Max Hadley, who the court recently appointed to be Kitchen's mitigation specialist, confirmed that Kitchen had voluntarily surrendered her bond in an effort to "take responsibility."

Hadley said Kitchen made the decision to voluntarily surrender her bond.

“She decided she was going to do what she has wanted to do all along, which was take responsibility for this and start serving her time now,” Hadley said. “Her lawyers never would let her talk about this case or take responsibility because they felt the case could be litigated, so she was never able to do this because her lawyers advised against it.”

“She’s waiting to be sentenced and will accept whatever that sentence is,” Hadley said.

Double-manslaughter suspect Marcia “Marci” Kitchen wore a blue jail jumpsuit this morning during a planned hearing on whether she should be incarcerated until her sentencing.

Kitchen, 41, turned herself in Monday and was booked into Humboldt County Correctional Facility. Today she was in court for about two minutes, looking tearful and almost panicky.

Protesters at today’s hearing demand justice...

It’s a wide range of emotion we’re all here for justice trying to the same thing and to make sure that justice is served for these little girls,” said Veronica Walin of Rio Dell, adding that her daughter was friends with Kiya Kitchen. “They were killed. We can’t save them, we can’t bring them back, but we can make sure the person who did it is punished rightfully or at least try.”

The protesters, who were on hand when Kitchen entered her guilty plea as well, said they were concerned that Kitchen will receive a lenient sentence.

“It’s important she gets more time and by not giving her a max sentence it’s showing our kids that they don’t matter, Walin said. “It’s important that he [Cockrum] thinks about all these things. He mentioned giving her limited time and that sent our whole community off.”

The mid term cap of two years of agreed as part of the conditional plea does not apply to all counts and special allegations. If the Judge decides to sentence her to the maximum, Marci Kitchen can refuse the plea deal and the case can proceed to a jury trial.

That's totally not right. She should not be able to change her plea if she doesn't like the sentence. I guess this is only allowed because it wasn't a plea deal offered by prosecutors... but I still don't think it's right.

Well, then that SHOULD mean that regardless of what the judge decides her sentence is she will accept it. No backing out of her guilty plea because she doesn't like the sentence. If she backs out then we will know she never wanted to accept responsibility, just wanted to manipulate the system for lesser punishment.

Say what? It's her lawyers' fault she never took any responsibility for her actions until now? Did they tell her to lie and try to hide her Jeep? Did they suggest she should try to get her son to lie for her? Was she bereft during those little out of state jaunts she took instead of owning up to what she did?

I call BS. IMO it's an attempt to backpedal and rewrite history in order to get a lighter sentence. It sure as hell isn't her conscience telling her to do what's right. Throw the book at her. MOO.

Well said! The mitigation specialist is working overtime to get a reduced sentence and is regurgitating whatever Marci feeds him. They are spinning the “poor Marci” up against “mean lawyers” story so fast it makes me dizzy. Of course, those attorneys both quit, and I guess it could have been because Marci stopped wanting to cooperate, rather than running out of money. Nah, I didn’t think so.
 
I’m new to this awful case. Is it known if she intentionally targeted her daughter & friend, or just an awful irony that she was DUI and happened to victimize her own child?

Either way, this is just a horrible case.

Believe me, the thought of a deliberate, angry “I’ve told you a thousand times not to skateboard in the road” attempt to scare them that ended tragically has crossed my mind. But if that was the case, and could be proved, the charge would be murder. I’m still in shock that she hid her truck and tried to get her son to lie. That alone led me to wonder if it was even remotely deliberate.
 
I hope MsMarple doesn't mind my expansion of her answer, but...

The kids were skateboarding on a straight open stretch of road in daylight when drunken Marci ran into them. She then abandoned her dying daughter, and the daughter's friend, to flee for home, hide her Jeep, and pressure her son to lie for her. No 911 call, no attempt to return and render aid, nothing except a frantic coverup. She has since spent two years dodging responsibility for her crime. She needs a good long spell in a cell to think it on it.

If the details I added to MsMarple's reply all seem bad, that's because there are no good details in this case. If you have a strong stomach, Flute, you can read all the bad details from the beginning. You might want to hold your nose while you read, though....
 
Sentencing at long last...unless the judge sentences her to the max and Marci refuses the plea deal and decides to go to trial. Stay tuned tomorrow morning, Tuesday September 18 at 8:30 a.m.
