If I am understanding what I’m reading correctly about Idaho law, it requires a life sentence for 1st degree murder but does allow the judge to determine if it is without parole and if not then it must be a minimum of 10 years before eligibility for parole or credit etc. She was just convicted of two 1st degree murders and while I still think this judge will give LWOP, he must at a minimum give a life sentence with no parole possibility for at least 10 years on each count so that’s 20 before she is sentenced on the conspiracy charges and the grand theft charges. I think she could also get a life sentence for the conspiracy to murder TD so that would throw in another minimum of 10. These are minimums if she doesn’t get LWOP. But she killed her two children - one of whom was very young and had special needs. There may be an even higher minimum for JJ’s murder because of that. Some states do but I’m not sure about Idaho. Also, at least JJ’s murder could be considered torture as he struggled for his lI’ve and I’m pretty sure Idaho statute calls for LWOP for 1st degree murder of a child when it involves torture. Either way, I don’t think the judge is going to let LVD off lightly for killing her own children. I think LWOP for Tylee and again for JJ to run consecutively and perhaps another LWOP or at least life with eligibility in 10 yrs for the conspiracy to kill TD. I have no idea what the penalty for the grand theft is but with or without it I do not expect LVD to ever see freedom again.I don't think she'll get LWOP. I'm thinking more like 20 years.
Arizona will want to try her. They don't want her to go free if she successfully appeals the Idaho conviction. I think there is only a small chance that happens but Arizona won't take that chance!
