Intimate relationship (LS) / Viktoria Gabriel

During his police interrogation on 31.03.1931 (LS)has stated that Victoria Gabriel have already offered him a few weeks after the death of her husband on 12 December 1914, engaging in sexual intercourse with her, which he had rejected having regard to his marriage ,

After the death of his wife (VS) on July 14, 1918 (LS) entered into an intimate relationship with Viktoria Gabriel. In his police interrogation on 31.03.1931, he stated that he had had in five cases intercourse with her. (LS) and Victoria wanted to get married. The marriage was prevented by the old Gruber, who had threatened that he would leave the court in the case of a marriage.

Paternity by J. Gruber and corresponding processes

When Victoria became pregnant in 1919 and you could see the pregnancy, there were rumors about the paternity of the unborn child within. It was rumored that the old Gruber was the father of the child. Gruber held (LS) for the author of this rumors and threatened him with the involvement of a lawyer. On 07/09/1919 Viktoria Gabriel brought her son Joseph to the world and was the father (LS) on. (LS) denied paternity and showed Viktoria Gabriel and Andreas Gruber on 10.9.1919 due to incest. He stated that Victoria herself had told him that she had again had sexual intercourse with her father. He also stated that Andreas Gruber from him 3,000 marks maintenance have called for Joseph.

Pastor Michael Haas had now entered the birth of Joseph in the parish register of Waidhofen and under the name Josef Gruber with the words "illeg.".

Andreas Gruber was taken after the display on 09.13.1919 in custody since he was considered a repeat offender. On 25/09/1919 (LS) pulled at the insistence of Viktoria display for incest back. She had him 2,000 marks (possibly later 3000 Mark additional) paid, so he did not have to pay out of pocket the settlement sum with respect to the maintenance. Very likely a marriage he was also again promised. On 25/09/1919 relieved (LS) Andreas Gruber before the guardianship court and acknowledged paternity. Gruber was released from custody. He did not receive a compensation for detention.

Andreas Gruber was appointed by the Guardianship Court Schrobenhausen guardian for Joseph.

Between (LS) and Andreas Gruber as guardian of Josef Gruber was agreed in terms of maintenance for Josef Gruber that (LS) has to pay a severance payment in the amount of 1,800 marks. The guardianship court had approved this agreement.

On 23/10/1919 (LS) stated under oath before the District Court Schrobenhausen that the alleged facts in its display of 10.9.1919 (incest) are still true.

On 31.12.1919, the public prosecutor brought in the district court Neuburg charges against Viktoria Gabriel and Andreas Gruber for incest, because (LS) had reaffirmed after a revocation, the truth of the facts of his complaint for incest underlying oath.

In the course of 1920 both were acquitted of the charge of incest, because the contradictory statements of (LS) regarding the paternity of Joseph was not sufficient to convict. Since an acquittal has occurred, there must have been a trial before the District Court Neuburg. The date of the judgment is not known.

After the death of Josef (LS) inquired if he could get the severance amount paid back. He was told that this was not possible. This was kept him from Martinsried Mayr during police questioning by 31/03/1931.

The guardianship filing of AG Schrobenhausen were performed under number 216/19 and must be filed in the State Archives in Munich, if they have not been destroyed.

The criminal records of the District Court Neuburg / Danube were performed under number 9/20. Currently it is not known where or whether they are archived.

Donation of 700 gold marks in the confessional

This fact is (so far). Only by a dated on 12.08.1948 Summary of police officers Xaver Meiendres tangible, which can be viewed in the State Archives Augsburg. Meiendres was transferred on 05.01.1931 by the gendarmerie station Zwiesel at the gendarmerie station chief warden. On 08/03/1948 he was a letter from the head office Swabia (Tgb.Nr. 463/48) asked to resign from his memories of the event HK writing. Meiendres was then (as Chief Inspector) at the higher National Police School Sudelfeld.

Meiendres: "About 14 days before the fact, 700 marks were set in gold in the confessional of the parish church of Waidhofen. The then minister of Waidhofen who knew the financial situation of his parishioners was pretty much convinced that only a member of the Gruber family of Hinterkaifeck could have put the money in the confessional. When he subsequently the daughter of Mr and Mrs Gruber was coming to him, and they asked her about the origin of the money, she admitted, after some hesitation, that they have put the money for missionary purposes in the confessional. Nocturnal Search Viktoria Gabriel or Cäzilia Gruber

Sophie Fuchs, a former classmate of Cäzilia Gabriel, testified in a police interrogation on 17.12.1951 that Viktoria Gabriel said to have left on 30/03/1922 after a violent dispute Hinterkaifeck late. The whole family was in custody on the search made (which has apparently led to the river a couple) and then I found Victoria sitting on a tree stump in the forest. This presentation was given when she was tired the next day at school and was interviewed by the teacher after the basic Cäzilia Gabriel.

1984 Sophie Fuchs said in a hearing by Commissioner Konrad Müller contrast, submit that had the nightly search of the grandmother, so Cäzila Gruber counted.

This representation and the two versions are (so far) survived only by the relatively late statements of the witness Fuchs.

Munich newspaper at the edge of the forest / tracks in the snow

These two facts can be found in the statements of the Post Schaffner Josef Mayer from Waidhofen.

1951 Ludwig Hecker had a conversation with Josef Mayer and related information from it in his 10-part serial story about the murder case Hinterkaifeck in the "Donau Kurier".

1952, possibly due to the continuing story of Hecker and in the course of the investigation against the brothers Gump, Mayer was questioned by police and later before the magistrate. The interrogation protocols of the conductor's post from 01.10.1952 and 05.06.1952 pursuant mentioned Andreas Gruber and his daughter Victoria Mayer over the discovery of a "Munich newspaper" at the edge of a forest and asked him if he knew someone who would refer this newspaper. Also the post Schaffner has been reported that have discovered the courtyard leading tracks in the snow Andreas Gruber from the forest.

The first statement (10/01/1952) was arrested in the apartment Mayers in Waidhofen by the police officers Prähofer and walnut. The second statement (05/06/1952) was recorded in the District Court in Schrobenhausen. Present were here the magistrate Hölzle and the court clerks Reiner. Mayer pointed out that he had been questioned in 1922 by station commander Goldhofer Hohenwart. A protocol, if made, seems to have not received it.

While the discovery of the "Munich newspaper" only mentioned by Josef Mayer, the tracks in the snow are also confirmed by other statements. Commissioner Reingruber wrote on 06/04/1922: "It should also be noted that the property has been committed in the 03/30/22 spent two men of a burglary in the early hours of Thursday. It is broken into the engine house as stated by the Andreas Gruber, but nothing was stolen. In fresh snow footprints of two men were seen, leading to the property, but there were no traces allegedly present which had led away from the property. (Details of [LS]). "

(NB .: In the statement of [LS] from 05.04.1922 this information is not included, they should be subsequently come to the attention of Commissioner Reingruber.)

Jacob Sigl mentioned the facts of the footprints in the snow in his statement from 01.10.1952. According to him learned his father Kaspar Stegmair from Gröbern, who was on his way to Schrobenhausen, on 30/03/1922 by Andreas Gruber, "that in the snow a track to his estate go, he thought that rogues were in his house. Stegmair should have Gruber asked to leave the property search, whereupon Gruber replied that he was not afraid. "His father told him about this interview on the same day at the cattle market of Schrobenhausen.

The much-awaited by Andreas Gruber letter

This fact seems to be - rather suggestively - only to find at Leuschner, in the 3rd edition of "The murder case Hinterkaifeck" about on p.23. But even at Leuschner is not said that Gruber had immediately asked several times and almost urgent for a letter. A letter speaks of possibly only ever the Post Schaffner in his answer to the question of Gruber, if he did not have with me more than the newspaper: "Your letter comes soon enough before you die."

This passage could be due to literary freedom. Post Schaffner Mayer does not mention the issue in his two interrogations in 1952 (see above).

Possibly existing firearms on HK and her whereabouts

On Hinterkaifeck 1920/21 there has been certainly at least one firearm.

There are two statements:

Rupert was a Scheppach 1919/20 as hoarders few times to HK. Well in 1920 he was asked by Andreas Gruber to repair a gun and brought him in the same year, a half-pound shot pellets, packed in one with his name and the words "wage for the second with 02.08.1920" labeled paycheck. Because this pay check was later found in the chamber of the murdered maid, Scheppach was interrogated by the police.

(Note .: See also Leuschner, 3rd edition, p 177 .: "Once the old Gruber had asked him to look up a gun. Scheppach realized that it needed a new pilot cone and promised to bring it the next time in order . ")

From the former Hinterkaifecker maid Kreszenz Rieger there is a Protocol of interrogation 09/07/1952. There they mentioned u.a .:

"Became known to me that the boys Thaler a year ago (Anm .: is meant the year before the murder, ie 1921) were encountered in the Wagenschupfen night of Gruber. At that time they should have injected fresh with an infantry rifle of the old Gruber. I once heard the shot. But I did not tell you what was the cause of the shot, so I do not have more terror in my pregnant state. "

Whether the repaired from Scheppach gun (and possibly another weapon) in 1922 on the farm was (s) and whether these (s) was functional (s), can not be said with absolute certainty. At least one weapon (probably the repaired from Scheppach) but must have been operational in 1921 on the farm. From an "infantry rifle" says Rieger Kreszenz apparently only by hearsay.

But she clearly states that she had heard a shot.

This weapon (s) was (were) not found in 1922 after the murder on the farm. Neither of Bernhard Gruber, who has lived in the yard after the fact at times, even from demolition in 1923 it is known that subsequently a (possibly hidden) firearm was found.

Unknown at the cemetery of Waidhofen

The stranger at the cemetery of Waidhofen is only in the revision of history - mentioned by Josef Ludwig (Hecker) from the year 1972 "Hinterkaifeck A sombre reminder". It says that Viktoria Gabriel did, the 30/03/1922 participated in a choir rehearsal on Thursday. On leaving the church have a singer at the cemetery output waiting for them and seen here is that a middle-aged man in front of Viktoria Gabriel had appeared and told her: "Let's run the geese. I'll accompany you. " Victoria replied that they find their way alone. When he had put her in the way she has asked him to leave her alone. He replied that she was the kind of woman who let him no rest. After further exchange of words and an insult to the man Victoria gave him a slap.

In the previous version of the Hecker-history from the year 1951, the unknown is not mentioned in the cemetery of Waidhofen.

Even otherwise, there is no statement an indication that Viktoria Gabriel on 30/03/1922 actually had an argument with a man at the cemetery of Waidhofen.

Loss of the door key from HK

On the morning of 3/30/1922 mentioned to Andreas Gruber its neighbors (LS) that he missed his house key. He also mentioned a little later the loss of the key against the passing Gütler Kaspar web Meier from Gröbern.

In his statement from 05/04/1922 (LS) does not mention that the murdered Gruber told him about the loss of the key. He mentioned this but during his police interrogation on 31.03.1931 against the police officers Ried Mayr from Munich police headquarters. At the same time he also says even that he was quite sure that the Hinterkaifecker were only in possession of your house key.

In Leuschner-book 1st edition 1997, however, is to read that Gruber Kaspar web Meier has lamented over the loss of the second (!) Front door key.

This discrepancy in the statement of Kaspar web Meier is not verifiable, since his testimony in the Munich State Archives does not exist.

Kaspar Stegmaier was the father of Jacob Sigl. Sigl mentioned in his statement from 10.01.1952 that his father Andreas Gruber on 03.30.1922 the story told by the footprints in the snow, but he does not mention the loss of your house key.

Attorney Pielmaier takes in his report dated 06.11.1926 but regarding the statement of Stegmaier. He writes that Andreas Gruber had the witnesses )LS) and Stegmaier indicated to that drop their him a house key. From this formulation, one could possibly conclude that several front door key must have been present, otherwise the talk of the loss of the door key would have been. However, this statement is vague.

The loss of Haustüschlüssels plays a role in the statement of Wenzeslaus Bley. He reported that Ms. Gabriel told before the murder at people or in shops that with them the house key already missing a few days.

Nocturnal restlessness in the attic

This fact is (apparently) reported only by Wenceslaus Bley. Bley's 1930 that Andreas Gruber should have told on 31.03.1922 in the hardware store bird in Schrobenhausen, he had on the night of 30th to 31.03. heard unusual noises in the attic of Hinterkaifeck. Gruber had a look, but I can find no cause.

Wenzeslaus Bley is a matter of hearsay here again. You may be the basis of a run in Gröbern in the inn Schwaiger conversation.

Even before the Tatnacht Unleashed beef

Johann Krammer, who as a 17 year old inquiries hires in 1930 about the murder case Hinterkaifeck and is friends with Wenzeslaus Bley, indicates that Andreas Gruber should have reported in the hardware store bird in Schrobenhausen on 03.29.1922, that night a cow to have been unleashed in the barn shall be or be rid. Become aware by the unrest, have looked Gruber and tied the cow again.

This story gives the impression that it had virtually given before night of the murder a "trial run" of the offender, who wanted to attract the Hinterkaifecker in the barn by a Unleashed beef. Source also seems to have been at the tavern table conversation.

It should be reflected in this story the actions of a gang of robbers (the Schmaderer family), which has lured many years before the murder case Hinterkaifeck farmers through the unleashing of cattle in the barn and there low- or killed in order to deprive the court may , This fact in turn seems in newspaper articles after the murder HK to have been mentioned. In public, it was known that has actually been a non tethered cattle in the barn at Auffindungstag. Even the Munich Criminal Police had suspected that the victims were lured by Unleashed cattle in the barn and further into the barn.

The man with the torch / fire in the oven

The facts of the temporary night at Hinterkaifeck carpenter Michael Plöckl who has observed the light from a flashlight and smoke or fire in the oven Hinterkaifecker is handed down by a report from Attorney Pielmaier and by the testimony of several witnesses. The statement of Plöckl himself that this (as evidenced by a marginal note) must have submitted on April 5, 1922 before the court Schrobenhausener Commission has, however, seems not to have received, and is possibly burned along with the files Neuburger 1944 in Augsburg.

Even in an article in the newspaper "Kurier" on April 8, 1922, reported: "On Saturday evening a passer will have seen the light in the oven, which seems almost incredible, do not you believe in a particular audacity of the criminals who are quiet time left. "

With date of 29 April 1922, the statement of the maid Magdalena Beck cup was logged in Augsburg, the resident of her in Gachenbach (BA Schrobenhausen) father had learned the facts of the unknown with the flashlight. Lorenz Beck cup Gachenbach was then heard on 1 June 1922 in Schrobenhausen: "A few days after the robbery was discovered in Hinterkaifeck, I sat in the Kugler-economy in Schrobenhausen. At the table I told some unknown worker that a carpenter from Waidhofen evening went from Gröbern and Kaifeck to Waidhofen. As he (the carpenter) passed the Hinterkaifeckhof, a rather large man person u came out of the oven located at the rear of the property. Shone in his face. Then again this should be gone in the oven to have spoken without a word. The name of the worker, as well as the candidate carpenter I can not say. "

Sergeant Alois B lank of High Wart added this handwritten submitted statement following (also handwritten) note to (?):... "In the present case the carpenter Michael Plöckl, z currently living in Haidhof, Gem cheeks comes into consideration. The same was, as here hand is known, already on April 5 and interrogated by the judicial commission at the scene. Have already written the details. "

In a report on the murder case Hinterkaifeck - dated 11.06.1926 - is the Neuburger Attorney Richard Pielmaier the incident again as follows: "A witness, Michael Plöckl that again on Saturday, April 01 in the morning, then on the same day in the evening is passed on Hinterkaifecker property, will have noticed that the oven door closed in the morning, but the evening was about half open and that evening the fireplace should have smoked something; also he wants in the forest, which is in the vicinity of the property until close to the road zoom, a flash of light in the evening, such as from a flashlight coming, have noticed. "

1930 issue of Johann chamber and Wenzeslaus Bley is mentioned again. Since chamber reproduces only stories of Bley, in the following only the statement of Wenzeslaus Bley (August 8, 1930) is quoted as saying: "On Saturday, April 1st, 1922 at 01.02 at night 12 clock went the carpenter Michael B l ö ckl of Gröbern after Mitterhaid. His way led past the courtyard behind Hinterkaifeck. In passing he looked like in the oven, this formed a separate cottage in the court-yard of the property, the fire burned. He stopped and looked. At the same moment this man is (Note would be properly .: "a man"), the opening out of which came the glow closed. This man was now with an electric flashlight on him. The lamp he held at arm's length in front of him. He shined the Blöckl directly in the face without saying anything and is back in the yard. Blöckl was afraid and ran away. "

A slightly different presentation at April 26, 1931 "the married Sawyer" Sebastian Maier from cheeks before the gendarmerie station chief warden, (LS) suspected massive "From the Gütler and nunmehrigen Gemeindediener Michael Plöckl in cheek, I learned that the same at the time the murder is every day, always gone in the morning and in the evening, as this went to and from work site at the estate of Hinterkaifeckers. One evening at 9 clock, as Plöckl went home again from work, this has been lit near Hinterkaifeck of a man person who was coming from a field out on him with a flashlight. This man person he did not know exactly, then without saying anything jump back into the field. How Plöckl told me that the form of this man person fits (LS). In its further transition Plöckl has made the perception that in the oven Hinterkaifeckers had to be a fire because he saw smoke rising. The smoke had an offensive odor in a way as if rags were burned. Plöckl has further told me that BEZW this evening. that night the inhabitants were killed by Kaifeck, at least this night was described by homicide than murder. I am convinced that (LS) burned that night in the oven his bloodstained clothes. "

A hearing Plöckls to clarify about the temporal variations in the testimony should not be done in 1931. However, at that time you had the opportunity, in Neuburg (telephone?) To make inquiries about the initial statement of Michael Plöckl.

Furthermore, there are, however, in the Munich document no notice.

It seems after all to be certain that Michael Plöckl has observed in the vicinity of the court or the oven a stranger with a flashlight or has certainly noticed the glow of a flashlight and a fire that has been burning in the oven. Probable likely dating to Saturday evening or at night be called as early as newspaper articles on April 8, 1922, which reflects also Pielmaier prosecutor in his report of 1926.

Testimony about the discovery of the bodies

(LS), (Auffindezeuge) 04/05/1922:
"... We went to all three of the house. While Poell and Sigl returned after Gröbern, I remained in the vicinity of the house Gabriel ...
Access in the living rooms and the whole house I have allowed anyone. I then thought to myself and the cattle fed this. After arrival of the police and the mayor Greger I have looked after nothing more. "

... "My trip I noticed no further. In contrast, the continuous Poell behind me shouted: "There's a foot." I replied: ". That would be nice," I quickly turned around and grabbed his foot and pulled him back and recognized that it was so.. Andreas Gruber had.

I looked at the place closer to u. Noticing that more people lying on the floor. I then noticed the other (s) n companions whether because these people are already dead and. Took 2 of them, namely the Gruber and Gabriel Cäzilie from the hay out. The latter I put about 1 1/2 meters to the left against the machine down. I had thought here is that the 2 1/2 years old Josef Gabriel, my son, could also be doing u. Might still be saved. After seeing that they gave no sign of life, I let the other people are u. Went through the stable transition in the apartment to look around for my son. "

Jacob Sigl, (Auffindezeuge) 10/01/1952:
"... S. sought in this space (Note .: bedrooms of Victoria G.) a candle and lit it up for his boys ..I would like to send advance that I Poell and the p immediately as we had found the bodies and he fumbled it, saying that he should leave so the things as they are. S. replied that he would see it exactly. Poell made him (p) due to his behavior at the crime scene to the accusation that he had killed the people in HK itself ...

S. now said that I ascend to the threshing floor and hay should throw down, so that the cattle could be fed immediately.

Poell and I have but no longer participated and told the p that we go home and report to the police report ...

S. made my request, to leave everything unchanged at the scene and also not to feed the cattle before the police arrived, no follow-up. He made himself very busy, went straight into the basement, took up milk and thus fed the pigs. On the way home I said Poell and nothing. It was noticeable in the case that p changes all that had to change, anywhere in the house just knew. S. came to my mind during the lifetime of Gruber not so much in the house in HK, that he could know more ...

Michael Poell, (Auffindezeuge) 04/05/1922:

"On Tuesday, 4.4.22 nachm. around 5 clock of the Bauer (LS) came to me in my habitation, in that Gabriel is stir nothing more. He then asked me to go with him to Gabriel. Jacob Sigl also joined us. And I notice that I have on the 1st and 3.4.22 the extraordinary silence is noticed in the home of Gabriel, esp. The local dog has not stirred to the conditions. Days I was busy in the fields near Gabriel.

Arrived at the home of Gabriel, we found all doors closed before, only for the nacelle leading gate was unlocked. From the power house, we then blew the barn door on & we went all three in the barn inside. Through the open barn door looked out a bark let loose. (LS) was preceded by & while at the stable door I saw him fall over something. I followed him immediately & tried with my feet on the ground, because it was a bit dark. . I shock it to something and then said to the two companions: "There is already something." (LS) then went back and picked up something I think first on a board and then attacked a freely visible foot... He pulled this out further & we realized it was the person of Andreas Gruber. We then saw another 3 persons below the hay. The girl was on the wall beside the stable door. He took it & put it slightly backward against the chopping machine in the barn. I & Sigl then immediately went out of the barn. But (LS) went through the stable transition in the living rooms & then opened our location on the east side of the house door. We then went into the house and also bedrooms. Found there the 2-year-old boy in cot killed before.

We then went into the kitchen & from there in the anstoßene (??) little room, where I saw a bed on the floor &. under the same 2 shoes sticking out. (LS) then the bed has lifted & now we noticed a strange female person slain lying dead on the ground.

The Hound of the Gabriel family was locked up in the stable. This is a good & alert dog. I am also not aware that he had not reported certain persons. It is not known to me that the family Gabriel would have been especially familiar with any of those.

The Gabriel family were generally considered hard-working, thrifty people, who lived a very retired life, in an economy they never came. I am also not aware that they had greater revenue lately. Whether they had any persons who were hostile to them, to me is also unknown.

Generally in places it is known that Gruber stood with his now murdered daughter Viktoria Gabriel in sexual relationship. As far as I know, (LS) had intended to marry Victoria G., moreover, he is the father of außerehel (??) Boy Joseph G. was. The marriage was, however, prevented by the old Gruber, the father of Viktoria Gabriel. That it lately so (LS) & Gruber were themselves hostile, I do not know. I am also aware that the family was wealthy Gabriel, but not how far.

A suspicion against a particular person, I can not tell & can not in this direction do not specify. "

Andreas Schwaiger, 17/12/1952:
"This (NB .: S., Poell and Sigl) are in fact come to the scene more than 10 minutes before me. It is therefore not possible that they have addressed the stall in front of me, or my arrival ... With S., Poell and Sigl I then proceeded and we came into the bedroom of the widow Gabriel ... A wallet was opened on the pillow ... "

Josef step Locher, 17/12/1952:
"How I still remember, I have the farmers and the farmers Jacob S. Sigl seen among the people ... Which door we then later entered the property, I can no longer say ... We have then, after we had looked at everything, leave the property ... "

Johann Freundl, 12/17/1952:
"The property was in HK when we arrived (NB .: With K. Stegmaier) only the farmer and peasant leader S. The property we entered through the front door and I do not remember exactly where we are met with p. S. then showed us the dead in the barn ...

Then S led us in maid's chamber, where the maid Maria Baumgartner was on the ground. He then led us into the bedroom and showed us the corpse of the little boy. While we went through the rooms, more and more people came into the yard and finally the mayor and the police chief of waiting ...

In the engine house, which was walled in the barn, there was a making eingesurtes meat. S. asked me to take away from the meat and something to eat ...

When we were out at the time of p through the rooms, he showed us in the bedroom an empty wallet. These lay on the bed in the middle of the blanket. It was closed ...

Furthermore, it occurred to me why the behavior of p on at the scene, because he let destroy curious of the existing tracks. I once made him even aware that people will destroy the traces. S. replied to me that the people were already there and now he could do nothing more. "

The Munich-based criminal investigation at the scene

The Criminal Division of the Munich Police Department was notified by phone on 05.04.1922 at 18.15 clock from the murder case Hinterkaifeck.

21.30 clock made themselves Detective Chief Inspector Reingruber, Criminal Inspector Georg Neuss, Sergeant Herman Kraus, the two police dog handler Sergeant Michael Bohlein, Sergeant Josef Scheringer with the tracking dogs "Argus" and "Flora", and Kriminalsekretar Andreas Biegleder from recognition service in a motor car from Munich to the way to Hinterkaifeck. In Leuschner film was reported that the police vans Directorate traveled to Schweitenkirchen because of a telephone transmission error first occurs after Hinterkaifeck at Waidhofen. So it came to late arrival in cheeks.

1:30 clock they met at the home of Mayor Greger in cheeks and were informed of this fact that the judicial commission has been studied in Schrobenhausen under the leadership of Johann Konrad Oberanmtsrichter Wießner the crime scene. Greger was still heard in the night in his house.

At 5:30 clock on 5/4/1922 make the police Munich police headquarters on his way to Hinterkaifeck. They drove the car only to Gröbern. From there they set out on foot on the road to Hinterkaifeck.

On property Hinterkaifeck they met once on the witness (LS). Initially, the police looked at the dead. They took the cross pimples (Aus: lolwut?) found by (LS) in the feeding trough in itself, so he could be examined forensic technically in Munich (later could no longer be determined with certainty whether it was used as a murder weapon).

Shortly thereafter, the Judicial Committee of the District Court Schrobenhausen met again, to see also the scene again. The Men prosecutors Renner and Hensolt by the district court Neuburg arrived at the scene. The police investigated the premises and the attic. The hidden in the attic bloody murder weapon, a so-called Reuthaue, they did not find, as were the band in 1923 found bloody iron and a rusty penknife undetected.

Kriminalsekretar Biegleder made to five scene images: two images from the barn with the corpses in different position (stacked and pulled apart), a picture of the maid's room with the dead maid Maria Baumgartner, an image of Victoria's bedroom with the bassinet of Joseph and a Hofbild.

Before noon the first witnesses were heard. First, the finding witnesses (LS), Michael Poell and Jacob Sigl were heard.

Then the witness Hans and Eduard Schirovski were interrogated, they could find coffee as representatives on 01/04/1922 at the property Hinterkaifeck no intake. In addition, the sister of the murdered maid, Franziska Schäfer was heard, Bernhard Gruber, the brother of the murdered Andreas Gruber, Cäzilia Starringer, the daughter of the murdered Cäzilia Gruber from his first marriage, and should make Josef Schrätzenstaller, the details of the means servant on Hinterkaifeck. The testimony of the sister of the murdered maid comprises only 16 typewritten lines, an example that the witnesses were heard only very superficially.

The tracking dogs searched the area of the property from without finding traces. The Munich police headquarters was already at about 15.00 clock back on the road to Gröbern from there drove them off to Munich. About 19.00 clock, they met again in Munich.

Thus it is clear that Detective Inspector Reingruber only on 04.05.1922 in the morning to 15.00 clock in the afternoon from 6:00 clock was at the scene. It is never returned there.

A crime scene sketch was not made, fingerprinting traces were also not secured.

The Munich police headquarters had never inspected the baptismal records, which has led to the age of the Cäzilia Gabriel was falsely decades always stated in all publications with 9 years. This was due to a false indication of the age Cäzilia by Mayor Greger under interrogation by 05/04/1922. This may later led again and again to speculation that Cäzilia the daughter of Karl Gabriel was not because this Viktoria Gabriel married until 1914.

On 06/04/1922 Detective Chief Inspector made Reingruber in Munich on a seven page report on the murder case Hinterkaifeck.

So the poor work of the top police officer in Munich at the scene was also the politeness was yet not too short, as a dated on 09th May 1922 Thank you letter from the officials Kollmer and Neuss proves to the mayor Greger:

"Dear Mr. Mayor, after we have meanwhile completed our work without however ceasing to spin out the other threads, we want after we are now provisionally back at home, do not miss you, my dear Mr. Mayor and your highly esteemed wife for your kind reception and catering our sincere thanks speak again.

You can be assured that we will never give your kindness, it was in their official, as well as a private nature, be forgotten and should it ever have the opportunity to show us gratitude by revenge, so we are of course all summon us to try our debts may be the same make.

For today you are now very much sincerely greeted with your family values and remain under excellentEsteem, Neuss / Kollmer "

The results of the autopsy

On 06.04.1922 the district court physician Dr. Johann Baptist Aumüller and the Legal Assistant Henry Ney arrived in Hinterkaifeck. A policeman was instructed by Dr. Aumüller unmount a door and put it on two wooden trestles on the farm.

There, one after the bodies were autopsied under the open sky.

On 06/04/1922 Dr. Aumüller obduzierte the bodies of Cäzilia Gruber, Viktoria Gabriel and Gabriel Cäzilia.

Cäzilia Gabriel

For the child, the lower jaw was shattered (source: phone message from the Munich Police Headquarters 07/04/1922)Dr. Aumüller explained in the section of the 11-year-old Viktoria Gabriel (In. He said Cäzilia Gabriel) that the child with timely discovery still could have been saved after a neck injury has been caused by the strike, the first 2-3 hours after the shock death brought about. (Source: Statement of Henry Ney from 19/01/1953)

The body has strong head injuries. The skull had been smashed with several blows. On the neck reveals a wide gaping, transverse wound. Besides the nose, on the right side of the face, there is a circular wound, her face is smeared with blood. In the cramped fingers of the right hand are tufts of hair, which is mentioned in several newspaper articles in the days after the crime were.

Cäzilia Gruber

The woman Gruber's face was also bruised in the area of the right eye. (Statement of Henry Ney from 20/03/1953)

Cäzilia Gruber had seven blows to the head, also Würgespuren, a further blow to the head in triangle shape. The skull was cracked. (Source: Munich Police Headquarters, telephone memo of 04/07/1922)

The maid Maria Baumgartner was killed by crosswise blows to the head. Her face was crusted with blood. (Source: inspection protocol senior judge Wießner from 05/04/1922)

Her head had a hole that was 4cm deep and blood-encrusted and probably resulted from a sharp hoe. (Source: Statement of Henry Ney from 20/03/1953)

J. Gruber

The lying in the bassinet J. Gruber was killed by a massive slap in the face, where the roof of the stroller (crib?) was destroyed. (Statement of Henry Ney from 20/03/1953)

Andreas Gruber

The right half of the face of the old gentleman Gruber was smashed. The cheek bones stood out, the flesh was torn, his face was caked with blood (statement of Henry Ney from 20/03/1953)

After the autopsy all the victims of the head was separated. Dr. Aumüller had visited shortly before a training course for district court physicians. There was taught that the heads of victims the best evidence must be provided that the murder weapon was not known. The victims were placed in coffins without heads.

sources:

There are far to the results of the autopsy in addition to the statements of Henry Ney from 1953 only a phone message from 04.07.1922 and a letter from the StA Renner from 04/10/1922 to his superior, the chief prosecutor at the District Court of Augsburg. In the phone message from 07.04.1922 there is a telephone conversation between the prosecutor at the LG Neuburg and the Munich Police Headquarters. In this telephone conversation StA Renner mentioned that signs of strangulation were present at the funeral of Cäzilia Gruber. Signs of strangulation on the corpse of Victoria Gabriel, he does not mention, though he also informs the results of the autopsy in a telephone conversation. In the letter dated 10.04.1922 StA shares with Renner that signs of strangulation were present at the funeral of Victoria Gabriel . signs of strangulation on the corpse of Cäzilia Gruber he does not mention. Thus, one can assume that StA Renner has made contradictory statements to the signs of strangulation. There can be no autopsy protocol does not provide the necessary reassurance notice at which female body now signs of strangulation were present.

In Leuschner-book 3rd ed. 2007, p 373, we read that Henry Ney had testified that signs of strangulation were been found only at the corpse of Victoria Gabriel. This must be a mistake, because Ney says about signs of strangulation from nothing.(Note. See also allmystery.de contribution ofkcefiak from 18.2.2008, 20.51 clock, see also contribution ofkcefiak from 19.2.2008 22.31 clock, see the article by @ grisu035 from 17.3.2008 4.48 clock, see the article bykcefiak from 30.3.2008, 21.07 clock)

According to § 87 II Code of Criminal Procedure, a dissection of two doctors is to be made, a doctor must be court physician or coroner. The six victims of Hinterkaifeck were, as far as hitherto known only autopsied by the court physician of the district court Neuburg, Dr. Johann Baptist Aumüller.

An autopsy protocol, as it should be actually made in the context of a forensic autopsy and shall be signed by the exporting doctors, is so far not available. Maybe it was destroyed during the fire of Justice building in Augsburg in 1944.

However, 1926 is not referred to an autopsy protocol, as StA Pielmaier prepared a summary report on the murder case Hinterkaifeck which is available from the State Archives of Augsburg.

The "Heuteppich" in the attic

On 04.05.1922, the Munich Police Department has visited together with the Judicial Committee of the District Court Schrobenhausen the memory that extends without firewall on the barn and the stable residential house. In Leuschner-book first ed. 1997 p.42 mentions that Reingruber have suddenly discovered that has been lying around on the floor boards familiar loose hay. He had pointed out that the perpetrators could go on as a carpet, without the residents could hear steps below. Reingruber is thus assumed that the scattering of hay belonged to preparation. The report of Georg Reingruber is in the Munich State Archives, however, not complete. There are only five to seven pages available. On these pages the "carpet" is also not mentioned, but possibly on the first four pages of the report, the Peter Leuschner 1997, however, probably still could see.

Testimony to "carpet" are, however, not before. Senior judge Wießner mentioned in the inspection protocol 04/05/1922 from the carpet also not, although he mentions the Heuseil and the displaced roof tiles regarding the search of the attic. Also prosecutor Pielmaier not mentioned in its report dated 11.06.1926 the laid hay.

In particular, Georg Kerner reported in his statement of 1951 nothing about the carpet, although he reports from all witnesses the most detail about the attic. In addition to the moorings in the hay even bacon rinds him noticed, which should have been in the vicinity of these places. Henry Ney, who has his reportedly visited the attic and even human excrement to have seen near the mooring sites, does not mention the carpet in his statement of 1952.

The presence of carpet was mentioned a few days after the fact, in this context, in Schrobenhausener weekly. Here it is stated:
"Because of several reasons, it is concluded that the murderers were already several days in the house. It was spread hay to muffle the sound of the steps, in two places was also located along the hay."

Interesting but this is a contribution of UserinTheresia. She has found that they had taken earlier that hay is spread over the whole attic, not a speck was entitled to remain free. The one I made for isolation, so that the stable rug could not sweat.

If the hay was then taken away, a thick layer of seeds, flowers and small parts remained back, which you then spread on bare patches on the lawn or used as a bath additive for the treatment of skin diseases.

The murder weapon (s)

According to current knowledge of the investigators, a 1922 discovered in the feeding trough pickaxe, a 1923 discovered during demolition work in the false ceiling of the house called Reuthaue and a 1923 in the hay (or straw?) Aufgefundenes pocket knives as murder weapons or possible murder weapons seem to have been discussed. Among the documents found during the demolition work (supposedly bloody) called. Hoop there is no documented assessment that this would have been regarded as a murder weapon.

1.) In the course of the investigation after the discovery of the offense was on 04/05/1922 ensured discovered in the manger of oxen pickaxe (see also Leuschner, 3rd Edition, p.42). Blutanhaftungen were not found what you trying to explain so that the pickaxe could have been licked by the cattle. Dr. Aumüller not seem to have viewed the pickaxe at least after the first three autopsied victims as a possible murder weapon (a note from Commissioner Reingruber following).

2.) was developed by Josef Gabriel (a brother of Charles Gabriel) in the context of demolition work on the estate Hinterkaifeck in the false ceiling of the house (in February 1923 discovered a bloodstained called Reuthaue next to the fireplace) and passed in the wake of the local police. About the detour of the district court Schrobenhausen the Reuthaue then passed to the police headquarters in Munich. In local forensic laboratory the Reuthaue has been (unsuccessful) examined (useful) fingerprints. Besides human hair blood of humans and animal hair were (probably a cat or a rabbit) detected. Whether the Reuthaue was also taken from Obduzenten Dr. Aumüller in inspection and this has reviewed its estimate of 1922 based on this Tatwerkzeuges or could clarify, is not known.

3.) When the demolition work was found in a barn (rusty) pocket knife, delivered to the local police and examined subsequently in Munich inconclusive Blutanhaftungen. According to the former Hinterkaifecker maid Kreszenz Rieger came this pocket knife from the possession of Andreas Gruber.

4.) Also in Stadel of Hinterkaifeck was found during demolition in 1923 allegedly bloody band iron. How get this band was iron (length, width, thickness, bent, rolled up?) Is not known. By whom the assessment was made "bloody" is also not known. There are no records showing that this band iron was ever investigated criminal technically.

(NB .: Possibly the hoop was not considered by the investigators due to its nature and the results of the autopsy as a possible murder weapon and therefore not further investigated. The estimate (the Auffinder?) That the hoop was bloody, possibly was not divided. But also, there are no findings.)

The investigation against the brothers Adolf and Anton Gump

Against Anton Gump an investigation was initiated on suspicion of complicity in the murder case Hinterkaifeck by the Public Prosecutor at the Regional Court of Augsburg yet in 1952. The prosecutor at that time Dr. Popp stated that Anton Gump had committed the offense together with his brother who died in 1944 Adolf Gump. The assumption was originally founded by an accusation raised by the sister of the Gumps, Kreszentia Mayer on his death bed against the priest Anton Hauber.

Attorney Dr. Popp is assumed that the born Karlskron in 1889 Korbflechter Adolf Gump had an intimate relationship with Viktoria Gabriel and that it is therefore between him and Andreas Gruber had come to jealousy, especially after the birth of little Joseph in 1919. This should have eventually led to the murder of six residents of Hinterkaifeck.

Adolf Gump had joined the Freikorps Oberland in the spring of 1919 and went with this, inter alia, to Upper Silesia.

When Opole district court against him and three other suspects a criminal case was pending, was in the accused to have murdered nine farmers in November 1921 after the uprisings in Upper Silesia and robbed. Gump had escaped in this criminal case, so that it can be assumed that in the spring of 1922 a search request under this criminal case has been submitted to the competent public prosecutor for his home district at the district court Neuburg.

Since Gump is born in Karlskron and is thus grew up near Waidhofen and Hinterkaifeck one can also assume that Reingruber has therefore asked, in the context of an arrest also Gumps alibi for the 30.03. and 31.03. to check.

By letter dated 04.09.1922, he calls the police stations in Karlskron and Schrobenhausen to search by Gump, because it is not inconceivable that he was also involved in the robbery and murder in Hinterkaifeck.

On 08/12/1926 Anton Gump was arrested in Emersacker tags and admitted it in the district court prison Wertingen. From there he was immediately transferred to the district court prison Donauwörth, where he was incarcerated until his trial before the district court in Regensburg.

In a letter obtained the gendarmerie station Emersacker is noted that Gump 1924 - 1926 was advertised in four Bavarian police to arrest leaves. On 21/10/1926 it came to a trial of Gump and his partner Magdalene Stampfl.

Anton Gump was acquitted of charges of wandering, because of "intellectual forgery" and fraud he was, however, sentenced to four months and three days in jail. His partner was sentenced for the same reasons even four months and 15 days in jail.

Henry Ney stated on 03/20/1953, Anton Gump was heard judicially also Hinterkaifeck, together with Attorney Renner he took part in the hearing itself, this had mentioned to him after the hearing: "This was nothing again."

Attorney Dr. Popp arranged yet in late 1951 and early 1952 in the investigation against Anton Gump on numerous interviews with witnesses, since much of the previous investigation file was burned in the murder case Hinterkaifeck. As part of this investigation, many farmers were again heard from the neighborhood Gröberner to clarify whether Viktoria Gabriel had entertained in the years before the fact, an intimate relationship with the basket weavers Adolf Gump. However, this was not supported by any testimony.

The witness Jakob Sigl loaded on the other hand in his statement from 01/10/1952 massively then already deceased farmers (LS).

As Attorney Popp could not submit this statement of Sigl in investigation against Gump, he applied for a further judicial examination of the witness Sigl. Previously, he featured in the police interrogation protocol of 1952 all incriminating statements to (LS) and asked the judge to cite the protocol without these labeled data. This incriminating details carriage builder were not included on the judicial examination protocol.

At the conclusion of the investigation, then an arrest warrant against Anton Gump was issued on 05.06.1952 and he was taken to the JVA Augsburg 2. On 29/05/1952 Anton Gump was released from custody. The reason for the release from prison, the 20-year statute of limitations for murder then in force was specified. In addition, could not demonstrate that the limitation period was interrupted by a judicial determination.

Through the subsequent reporting in many print media, the Anton Gump stamped as a murderer who escaped only by prescription his alleged justice, Gump's reputation was severely damaged. In addition, it was found later questioning other witnesses, that Kreszentia Mayer, who had accused her two brothers on her deathbed fact, it would not have taken in the past with the truth so often exactly.

The investigation against Anton Gump was finally set at the final 22.02.1954 by pointing to the limitation period by order of the chief prosecutor Dr. Mr. Reiter.

The missing statement by Pastor Haas

Peter Leuschner writes on page 7/8 in "The murder case Hinterkaifeck" (3rd edition): "Mysterious as the murder itself are also the files. For example, since missing the testimony of the former parish priest. In a later applied the alphabetical name directory it says under "H" in a tiny handwritten pencil note: "Pastor Haas missing in Waidhofen !! Vol. III / 1061st "The Name" in 1061 to close "after, it was only a sheet. But what was it? Or should the local priest not to have been heard right? "

Leuschner subject here is obviously a mistake. The said register tape, all three sub-volumes of the Munich records underlying the missing page 1061 not. This register tape all aufscheinenden in the files witnesses and suspects are listed by name with the corresponding references. One last Beiheftung to band III is dated 22 February 1941. 1952 index volume was issued temporarily to Augsburg. In the meantime, this register may have been manufactured by an unknown agent.

Pastor Haas has been overlooked apparently by this agent, was added later by hand later: "Pastor Haas in Waidhofenmissing !!". Referenced with "S. 1061 "but not on a statement of Haas, but on the interrogation of teacher Hans Yblagger of 19 February 1931 was active in Waidhofen October 1922 to October 1927. There we read: "Of course, I also talked with Pastor Haas often about the murder case. There are there but our opinions about the perpetrator parted. While Pastor Haas always held the Gütler Kaspar for the verdächtigeren, I was of the opinion that (LS) would be more suspicious. "

Another (in the index volume also subsequently unregistered) mention of Father Haas found in the transcript of the interrogation of Wenzeslaus Bley from 08.08.1930. Bley refers back to Yblagger. Haas should have told this, that he "had sent for his suffering after Wörishofen" (LS).

An indirect indication of a possible interrogation by Father Haas could provide the report of Inspector Xaver Meiendres from 08.12.1948. Meiendres is clear, however, that he had written the report (26 years after the fact) from memory and without him present document. Pastor Haas is mentioned in this report in connection with the "700 marks in gold," which had been kept "about 14 days before the fact" in the confessional of the parish church of Waidhofen. The priest, "who knew the financial situation of his parishioners was pretty much convinced that only a member of the Gruber family of Hinterkaifeck could have put the money in the confessional." He had then ordered Viktoria Gabriel in his rectory.

If Haas - especially to the 700 gold mark in the confessional - should have been heard, then this should probably be done as early as 1922. A corresponding transcript exists obviously not (any longer) and is possibly burned with the files of the prosecutor Neuburger 1944 in Augsburg.

Surviving photos of Hinterkaifeck or residents

No Photographs have been found - by the former residents of HK so far - with the exception of the here shown in the'Fotogalerie' Karl Gabriel. By late April 2008 until the time of honor is now established that at least must have existed a photo of the church choir of Waidhofen, was mapped to the Viktoria Gabriel. Also, this photo is (yet) not before. That a wedding photo of Victoria and Charles Gabriel has existed, it is believed, but not guaranteed.

From HK property there seems to be two shots: A shot (here in the'Fotogalerie' and Leuschner, 3rd edition, p.291) has been made on 04.05.1922 as part of the police investigation. Another shot of unknown ownership, which would some time ago (during the lifetime of the residents) have originated, was with the photo of the six coffins in a report by the magazine "world view" ready.

2008, from Allmystery users'hauinolo' a class photo from 1921 are taught that the student (several ages) shows the elementary school Waidhofen. Identification of Cecilia Gabriel is not yet succeeded.

The murder case of Profiler view

Klaus Wiest, Chief Commissioner of the Department of "Operative case analysis for homicide and sexual offenses" at the Munich Police Headquarters is what is called a "profiler" modeled after the American FBI. Based on the crime scene and all available results of investigations he tries to create personality profiles of offenders. 2005 Klaus Wiest is driven to Konrad Müller and talked with his colleagues for an afternoon on Hinterkaifeck. Together they have rolled files, and Wiest has composes the so far last official paper. "Everything points to personal motives go," Wiest stated in the opinion. It must "have been tension in the immediate social environment," an "emotional conflict between perpetrators and victims".

Well. That was a bit of a task. Wish I'd paid more (any) attention in German class at school! If there's anyone fluent in the language willing to take on the task of interpreting some portions that are a bit tangled, please feel free to speak up!!!! I'm particularly interested in the parts concerning LS and the discovery of the murders.

Untangling the grammar as it is, things do not bode well for our pal LS. He had motive and opportunity. He inserted himself well and truly into the crime scene, and as far as I can tell went about disturbing everything he possibly could. Note how, despite the antagonism with the family and the 'illegitimate' status of Viktorie's little boy, he claims the child as "my son" at the crime scene. He acts as a tour guide, offers people food, orders people about and does exactly what he's told them not to do (if I have the translation right, so that bit is pending). Very suspicious. His interference and desire to be in charge after finding the bodies etc, reminds me of the son in law from a somewhat similar 'murder mystery' here, the Gatton murders. Whom I also suspect..

It should be noted that LS was the "bigwig" of the area, not quite a mayor? But at that level of leadership, kind of. As the man of influence, he may have had the clout to make himself less tasty as a suspect with local and imported police, as well as the clout to make an accusation of incest and have it stick. I dunno about the incest thing... I mean it could be true? But then, look at the sources. A disgruntled ex maid, and LS claim direct knowledge/observation. The rest are repeating hearsay, or saying the proof of incest is in the arrest they witnessed. Idk... will look at all a bit more closely soon.

It seems the bodies were already covered up when the three neighbours (including LS) first investigated, which to modern profilers suggests "undoing" ie, familiarity with the victims. Also, the wounds were almost all concentrated on the heads of the victims, but Viktorie and her mother also showed signs of strangulation, and Viktorie suffered a great deal of damage to her face. Once again, this points to familiarity, and the overkill as well.

I'm a bit stumped as to the killer living there for a couple of days. But I have seen crimes where killers have done this. IMO it's done out of a profound desire for "ownership" of the scene, some kind of deep fantasy of being in total control. Think about that, then look at the behaviour of LS in the aftermath..

I'm sure I'll find a lot more to say once I've parsed the rest of the info. But so far, I'm thinking LS is good for these murders....

better grammar..making better sense of some parts of the previous posts...:guitar:

Gruber in particular is described as a brutish, sullen loner. He is said to have beaten and mistreated his children, of whom only Viktoria survived.

His daughter Viktoria was a popular member of the church choir, known for her beautiful voice. It was common knowledge that Gruber had an incestuous relationship with his daughter (something which, while illegal, was not infrequent in rural areas at the time), and actively prevented her from marrying again. His wife apparently suffered from the knowledge, but did little to stop things. A schoolmate of young Cäzilia´s reported in 1984 that Cäzilia was reproached for falling asleep in school on the 31st and related that the night before, there had been a severe argument in the family and her grandmother had stormed out of the house wanting to kill herself. They had searched for her for hours. (Earlier, in 1951, the same witness had stated that it had been Viktoria who they had searched for).

Some weeks before the fatal night, Viktoria had withdrawn all her money from her bank account and borrowed some from her half-sister (Gruber was Cäzilia´s second husband), to invest in the farm. A donation of 700 goldmark was left in the confessional of the church. The priest traced it to Viktoria, and she told him it was “for missionary work”.

(there's an interesting summary of LS' behaviour at the end of this article, including that LS had remarried by that point. His first child with his new wife had died and been buried only a few days before the murder. ... very worth a read)

.. what Pomeranians used to look like:

ellen.jpg

Toy/dwarf versions of the Pom were popular in Germany by the early 1900's, but the larger spitz (aka american eskimo dogs... or larger, keeshond types) were likely of better use to a farm. They were notoriously barky and snappish (as was the Gruber's dog) and being bred for work as watch-dogs, they were generally good at their job. I have a 3-month old puppy that's only part-bred Pom and the dear little monste.. um, sweet thing... loves nothing better than climbing to the top of the sofa when nobody's looking, and yapping her head off at anything that moves outside the window. She barks at suspicious things - open cupboards, plastic bags, brassieres. In short, anything she has never seen before in all her long 3 months life. Ie, just about *everything*.

My point being, I wonder how a stranger could creep about in the snow or around the attic making noises, etc, without Gruber's notoriously cranky Pomeranian turning itself inside out with barking.

The majority of people are right handed, and the majority of assaults are frontal. Wounds received during an assault tend to be clustered on the left side of the body.
http://www.forensicmed.co.uk/wounds/sharp-force-trauma/patterns-of-sharp-force-trauma/

--- Looking at the (vastly underwhelming) autopsy report, it's plain that nearly all the wounds are to the heads of the victims, made with with what is probably a chopping instrument (exhibiting both blunt force and sharp force injuries) and that they're pretty much all on the right side of each victim. I have to assume that the killer was facing at least some of the victims, as they have facial injuries. So--- was this killer left handed? A person holding a pickaxe type weapon in their left hand and attacking front-on might leave a majority of injuries on the right side of the victim. That most of the victims have right-side injuries makes this more likely, IMO.

Chop Wound
A wound caused by a heavy weapon or instrument with at least one sharp cutting edge—e.g., axe, machete, panga; often the wound has abraded margins—which may be scraped off—and may be thus confused with a laceration; chop wounds over bone may have a groove or cut in the underlying bone—e.g., skull
-- Segen's Medical Dictionary

The pattern of homicidal slash/chop injuries..
..the majority of the victims .. had more than five wounds. In contrast, the victims in other categories had less than five wounds each, with the exception of a single case in the psychiatric-homicide group. In homicide victims with a single wound, the most common site of injury was the neck. In those with multiple wounds, the common sites were the head and neck.

I have the impression that someone wanted to terrorise, control and ultimately destroy this family. The evidence of someone probably *living* in the house for weeks before the murders aligns with the fact that the killer appears to have *stayed* in the home for possibly days after the crime. In turn, this suggests to me (whether the killer in fact did all this, or it was made to look so..) a desire to enjoy a sense of total control over the situation, and the victims concerned.

I'm not seeing much in the way of overt sexual motive, which is strange where obvious signs of stalking exist. The killer, however, experienced a deep rage, and the wounds almost exclusively to the face/head of the victims suggests personation - that the killer wanted *these particular* people dead, rather than anyone else.

The covering of the bodies is also of interest to me... tghere seems to be a couple of different levels to it. It's almost as if there were several crimes in one here... the murder of Viktorie and her daughter (and, possibly Cazillia Gruber), the murder of Andreas Gruber, and the murders of little Joseph and the maid.

Cazillia Gabriel (daughter Viktoria Gruber): lower jaw shattered, cervical injury due to shock, severe head injuries. Skull was smashed with several blows and her neck revealed a wide gaping, transverse wound. On the right of her face was a circular wound. Her face was smeared with blood. In her cramped right hand fingers were hair pieces.

Cazillia Gruber (wife of Andreas Gruber): bruising near the right eye, seven blows to her head, one in triangular shape. Signs of strangulation, skull cracked.

Viktoria Gabriel (mother of Cazillia and Josef): nine “star-shaped” wounds to the head, strangulation marks on the neck, right side of the face smashed with a blunt object. A small round injury of a pointed tool on the upper skull. Smashed skull.

-- Both adult women are observed to have strangulation marks. All three have facial injuries and multiple head wounds. Some of these wounds are small and circular, as might be caused by the pointed end of a pick-axe type weapon.

-- Only Viktorie and her daughter were still wearing their day clothes. All other victims were in night clothes. This might suggest that these were first victims, lured or found out of the house, and were murdered while the rest of the household prepared for bed.

-- Only the younger Cazillia appears to have survived the initial attack for any length of time. She is also the only victim to have her throat cut.

Maria Baumgartner (maid): killed by crosswise blows to the head, face crusted with blood, one head wound was 4cm deep and blood-encrusted probably resulted from a sharp hoe.
Josef Gruber (son Viktoria Gruber): killed by a heavy blow in the face, top of the bassinet stroller destroyed.

-- Marie and Josef were killed in the house, likely as they slept.
-- Both bodies are 'hidden', Marie under the bed/mattress and Josef under the bassinette hood and a skirt belonging to his mother.
-- It's very possible that they were the first to bed, Josef being an infant and Maria tired after travelling and settling into her new home and duties.
-- It's interesting that the killer bothered to hide any of the bodies at all. But of particular interest is that little Josef was killed *through* the hood of his bassinette and then covered up. As if the killer felt shame over the murder of the small child, in particular and perhaps did not want to view the baby's death.

-- Marie showed no signs of strangulation, though she shared the single deep wound/multiple blunt force traumas of the other three ((related) females. After four victims with roughly the same pattern of head wounds, it starts to look a preferential mode of killing.

Andreas Gruber (husband Cazillia Gruber): right half of the face smashed, cheek bones protruding, flesh seemed shredded, face caked with blood.

-- The sole adult male does not have the distinctive pattern of skull wounds shared by all four females, though the focus of injury is still the head/face. The obliteration of his face seems like clear personation, rather than being merely functional.

I'm so all over this case like white on rice... I do get a bit fixated on these very cold cases. This one's just so interesting! I have a lot more blathering to do. But duty calls. :(

... i wonder if the date is a coincidence.

That old timey language made my head hurt. Was the incestous relationship consensual? Did Andreas kill his other kids? How many did he have and how old were they when they died?

Just to repeat my take on the incest:

I dunno about the incest thing... I mean it could be true? But then, look at the sources. A disgruntled ex maid, and LS (a prime suspect with a history of antagonism toward the family) claim direct knowledge/observation. The rest are repeating hearsay, or saying the proof of incest is in the arrest they witnessed.

So I have my doubts that the incest happened at all.

Interestingly, in the case I mentioned earlier as quite similar in some ways, there were rumours of incest floating about, also. Obviously here, there's charges to back up the claim. But then, if LS was behind it all, and I reckon he might have been, having power and influence in the area might have helped those charges get pushed along in court - who's going to argue with witness testimony from him?

I forget/dunno about other kids.. will look it up, when I have time. Nice to see you on this one, scriptgirl.

Ausgirl, I have missed you. You, me and Kline are homies. Anyhoo, this is one ****ed up case. Why didn't that family go when they saw the footprints and realized there was someone in the attic?

 awh, SG, missed you too. Nice to see Kline around again, eh?

I reckon they didn't leave, as that was their home. And maybe being a farm, they could expect the odd hobo to wander through. It used to happen to a lot of farms here in the old days, I know that...

I actually suspect the whole "haunted" thing.. something's just not right with that. I mean, clearly it wasn't haunted.. but the maid leaving, just in time to avoid the slaughter, claiming "haunted".. and she's one claiming also that there was incest... idk, I'm inclined to eyeball her atm.

Something has bothered me with the crime scene photos since I first saw them on a "creepypasta" site a few years ago. Looking at photos 3 and 4, showing the victims in a barn-two photos, three different victims, but all in the same location? in photo 3 a single body is shown in a pile of hay. In photo 4, two bodies are shown on the same pile of hay. How does that happen? Were the bodies posed for the crime photos?

Just wondering.

Hi shadowangel.

From what I understand, the bodies of Gruber, Cazilia and Viktorie were stacked one atop the other by the killer.

From the OP: The neighbours who had found the bodies, had fed the animals, moved the bodies (Although they were hidden under straw and an old door, when discovered)

So my thought is, the pics are recording a police re-creation of the 'body pile'.

Unless I missed something, I find it odd that the family and/or others heard noises in the attic before/after the murders, yet no one went up there to investigate the source. Maybe it was assumed to be squirrels or rats, which can make an awful racket once they get inside a closed indoor space?

That same night, Andreas was awoken by strange, inexplicable noises coming from the attic. Remembering what the maid had said about ghosts and the noises from the attic, he checked there too, but found nobody hiding there. With apparently nobody hiding on the property and no footprints leading back out into the woods, it seemed like the trespasser had simply vanished. Satisfied that no one was there yet still a bit unsettled, Andreas went to bed only to wake up the next morning to find a strange newspaper on his porch that no one in the family recognized. Not long after that, on March 30th, 1922, a set of keys to the house mysteriously disappeared and could not be found anywhere. In his search for the keys, Andreas came upon the disturbing discovery of scratches on the lock to the tool shed, as if someone had tried to pick it.
