25-year-old Brodey I. Murbarger had a pre-trial conference yesterday in Wayne County Circuit Court. Murbarger, his attorney Christian J. Baril, and Wayne County State’s Attorney Kevin Kakac appeared before Judge Tom Dinn via Zoom. Another pre-trial conference was scheduled for January 25th at 10:30 a.m., where Baril is expected to present a motion to allow Murbarger access to a computer or similar electronic device. He also indicated he would have a second motion related to bond, though he did not enumerate yesterday what that motion might be. Judge Michael Molt denied a motion in December to reduce Murbarger’s $300,000 cash bond.

Baril, had filed a motion to allow him access to a computer or electronic device to review discovery materials for the case. State’s Attorney Kevin Kakac argued against the motion, saying the jail isn’t set to up store any such device or discs or provide a private room for a defendant to use them. Judge Michael Molt noted the uniqueness of the case and eventually granted the motion- but with restrictions. He said the device would have to be brand-new, and it would have to be examined by an IT specialist to ensure it only had software to allow for the reading and viewing of discovery materials and could not, for instance, access the Internet or communicate with any other device. He also said Sheriff Mike Everett and jail staff would be responsible for determining a reasonable time limit for Murbarger to access the device.

Murbarger’s attorney filed the motion last week asking the court to allow his client access to either a computer or electronic tablet while he remains in the Wayne County Jail. The judge on Monday granted the motion but ordered the device be wiped clean, have no other software installed other than needed for viewing of discovery in the case and that no one other than Murbarger be allowed to view that discovery. The Wayne County sheriff will set the hours the defendant will have access to the device.

25-year-old Brodey I. Murbarger appeared in Wayne County Circuit Court via Zoom yesterday afternoon for a status hearing. The short meeting consisted almost entirely of an order from Judge Michael Molt to Murbarger’s attorney, Christian J. Baril. In the last hearing in the case in late January, Judge Molt granted a motion that would allow Murbarger access to a computer or electronic device to review discovery material for the case. In that order, he noted the device would need to be brand-new and examined by an IT specialist to ensure it only had software to allow for the review of discovery material and no other capabilities, like Internet access. The judge noted said requirements had been met, but Baril would need to file a motion with the computer’s make, model, and serial number so the Sheriff’s Office could identify it. Baril indicated he would do so yesterday, and he hoped to bring the computer to the jail in the next day or two.

Baril also clarified that he will be burning CDs or DVDs of discovery material after redacting necessary information from the originals, and he will deliver those items to the jail staff for Murbarger’s use. No future court date was set.

Murbarger remains housed in the Wayne County Jail on $300,000 cash bond. He faces three counts of first-degree murder, one count of concealment of a homicidal death, and two counts of home invasion in connection to the death of Megan Nichols.

Murbarger has now been incarcerated for 7 months since October 7th, as he reviews all pertinent discovery material.

Would the next step be a trial with presented evidence? How long before we can expect it to start? Suicide cases are quite common in Illinois prisons.

25-year-old Brodey I. Murbarger appeared in a status hearing in Wayne County Circuit Court this morning. His attorney and the prosecution agreed to meet in private to discuss the scheduling of a jury trial, as the county is once again able to schedule them because of declining COVID numbers. They will advise the court of their progress in a later meeting, and another pre-trial conference was scheduled for June 29th at 9 a.m. at the Wayne County Courthouse.

WAYNE COUNTY, IL —

The county will return to scheduling jury trials Tuesday (June 1st), so the hearing will allow his defense and the prosecution to discuss the possibility of setting a trial date. No new evidence or motion outside of scheduling a jury trial is anticipated. The case saw little movement during the coronavirus pandemic but the county did provide the defendant with an electronic tablet to allow him to view discovery in the case.

His attorney, Christian J. Baril, told Judge Michael Molt and State’s Attorney Kevin Kakac the review of discovery materials is going well. He has met with Murbarger in person a couple of times since a specialized computer for the sole purpose of allowing Murbarger to view discovery arrived at the jail last month, but he said they have quite the volume of material to wade through.

Wayne County is once again scheduling jury trials, and Baril and Kakac agreed to meet privately to discuss scheduling a trial, then advise the court. Judge Molt said the county generally holds jury trials on the first and third Mondays of a month, and the next several months are pretty open for the county. The court then set another pre-trial conference for June 29th at 9 am, and, barring a compelling reason against, that meeting will be held in person at the courthouse.

He was set to appear today at 9, but, by agreement, the meeting has been moved to September 7th at 2 pm. The last meeting in the case was held via Zoom and lasted about five minutes; State’s Attorney Kevin Kakac and Defense Attorney Christian J. Baril said they had spoken about a trial date at that time, and the next conference was set with the intent of having a more concrete idea of a trial date. MURBARGER PRE-TRIAL CONFERENCE

25-year-old Brodey I. Murbarger appeared in Wayne County Circuit Court Tuesday for a pre-trial conference. His attorney, Christian J. Baril, filed a motion last week for bond reduction, his second such motion. His arguments were largely the same, saying Murbarger is neither a flight risk nor a danger to the community. He said Murbarger is innocent until proven guilty, and it is a dangerous road to presume guilt for allegations. He asked for a reduction of bond to $10,000 cash from the current $300,000 cash, and he also indicated Murbarger would pay for a GPS ankle-monitor with his own funds in order to have a chance at release.

Illinois Assistant Attorney General Myra Yelle-Clark argued that the only thing that has changed since Judge Michael Molt denied bond in December 2020 was that a court date has been set.

Judge Molt respectfully denied the bond-reduction motion, saying he has a duty to protect the public, and the charges and nature of the case are such that he felt he would not be doing his duty to reduce bond.

State’s Attorney Kakac and Assistant Attorney General Yelle-Clark worked with Baril to set another pre-trial conference for December 7th at 2 pm, and Baril then requested Murbarger be allowed to visit his family in-person at the courthouse for a brief time. Judge Molt granted that request, under the supervision of court security.

Murbarger remains housed in the Wayne County Jail on three counts of first-degree murder, one count of concealment of a homicidal death, and two counts of home invasion.

MURBARGER TRIAL DELAYED

The jury trial for 25-year-old Brodey I. Murbarger has been continued to May 2nd in Wayne County Circuit Court. Appearing via Zoom Tuesday, Defense Attorney Christian J. Baril said he made the motion due to responsibilities he had due to a death in his family. The State, including Assistant Attorneys General Michael Falagario and Myra Yelle-Clark and State’s Attorney Kevin Kakac, had no objections to the change. Judge Michael Molt granted the motion to continue to trial and said the speedy-trial calendar had been tolled until further notice from the court, as pandemic-related issues have already pushed the trial past its time.

Falagario said he had no issues with the delay due to his and Yelle-Clark’s coming on late, and they were still working on discovery. She further indicated she would prefer to touch base monthly for conferences. The court set another pre-trial conference for January 11th at 9:30, and the final one will be April 26th at 9:30. Additional conferences in the interim may be scheduled.
