*Omnibus Hearing (@ am CT) - IN - Emma Grace Patricia Sweet (2) (Last seen Nov. 24, 2021, reported missing Nov. 25, 2021; found Nov. 28, 2021 -2 ½ miles downstream from truck. The death certificate filed for 2-year-old Emma indicates her manner of death as homicide & cause of death as complications of hypothermia & asphyxia due to drowning). Also Jeremy Sweet, dad & truck found Nov. 26, 2021 in the White River, Columbus, Bartholomew County. *Jeremy W. Sweet (38/now 39) arrested (11/28/21) & charged (12/1/21) with neglect of a dependent resulting in death & unlawful possession of syringe. Plead not guilty. $1.2M bond.
No actions were taken by her adult caregiver to rescue Emma from the dangerous environment & this inaction resulted in her death," the Bartholomew County Sheriff alleged in a statement, "and thus the manner of death is homicide."
Trial was set to begin on 8/23/22 continued to 12/13/22 continued on 4/11/23.

7/25/22 Update: Hearing held. Defendant by counsel makes an oral motion to continue the change of plea hearing, pretrial conference & jury trial. State has no objection. Court grants continuance & sets new dates & deadlines. Change of plea hearing on 11/14/22 @ 9:15am, pretrial conference hearing on 11/28/22 @ 11am & trial set to begin on 12/13/22. No update on plea hearing.
11/14/22 Update: No plea change. At a change of plea hearing Monday Sweet’s defense attorney, Andy Maternowski moved for a resetting of dates because he told Bartholomew Superior 1 Judge James Worton the prosecution and defense were “still working through discovery.” Prosecutors offered no objection, and Worton reset Sweet’s next pretrial conference for 3/13/23 @ 9am & on 3/27/23 @ 11am & his jury trial for 4/11/23.

12/28/22 Update: Change of plea hearing on 3/13/23 @ 9am. Pretrial conference hearing on 3/27/23 @ 11am & jury trial begins on 4/11/23.
3/13/23 Update: Defense attorney Andrew C. Maternowski asked that the matter be postponed for the fourth time. Maternowski was retained by Sweet last May, replacing public defender Aaron Edwards. He told Judge James Worton the case is still active in the discovery phase. Besides the State & defense exchanging information, discovery might mean interviewing witnesses, gathering physical evidence, examining computer files, speaking with expert witnesses, reviewing police reports & going over witness statements. After DA Holden-Kay did not object, Judge James Worton scheduled a new change of plea hearing for 6/26/23 at 10:30am, a final pre-trial conference on 7/10/23 at 11am & a tentative jury trial to begin at 8:30am on 7/18/23.
