At 4:07 p.m. court is back in session. Judge Gull starts off by scolding the jury, she says officers informed her of people in the jury talking and says anyone talking will be kicked out.

The defense calls to the stand First Sergeant Chris Cecil from ISP. Defense attorney Jennifer Auger asks him what an “audio output start” means. He says he does not know. Cecil says he doesn’t have the education to know why a cell phone would or wouldn’t connect to a tower.

McLeland begins cross examination at 4:08 p.m. Cecil says he googled the water question asked by the jury before the break. He said a Google search said that a phone could register water or dirt in the headphone port as having headphones plugged in.

Auger begins redirect and asks Cecil, “do you normally Google search when conducting research in a criminal investigation?” Cecil says “not normally, no.” Auger asks “you normally look at peer reviewed articles, right?” Cecil says “that’s correct.”

Auger asks “you and the state have had 7.5 years to research this?” “That’s correct,” Cecil responds.

The defense then calls Brian Bunner, a lieutenant with the Indiana State Police.

Auger asks “Do you know what audio output means?” Bunner says no. She then asks, “have you done any Google searches?” He says “no.”

Defense says nothing further.

No cross.

Jury leaves the courtroom at 4:25 p.m.

 
Delphi Murders Trial Day 16 Wrap Up:

Want to start with some really important testimony from one of the defense's witnesses this afternoon that calls the prosecution's timeline of the crime into question

-This afternoon the defense called Stacy Eldridge to the stand <i></i>
-She is a digital forensic examiner and worked at the FBI for about a decade
-She is being paid by the defense team and was asked to do a review of the data that state police extracted from Libby German's cell phone <i></i>
-She did not do her own extraction, just analyzed data state police had already extracted
-State Police did not do what's called a "Full File" extraction initially, but did one in October 2017
-Eldridge said the delay in doing that full file extraction caused issues <i></i>

-She said you lose files every time the phone is turned on and off and older files drop off as time goes on
-Eldridge said main piece of evidence missing from the state police's extraction is the power log which tells when the phone turns off and on <i></i>
-Eldridge said she generally agreed with the state police's timeline of the phone data
-She did a little more analysis of the data and found the last time Libby's phone connected to a cell tower was at 5:44 PM on February 13 <i></i>
-The next time it connected to a cell tower was at 4:33 AM on February 14th
-She said there is no explanation of why the cell phone didn't have signal during that time other than movement or the signal being blocked <i></i>
-In their analysis of the phone data, state police found what's called an "audio output route" at 5:45 PM on February 13
-State police didn't know for sure what that was when they did their full analysis in 2022, but more research has been done now <i></i>
-The data shows that something was plugged into the audio jack of Libby's phone at 5:45 PM and then it was unplugged at 10:32 PM that evening
-That's significant because the prosecution's theory is that Richard Allen killed the girls around 2:32 and left around 4 PM <i></i>
-The prosecution appeared very caught of guard by this revelation
-Prosecutor Nicholas McLeland tried to go after Eldridge's credentials during cross examination
-He then asked why the phone didn't show movement <i></i>

-Eldridge said just because it didn't log movement doesn't mean it wasn't moving
-She said there remains a lot of questions about how the Apple Health app registers movement
-McLeland never really went after the data showing the plugging/unplugging <i></i>
-After that, the defense called First Sergeant Christopher Cecil to the stand
-He testified for prosecution and was state trooper who did the extensive analysis of Libby's cell phone data
-He testified he didn't know what that "audio output route" was <i></i>
-During cross examination, McLeland asked Cecil about what other things could possibly affect the headphone jack
-Cecil said water damage and possibly dirt
-When asked where he got that, he said he Googled it during a 15 minute break <i></i>
-Defense attorney Jennifer Auger went at him on redirect and asked him is he normally does his research on Google.
-He said no
-He didn't know if phone had water damage or dirt on it
-Auger said "You and ISP have had 7 1/2 years to figure this out?"
-Cecil said yes <i></i>
-Auger then said you "come here after a Google search?"
-Cecil said yes
-After that, she called Brian Bunner to the stand
-He did the first extraction from Libby's cell phone on Feb 15, 2017
-He said he didn't know what the audio output meant <i></i>

-Auger then asked if he did any Google searches during the break and he said no
-The phone was a big moment for the defense
-Defense Attorney Andrew Baldwin said the state's case would melt away with the phone data
-We'll see what the jury thinks about it <i></i>
-We began the day with Betsy Blair back on the stand
-She says she saw bridge guy on the bridge the day the girls went missing
-She also described a car that was parked at the old CPS building where the prosecution says Allen parked that day <i></i>
-She described the car she saw as a 1965 Ford Comet
-Says she saw the car as she was leaving the trails around 2:15 PM
-She told police in 2019 that the car she saw "could not have bene black" <i></i>
-During cross, deputy prosecutor Stacy Diener said Blair gave a statement in Feb 2017 as well
-At that time she said the car she saw was parked strangely and was "not newer"
-She's certain the car she saw was parked at the CPS building <i></i>
-After Blair it was Dr. Stuart Grassian who is a psychiatrist that specializes in the effects of solitary confinement
-He reviewed medical records, video from Allen's cell, his phone calls and other things
-Grassian said solitary is "lonely" and "toxic" to mental health <i></i>
-He said the UN considers more than 15 days in solitary confinement to be a form of torture
-Allen spent 13 months in solitary
-Grassian was asked about false memories
-He said false memories can start by seeing photos or reading things <i></i>

-They're then played over and over in someone's mind that eventually it almost becomes real to people
-During cross examination, Diener pointed out that the study of false memories was done with victims of sexual abuse, not those in solitary <i></i>
-She asked Grassian if he understand that Allen was put in solitary for his safety
-He said his focus is on the conditions he's put in, not the reasoning for it
-Last up before lunch was Dr. Eric Warren who is a specialist in forensic firearms examination <i></i>
-He worked at the Tennessee Bureau of Investigation for several years as a firearms examiner
-He acknowledged there are people in his field that are skeptical of the practice but he is not one of them
-Warren was hired by the defense to review the work of Ms. Oberg <i></i>
-Oberg was the state police examiner who concluded that the unspent round found between the bodies of the girls was consistent with Richard Allen's gun
-He said there have been recent incidents of labs being shut down because of firearms identification issues <i></i>
-He said the comparison Oberg did is comparing "apples to oranges"
-Oberg compared the bullet from the crime scene to a bullet that was fired from Richard Allen's gun
-Warren said there is more pressure exerted on a bullet when a gun is fired from the explosion that occurs <i></i>
-He also pointed out that Oberg did not do any documentation of specific characteristics on certain parts of the gun
-He also looked at the photos from Oberg's report and didn't think there was "sufficient agreement" on the marks she referenced <i></i>
-During cross examination, deputy prosecutor James Luttrell became quite angry with Dr. Warren at times
-Warren told him that Ober came to the conclusion on her own that she could compare a fired round to an unfired round <i></i>
-Luttrell pointed out that Warren didn't review the bullet or gun himself, he only looked at Oberg's work
-The jury asked 15 questions about this testimony
-One that stood out to me was about asking why Warren didn't do his own examination of the evidence <i></i>
-Warren said he was asked by defense to first look at Oberg's report and determine is she had a solid reason for her conclusion
-They determined she didn't and so they didn't need to do their own test to disprove hers <i></i>
Court ended early yet again when the defense ran out of witnesses. We ended with the phone testimony. Still appears that things may wrap up in the coming days.

Court resumes at 9 am Wednesday.

Delphi Murders Trial Day 17 Wrap Up:

We're close to the end. The defense rested this morning and then we finished rebuttal witnesses this afternoon. Closing arguments start tomorrow.

-Defense attorney Brad Rozzi told the courtroom the defense rests shortly after court began


-This apparently caught the prosecution off guard because they're rebuttal witnesses weren't there yet and so we had to take a break and wait for them
-During this time the attorneys discussed the jury instructions some


-Judge Gull said she would read instructions to the jury before closing arguments and neither side had a problem with that
-First rebuttal witness for the prosecution was Breann Wilbur
-She took the stand previously and was on the trails the day Abby and Libby went missing


-The prosecution admitted a snapchat photo she took when she arrived at the trails around 12:25
-She then walked to the high bridge and didn't see any girls and didn't see bridge guy


-This seems to be pushing back on Allen's statement during his first interrogation where he said was on the trails from 12 to 1:30 after initially telling police in 2017 that he was there from 1:30 to 3:30


-Defense attorney Andrew Baldwin seem to insinuate during cross that police were more focused on the end of her time on the bridge and not the beginning
-He basically said we all just have to rely on her memory
-Next up was Master Trooper Brian Harshman


-He also previously took the stand and was the one assigned to listen to all of Richard Allen's phone calls
-Harshman testified Allen has essentially been in solitary confinement since his arrest
-Seems that the insinuation was why did he only become psychotic at Westville


-The defense did not cross examine Harshman
-Last up was Dr. John Martin who was the psychiatrist at Westville who treated Allen
-He went to medical school in India and worked in several Florida prisons and jails
-He first evaluated Allen in November 2022


-He said Allen was stable and had no problems that he could outside of his previous mental health history
-Martin said he had treated "safekeepers" previously but never one in solitary confinement


-He testified that even though there was mental harm by putting Allen in solitary it was done with the intention of keeping him safe

NOTE: There was some notable reaction from defense team when Martin said this because it's exactly what they want him to say.


-Martin met with Allen 18 times in 13 months
-After their first November meeting, Martin didn't see Allen again until April 2023
-Martin was asked to come to the prison and saw Allen laying on his cell floor naked and covered in feces


-The next day it was decided that Allen would get a Haldol injection
-By early May, Martin said Allen improved and there was no evidence that he could see of psychosis
-That continued into June when Martin had another meeting with Allen


-It was during this meeting that Allen said he wanted to apologize to the families of his victims
-Martin said he did not present as psychotic during that meeting
-During cross, Rozzi starts to ask about lawsuits Dr. Martin was involved in down in Florida regarding solitary


-Deputy prosecutor Stacy Diener objects and he moves on
-Dr. Martin agreed that solitary confinement can bring about and exacerbate mental illness
-He testified that he never saw the videos of Allen at Westville


-Rozzi then played a video from around the time Allen made that statement

NOTE: Allen nor his family watched the video. They turned their heads away and some were crying as it went on.

-It showed Allen getting a medical check up at the prison while strapped to a chair


-He appeared catatonic and had a blank stare on his face
-Very similar to the photo below that his attorney's released of him
-During redirect, Martin said the video was not how he remembered Allen that day and he can't explain why
-He said it doesn't make him think he was wrong

-During recross, Rozzi asked if seeing that video made him question his assertion that Allen was no longer psychotic and Dr. Martin said it did
-The jury asked 4 questions including about whether what Allen looked like on the video could be him faking his symptoms
-Martin said no


-Martin did say it's possible Allen could slip in and out of psychosis in a 24 hour period
-That was the prosecution's last rebuttal witness
-Seemed notable to me that they didn't bring anyone to refute the phone data from yesterday that seemingly blew up their timeline


-Defense didn't call any rebuttal witnesses
-Judge Gull turned to the jury and said "you have heard all the evidence in this case"
-Jury was sent home for the day
-Once the jury left, Baldwin asked Judge Gull to issue an arrest warrant for Elvis Fields


-He is one of the supposed Odinists the defense contends killed Abby and Libby in a sacrifice
-Fields was issued a subpoena and never showed
-Baldwin wants him to testify outside the presence of the jury but for the record in case an appeal is needed


-Gull said he wouldn't have been allowed to testify in the case so she's not going to do that
-Court wrapped up early and closing arguments begin at 9 am tomorrow
-Each side gets 2 and a half hours for closing
-Prosecution will go first followed by the defense


-Then the prosecution will get a rebuttal and that will be the last work
-Appears Brad Rozzi will be doing the closing for the defense while McLeland handles it for the prosecution
-After that, it'll be up to the jury

13 Things To Know From The #Delphi Murders Trial Today - Nov 6

1. The Defense surprised most people in the courtroom at 9:10am by resting its case — moments after jurors sat down — without calling another witness.The prosecutor & judge were certainly caught off guard.


2. Prosecutor Nick McLeland needed a 90+ min delay to get rebuttal witnesses to the courthouse. Judge Gull said she had planned to discuss jury instructions with attorneys, but had not expected to do that so soon. Jurors got a break while waiting for State witnesses to arrive.


3. The State re-called Breann Wilber to ask about what she saw on the Delphi trails on the day of the murders. She said she didn’t see young females (Abby & Libby) or Bridge Guy while walking. Didn’t seem like overly helpful testimony but it could be referenced during closing.


4. The State also re-called ISP detective Brian Harshman to ask about size/condition of cells at the 3 prisons/jails where Richard Allen has been held since his arrest. Harshman said they’re all about the same. I think that will be mentioned during closing re: RA’s mental health.


5. The State’s final witness was Dr. John Martin, a psychiatrist who treated Allen at the Westville prison. He said RA was stable & didn’t seem depressed or anxious when RA first arrived in early Nov 2022. Also said “everything seemed to be fine” when he saw RA 3 weeks later.


6. Martin said Allen was also doing well in Jan 2023 so he did not plan to visit him again for 3 mos. That changed on 4-13-23 when RA showed clear signs of psychosis. Martin & other mental health staff chose to administer RA an anti-psychotic drug to improve RA’s poor condition.


7. The psychiatrist said Allen’s condition improved by 5-2-23 and he saw no signs of psychosis in RA in May or June, including on 6-20-23 when Martin claims RA said “he wanted to apologize to the families of his victims.” During that time, Allen also made many other confessions.


7. Things got messy during cross exam. The Defense showed Martin a video of Allen on 6-20-24 (same day as the confession to the doctor). The video showed RA restrained in a chair getting a medical exam, looking lethargic, dazed, motionless & emotionless. Then came the questions…


8. (Oops, two #7s) After acknowledging the dazed RA video was taken the same day he diagnosed Allen as NOT psychotic, Martin told dpty pros Stacy Diener he stood by his diagnosis. But when def atty Brad Rozzi asked if the video made him want to reconsider that, Martin replied YES


9. Martin reversed course again a few minutes later under more questioning by Diener. The jury may have gotten whiplash from so many back-&-forth answers from the psychiatrist. And then there’s this doozie of an answer when Diener asked about Allen being in solitary confinement…


10. Martin said solitary brings a stigma that an inmate is being punished for bad behavior in prison but “Mr Allen had not done anything wrong & he was being treated as if he had done something wrong. That was not right.” Said IDOC had to balance RA’s safety & his mental health.


11. The testimony from the State’s 41st & final witness was no home run following what jurors heard a day earlier: a Defense witness who said Allen was definitively suffering from psychosis & a mental health crisis when he made a series of “false” prison confessions in 2023.


12. At 2:20pm, Judge Gull told jurors “Ladies & gentlemen, you’ve now heard all of the evidence in this case.” Thursday is closing arguments from the State & Defense which are both allowed 2-1/2 hours for their closing statements. Jurors will then get instructions from the judge.

Judge Frances Gull uttered those words to the jury at 2:20 p.m. Wednesday, after 17 days of testimony in the Delphi murders trial. After the defense rested its case, the state brought back two witnesses for more questioning, as well as prison psychiatrist Dr. John Martin, who met with Richard Allen after Allen was diagnosed as psychotic. Allen did not take the stand in his own defense, and the jury was reminded that he is not required to testify and that cannot be held against him. Thursday, jurors will hear closing arguments, and they’ll get their jury instructions before deliberating on a verdict.

Richard Allen's sister & daughter say he never molested them | Day 14 & 15 | DELPHI DEBRIEF​

We heard crucial testimony for the defense inside the Carroll County Courthouse on Monday.We learned more about Richard Allen's mental state while he's been in prison, as well as firsthand accounts from his own family in Delphi.

First to take the stand Monday was a neuropsychologist, Dr. Polly Westcott. Westcott said she met with Allen in prison to do a series of psychological exams, and after reviewing those exams, prison videos, phone calls and medical reports, she determined Allen suffered from major depressive disorder and psychosis when he confessed to killing the girls. She also determined he was not faking or exaggerating his mental health. That contradicts the most damaging evidence against Allen so far — his recorded phone call confessions to killing Abby Williams and Libby German in February 2017.

Jurors also watched two videos that showed Allen inside his prison cell. A witness said it showed Allen eating his own feces and banging his head against the wall of his cell. The defense is trying to prove Allen's mental health was deteriorating, driving him to make false confessions. The state claims the videos were used to get sympathy from the jury.

The jury is now deliberating the #Delphi case against accused murder suspect Richard Allen.

Allen faces 2 charges- 2 felony murder charges for killing Abigail Williams and Liberty German and 2 murder charges for killing Abby and Libby near the Monon High Bridge Trail in Delphi in February 2017.

The jury went into deliberations at 1:24 pm, 11/7/2023.*
