“We disagree with that assessment,” the defense attorney said. “It’s the nature of the case. It would be remiss for us to assume her state of mind.”

Wilson wants to bring in a private doctor, Dr. Robert Hanlon, to work with and evaluate Giedrojc in the jail house.

“He is very respected in the legal community,” Wilson said. “His evaluation will be more scientific.”

Cook County Circuit Court Judge Colleen Hyland on Wednesday approved a defense motion, allowing a new expert to evaluate Giedrojc behind bars. The defense's psychologist, Dr. Robert Hanlon, will rely on an interpreter to evaluate Giedrojc, who came to America in 1983 and has an eighth-grade education...

Giedrojc was admitted to McFarland Mental Health Center in Springfield in August 2014, just one month after a different judge declared her unfit for trial, according to court records. They indicate that she was diagnosed with a history of "major depressive disorder" but was in remission after receiving regular doses of antidepressant and antipsychotic medication.

An evaluation described her as "quiet and submissive" and that she speaks little but listens to other more talkative patients, court records show.

Exam finds woman psychologically fit for infant death case, judge says

A psychological examination has found the Oak Lawn woman accused of brutally killing her infant grandchild fit to stand trial, said the judge in her case.

On Wednesday, Cook County Judge Colleen Hyland set a bench trial date of July 16 for 65-year-old Alfreda Giedrojc. Prosecutors allege Giedrojc beat 5-month-old Vivian Summers with a sledge hammer before cutting the infant's throat with a kitchen knife.

"How long do you think the trial will take?" Hyland asked Wednesday.

"One day, judge," said Cook County prosecutor Michael Deno.

Giedrojc returns to court June 6 for a status hearing.

While there was discussion at Giedrojc’s last court hearing in June of a possible plea offer, assistant public defender David Dunne asked for a bench trial date to be set on Oct. 24. Giedrojc has undergone several years of psychological evaluations while awaiting trial. The case has gone on for so long that her originally assigned public defender retired.

Judge To Rule If Grandmother Was Insane In Baby Murder Trial

A Cook County judge is set to rule Wednesday if an Oak Lawn woman was legally insane when she allegedly bludgeoned and slit the throat of her infant granddaughter in October 2013. Testimony wrapped up in the two-day bench trial of Alfreda Giedrojc, 67, who is charged with the first-degree murder of 6-month-old Vivian Summers. Experts for the defense painted a troubling portrait of Giedrojc's slow descent into mental illness up until the day when she allegedly murdered the Bolingbrook infant.

In his closing arguments, Cook County Assistant State's Attorney Michael Deeno said the evidence showed that Giedrojc knew that what she was doing was wrong; that if she tried to hurt Vivian or her other grandchild, the men in the house that morning -- Boleslaw, Summers or her son -- would have stopped her. So she waited until they left and she was alone with the baby.

"Why did she have to hide the sledgehammer," Deeno said. "She didn't put it out in the open knowing the next day Vivian would be coming with her father. She told doctors she knew she'd be arrested. She knew what she was doing was criminally wrong."

Grandmother who brutally killed infant in Oak Lawn found not guilty by reason of insanity

An Oak Lawn woman was found not guilty by reason of insanity in the brutal 2013 slaying of her 6-month old granddaughter.

Judge Colleen Hyland ruled Wednesday that Alfreda Giedrojc “did suffer from a mental illness” when she repeatedly hit the infant in the head with a sledgehammer and later used a kitchen knife to slit Vivian Summers’ throat.

Hyland further pointed to testimony of Giedrojc’s family in determining her ruling, including testimony from her daughter that described Giedrojc as, “a lump on a log” leading up to murder. Family members also said Giedrojc had been losing weight, stopped working and no longer attended church.
