SAVANNAH, Ga. (WTOC) - It’s been nearly four years since law enforcement found the bodies of Mary and Elwyn Jr. Crocker buried in their own backyard. As the capital murder case against their father and multiple family members continues, WTOC Investigates has learned about new court action involving the Crocker children.

A legal petition pending in the Effingham County Probate Court could pave the way for a wrongful death lawsuit against the social workers who did not investigate child abuse claims.

Legal arguments are expected on Wednesday during a scheduled hearing in the case.

The probate case began in March of this year when an Effingham County resident named Sophia Pfohl petitioned the court for the letters of administrator over the estates Mary and Elwin Jr., according to the probate court filing. Usually, an estate is created when someone dies without a will.

I'm thinking NO on this probate case and potential lawsuit. I don't see the need to follow the blow by blow hearings and proceedings. It could get dismissed or continue on for years. We can keep up with it through posted news articles for now.
 
probate case -

Attorneys representing the woman asking to become the administrator for the estates of the Crocker children went into the Effingham County Courthouse around Wednesday around 10 a.m. They came out just before noon.
But WTOC doesn’t know what happened inside or what’s next because of an order from Effingham County Probate Court Judge Beth Rahn Mosley to close the courtroom.

10/3/19: Candice Crocker has been ordered to undergo a mental health examination. 10/15/20 Update: Plead guilty to 2 counts of malice murder, 2 counts of cruelty to child, to 2 counts of concealing a death & 2 counts of false imprisonment. Rest of the charges were Nolle Prosequi (dismissed). Sentenced to life without parole & credit for time served (12/20/18 to 10/21/20) to be served concurrently. In plea deal she must testify against the other 3 defendants.

EFFINGHAM COUNTY, Ga. (WTOC) - Almost four years ago, Mary and Elwyn Crocker Jr. were found dead in their backyard in Effingham County.

Their father, a defendant in the case, was in court Friday as a judge heard pre-trial motions. The court addressed more than a dozen pre-trial motions by the defense in the case against Elwyn Crocker Sr.

During the pre-trial hearing, Elwyn Crocker senior’s defense attorneys said their were 16 search warrants filed in this investigation.

We’re also learning there were about seven or eight devices, like phones and tablets, taken from the home the siblings lived at with their family.

One of Crocker’s defense attorneys Samuel Wood argued that some evidence presented in pre-trial hearings should be closed to the public. He says because if potential jurors see content like what’s on those devices mentioned or disturbing photographs before jury selections for trial begin, their opinion could be swayed.

Lead prosecutor Matt Breedon denied the motion.

“Those photographs will be displayed to this court in a manner to where they will not be able to be video recorded by the crews in the court room, either they will be handed to the court or they will be displayed on a screen that will angled towards the court.”

As Crocker Sr.’s attorneys defended several motions, one topic kept coming up...the state’s wish to pursue the death penalty.

The motions discussed at this pre-trial hearing have not been ruled on by Chief Judge F. Gate Peed yet. He has until trial begins to make a decision.

As for what’s next, Judge Peed says Elwyn Crocker Senior, Kim Wright and Mark Wright will be in pre-trial hearings together at the end of October.

When trials begin, the three defendants will be tried separately. Judge Peed says the first person in trial will be Elwyn Crocker Senior.

10/3/19: Candice Crocker has been ordered to undergo a mental health examination. 10/15/20 Update: Plead guilty to 2 counts of malice murder, 2 counts of cruelty to child, to 2 counts of concealing a death & 2 counts of false imprisonment. Rest of the charges were Nolle Prosequi (dismissed). Sentenced to life without parole & credit for time served (12/20/18 to 10/21/20) to be served concurrently. In plea deal she must testify against the other 3 defendants.
I figured there was some type of sexual abuse involved. This is a sick group of individuals. I hope justice is served. I remember when they story came out and how very sad it was that they were gone and it seemed no one cared.

9/16/22 Update: Motion hearing before Judge Peed (motions #36, 49,-64); Andriene Saxon, court reporter, Attorneys Matthew Breedon, Ada & Jerilyn Bell & Samuel Wood for defense. Crocker was in court Friday as a judge heard pretrial motions. The court addressed more than a dozen pretrial motions by the defense. One of Crocker’s defense attorneys Samuel Wood argued that some evidence presented in pretrial hearings should be closed to the public. He says because if potential jurors see content like what’s on those devices mentioned or disturbing photographs before jury selections for trial begin, their opinion could be swayed. Lead prosecutor Matt Breedon denied the motion. As Crocker Sr.’s attorneys defended several motions, one topic kept coming up...the state’s wish to pursue the death penalty. The motions discussed at this pretrial hearing have not been ruled on by Chief Judge F. Gate Peed yet. He has until trial begins to make a decision. 7/15/21 Update: A schedule of when each defendant’s pretrial motions will be considered. All defendants have filed a number of motions in recent months. Elwyn Crocker has filed 40. Kim Wright has filed 107. Mark Anthony Wright has filed 79. Beginning 8/27/21, the presiding judge will hear motions that attorneys weren’t able to resolve amongst themselves. Elwyn Crocker’s will be first beginning at the end of August, then from that point on every four weeks the judge will meet with prosecutors & defense attorneys to work through the motion list. All of this is expected though, especially given the amount of discovery & overall magnitude of the case. Judge Gates Peed gave his estimation in court Thursday of when a trial could begin. “I would like to be in a position to have a jury in place in the first quarter of 2022. Like I said, that might be overly optimistic, or it might not be,” said Judge Peed. The judge asked the counsel to have each defendant also meet with the State in the coming weeks to hash out what motions truly need to be brought to the court for a hearing. He wants a comprehensive list made by July 30. The first motions hearing for Elwyn is scheduled to take place on 8/27/21. Wright is brother of Elwyn Sr.'s wife, Candice & overheard a family discussion about Mary's death & called an aunt, who tipped off authorities. Judge F. Gates Peed has also imposed a gag order prohibiting attorneys and investigators from discussing the case outside court.

The court site still has 12/8/22 as hearing, but I will go ahead & move them to 12/9/22 - as I believe since all 3 filed motions to move the motions hearing.
 
I have moved them all to 12/9/22 - since they all requested it - it is not updated in the court site yet.
