Emotions run high as Boise mass stabbing suspect appears in court

BOISE - Grisly details in an Ada County courtroom Wednesday morning about a stabbing rampage that took place at a Boise apartment complex June 30th -- in which a three-year-old girl was murdered and eight others injured.

The accused -– Timmy Kinner -– appeared before a judge … who read off the thirteen charges against him.

Security was heavy at Wednesday morning’s hearing. Over a half-dozen bailiffs and deputies surrounded Kinner as the charges were read.

Judge Nancy Baskin did not allow TV video cameras in the courtroom … only allowing still photos to be taken.

The documents also say Kinner allegedly stabbed a two-year-old … causing lacerations to her stomach, liver and pancreas.

Boise mass stabbing suspect will stand trial in January; judge wants jury pool of 300

Timmy Earl Kinner Jr. opted to “stand silent” Tuesday morning at his plea hearing on multiple charges, including murder and aggravated battery, at the Ada County Courthouse in Boise.

Fourth District Court Judge Nancy Baskin entered “not guilty” pleas to the charges against Kinner and set a trial date for January. Jury selection for the trial, anticipated to take eight weeks, will begin Jan. 3.

Ada County prosecutors have not said whether they will seek the death penalty. They have 60 days from Tuesday to determine that.

The 30-year-old man accused of stabbing nine people in Boise will receive a mental competency evaluation, and access to the defendant by police and other authorities has been restricted until after that examination has been done.

A hearing will be held to determine Kinner’s competency to proceed after the mental evaluation is done. If he is found to be unable to assist in his own defense, he will be sent to one of the state hospitals for treatment. The judge will then later decide if he has improved enough to continue.

Attorney: Boise mass stabbing suspect needs to be committed to state hospital


Defense attorneys representing the man accused of stabbing nine refugees in Boise say he needs to be committed to a state hospital for mental health treatment.

Efforts to complete a court-ordered mental health evaluation of Timmy Earl Kinner Jr., 30, have stalled, according to prosecutors and defense attorneys handling the case.

Fourth District Court Judge Nancy Baskin did not order Kinner to be committed to a hospital. Instead, she said both sides must agree on a psychiatrist who will help determine if Kinner needs mental health treatment before his court proceedings can move forward.

A new status hearing on Kinner’s mental competency evaluation is set for Oct. 23.

Baskin ordered a mental competency evaluation at Kinner’s last court appearance on Sept. 5. But prosecutors said in court on Friday that Kinner hasn’t cooperated with the psychologist who is attempting to complete the assessment.

However, Deputy Prosecutor Tessie Buttram said the psychologist has not found evidence that Kinner needs psychiatric treatment. She raised doubts about whether Kinner had any serious mental health issues, suggesting that his lack of cooperation might but due to malingering, or faking illness, rather than due to any actual illness or defect.

Prosecutor’s have not said whether they will seek the death penalty. They have until late October to file their intent (60 days from Kinner’s entry of plea on Aug. 28).

Timmy Earl Kinner Jr. seems eager to communicate — but not with the psychologist assigned to evaluate his fitness to stand trial for allegedly stabbing nine Boise refugees in June, including a 3-year-old who later died.

Kinner has mailed two more letters to prosecutors, bringing the total to three, according to court records. He refused to meet with a psychologist twice this week.

Fourth District Court Judge Nancy Baskin has decided to review those letters — not yet seen by defense attorneys or prosecutors — to determine if they could be useful for the mental competency evaluation of Kinner.

The judge said that if Kinner won’t go voluntarily to the conference room, jail staff may use up to the same level of force that’s used to bring a defendant to a court appearance.

Baskin also closed next month’s competency hearing to the public, except to victims, victim-witness coordinators and an investigator. Kinner will appear in court Dec. 13 at a hearing to determine whether he’s mentally fit to stand trial.

On Thursday, Baskin agreed to a defense motion to close that hearing to the public due to the “highly personal” medical information that will likely be shared.

From the article, it sounds like Kinner is still refusing to meet with the psychiatrist who is supposed to file a report on his mental competency.

The judge reminded prosecutors and the defense that she previously ordered the psychiatrist to file the assessment of Kinner on or by Nov. 29. She ordered them to set up a conference call with the psychiatrist to discuss the deadline for filing the report.
