers to be willing to give up their parental rights as part of their divorce agreement too, as this 'sperm donor' did and when his ex was interested in another man, he decided to kidnap their child rather than do the uh, typical thing and uh, coparent. Apparently for Mr. DerOvanesian coparenting must be a 'rare and foreign' concept. After all, if you can't have what you want just take it right? Abiding by the laws of the courts, nah, not typical at all....

If his eyes did not look wild / crazy / intense ? well then I would have to say I think technically he can argue that all the claims were unfounded that he is only interested in his child's safety;
But safety by sea, in the night? expecting a storm, and not being a proficient sailor is insane, it does not fit. And 3 years in not enough.
She will have to run all her life unless she can succeed in having his parental rights remover, and then move and change identity anyway. that is the only way she can feel safe with the laws we have now.

A judge-appointed supervisor monitoring a court-ordered visit between a 3-year-old Cocoa boy who was abducted by his father will not face any charges, police announced today.

"Police believe Martikainen had the abduction planned and used Rumble," a police official said in a statement, Florida Today reported. "Therefore there will be no criminal action taken against Rumble."

Martikainen spent the night at the Lee County Jail and was taken to the Federal Courthouse in Ft. Myers. According to this Public Defender, it started as a long time custody battle, "Apparently this is a bitter dispute that's been going on for years."

Martikainen's ex-wife Christa Finch call him a con man who had a plan to kidnap their child, even though she's the one with custody, "In all of these types of situations there are always two sides to the story. I think it&#8217;s quite unfair to speak to only one side." So that's why this public defender's speaking out for this dad, "Allegations that the ex-wife has a new boyfriend and pressures on the little child to refer to him as his daddy. Paul Martikainen, 35, faces up to three years in prison if convicted on a federal charge of international parental kidnapping in connection with the Nov. 28 incident involving his son, 3-year-old Luke Finch.

He filed a written plea of not guilty and waived his appearance at an arraignment set for this morning before United States Magistrate Judge Karla R. Spaulding, Local 6 news partner Florida Today reported.

Authorities said Martikainen snatched the boy from Cocoa Riverfront Park while a friend -- who a judge ordered to supervise visits amid allegations that Martikainen had abused the boy -- stepped away to the restroom during lunch. Martikainen drove the toddler to Fort Myers and set sail for Mexico, police said.

Palm Bay dad's kidnapping trial on hold until March

During a status hearing Thursday in Orlando, court records show 35-year-old Paul Martikainen asked federal U.S. Magistrate Judge Gregory A. Presnell to postpone his anticipated February trial.

Presnell agreed, saying in his order that "the ends of justice outweigh the public's interest to a speedy trial."

The judge set a status hearing for 8:45 a.m. Feb. 18. Martikainen's presence is not required at the hearing.

Martikainen faces up to three years in prison if convicted of international parental kidnapping. He has pleaded not guilty.

Nearly three months after Christa Finch's ex-husband sparked a statewide manhunt by abducting the couple's 3-year-old son from a Cocoa park, the case is expected to end abruptly with a guilty plea next week in an Orlando courtroom.

Paul Martikainen will admit to charges that he kidnapped his son, Luke Finch, amid an ongoing custody battle and fled with the boy on a sailboat in the Gulf of Mexico as a storm approached, court documents show.

Martikainen, 35, of Palm Bay faces up to three years in federal prison and a $250,000 fine on one count of international parental kidnapping. :shakehead: :furious:

"I'm sure she would tell you they couldn't lock him up long enough for her," said Finch's attorney, Alan Landman. Finch, of Cocoa, could not be reached Wednesday for comment. A call to her cell phone indicated the number was no longer in service.

"Now she has some closure in her life and doesn't have to live in fear every time he picks up the child," Landman said. "I'm sure she would also tell you that once he gets out, from her perspective, he's not going to see the child again."


Typically, judges will order a pre-sentencing investigation after a guilty plea is entered and set off sentencing about 75 to 90 days, court officials said.

"The defendant is pleading guilty because defendant is in fact guilty," according to court papers filed this week. Martikainen agrees that "were this case to go to trial, the United States would be able to prove those specific facts and others beyond a reasonable doubt."


What's next
Paul Martikainen's plea hearing is set for 10:30 a.m. Feb. 18 before U.S. Magistrate Judge Karla R. Spaulding in courtroom 5D of the federal courthouse in Orlando.

A Brevard County man who kidnapped his son during a supervised visit last year and fled with the toddler on a sailboat will be sentenced in Orlando federal court today.

Paul Martikainen, 36, faces up to three years in prison and a fine of up to $250,000. He pleaded guilty to a count of international parental kidnapping in February.

I'm so glad there is an update to this! I've always wondered what he would be sentenced. All of this took place right before I started posting on WS, but Riverfront Park is not even 10 minutes from my house and I remember seeing the mom all over the news and feeling so horrible for her.

A U.S. appellate court has ruled that a father convicted of kidnapping his son from Cocoa and setting sail with him in the Gulf of Mexico should be resentenced because prosecutors wrongly argued he fled from law enforcement officers.

He has already done 17 months. :eek:

These are federal charges.

He does at least 85% of the time.

(I think I'm correct on my Math here...)

So if he gets a new 21 month sentence.... he won't even have to finish up to 18 months. He would almost certainly be released immediately.

With a 27 month sentence... he would do almost 23 months. That would keep him in until late October or so.

So Luke will be 5 years old instead of 3?

Wow... that's reassuring. :waitasec:

Even if he got and did the full 27 months with no 85%... that's still only early March 2012.

I certainly hope precautions have been taken since they couldn't keep him in there longer...
