Initially, Carlo questioned if he was Evan’s biological father. He filed for paternity action and tried to set up child support.

Carlo says the conversations began civil in Jan 2017. But they turned in Feb

Carlo remembers Miranda disciplining Evan, telling him to go to the door (the time Carlo saw his son with the injury) and Bodine was not in sight. Carlo is now excused.

Witness 3: Evan’s aunt, Cheryl Brewer Met Evan’s mom, Miranda, around 2013.

Cheryl & her 18yo son allowed Miranda & Evan to move into their home in summer 2014. Cheryl helped raised her nephew.

Cheryl offered multiple times to help raise Evan. She says Evan had two aunts’ homes that he was welcomed to at anytime.

Cheryl says Evan was potty trained in her home. She says “he was a big boy... very healthy”

Remembers winter 2017, when Miranda showed up at her house in the middle of the night when she was “beat up” around the face. Miranda says Bodine hit her. Evan didn’t have a coat and was dressed in clothes too small for him. Evan stayed at Cheryl’s home.

Two days later, she brought Evan back into the south Wichita house, where Miranda lived. Reported the whole incident to Carlo.

Cheryl is crying recalling the time Evan was with her and witnessed Evan chocking a 4yo girl & his mouth was cringing. “I’d never seen anything like that.” She says it was the first indication that “Something major was happening at that house”

Cheryl says she told Evan “you don’t do that” That behavior concerned her. Evan was potty trained before and when he returned to her house (after living with Miranda & Bodine), he was afraid to go to the restroom.

The aunts were not backing down to help their nephew and to try to find him.
“Since we couldn’t get assistance from the officers,” she says they just stayed outside the south Wichita house demanding to see Evan 24/7.

Update: Defendant Stephen Bodine’s father remains in jail after the disturbance he caused oustide the courtroom yesterday. Evan’s family members have a protection from stalking order against him, thus he’s not allowed to be in the same room. (Evan’s family is at all hearings)

Court is back in session. Witness 3 is being cross examined.

Witness 4: Stacy Hamilton (sp), has children with Carlo Brewer. She was in a relationship with Carlo before Carlo and Miranda were together.

Stacy was Miranda’s friend. She recalls Miranda telling her that Bodine would be her roommate first. Eventually, Miranda and Bodine got into a relationship.

Stacy says Miranda became distant.
But Stacy still came over to babysit Evan. She recalls 5/8/2017, when she took Evan out to the park, with her kids, and brought Evan back home.

The first cause of concern for her was Miranda dating Bodine. She recalls a time when Miranda was abused and she said Bodine did that. Miranda had back injuries that Stacy believed required medical attention but Miranda refused to go.

Stacy recalls a second incident when she saw two black eyes on Miranda, months before March 2017. She offered to keep Evan and Miranda said Bodine wouldn’t hurt Evan and that he wouldn’t do that again.

Stacy learned that Carlo wasn’t allowed to see Evan in the spring of 2017.

Stacy recalls learning that Evan was scared to go to the bathroom in the middle of the night because “he was scared of Bo” Bodine referred to Evan as “the boy” and not by his name.

The witness is being cross examined by the defense attorney. He’s questioning her recollection of events because she cannot remember exact dates they happened.

She remembers 5/8/2017 when Evan looked good (not injured). She says Miranda informed her that she and Evan would be leaving Kansas.

Last saw Evan March 2017 at rental house of Bodine and Miranda Miller. CB saw nose injury on Evan. Evan said his "daddy" did it, meaning Bodine. Miller asked Evan what he said and Evan changed his story and said he fell. Miller put Evan against the wall with his nose touching wall. CB said Evan looked at him as if he wanted to go with CB

Prosecutors said Carlo made 'dozens of calls to police' from March to Sept 2017. Also CPS was called.

"Report indicates that Stephen bragged he chokes Evan out and does CDP to bring him back," said former DCF social worker Kena Battler."

Others saw abuse, injury and controlling between Bodine and Miller. Miller was seen with injuries and she told friends it was from Bodine.

During this time Evan's personality changed...
"
They said Evan became violent and attempted to choke other children.

"He turned around and took her pink dog collar, the leash. and was trying to wrap it around her neck...and did it again," Evan's aunt, Cheryl Brewer, said. "That was my first indication that something major was happening at that house."

Carlo Brewer, Evan's dad, did not see Evan during this time but he kept going to the house asking where Evan was. August 2017, Bodine had a hatchet and sliced a tire and police were called.
 
State worker saw Evan twice before he died. She believed mom’s story explaining abuse

DCF, Department of for Children and Families....or in other states Child Protective Service....a social worker, Kena Battle, said 2 reports of abuse were investigated. One report was Miller took her to the DCF office and the other was when the social worker made an unannounced visit to the rental house

Social worker, K. Battle, said "his condition during the visits didn't cause enough concern to substantiate the abuse alleged''.

First visit was March 24, 2017 at the K. Battles office. Injuries were to nose and face. DCF had received 2 reports just before this visit. Miller changed her story and explained away the injuries, tripping and bike being ridden on stairs

K. Battle said Evan ''did not appear to be in pain''

Second visit was when Battle went to the house April 5, 2017 unannounced. Miller said Bodine did not live with them. Battle ''took Miller at her word''

Battle closed the case said she could 'substantiate the abuse at that time'.

Again Battle went back to the house when more abuse reports were received...this was in May 2017. One report said "Bodine had bragged about choking Evan and was brainwashing Miller — no one answered the door."

There were a total of 8 reports DCF received on Evan's abuse. Some of the reports did not give enough information so they were not sent on to a social worker.

State has said the DCF has made 'mistakes' in this case.

Jury is back.

Witness #5 is Jolyn Kennedy (sp), she’s an inmate (for an unrelated case). She is friends with Miranda.

She used to watch Evan frequently on weekends, but says things changed when she started dating Bodine.

Recalls that Evan was potty trained but had started wetting himself after Miranda and Bodine were dating.

Witness 6: Steven Hastings, friend of Carlo Brewer. He and Carlo went by the south Wichita house multiple times in the hopes of seeing Evan.

After the “threatening” text messages in feb 2017, Carlo and his friend would go knock on the south Wichita house together to check and see if Evan would come out. In March 2017, Miranda answered the door. They saw Evan and noticed an injury on his nose.

Witness 7: Jeremy McCart (sp), Carlo’s father in law. His car was damaged in August 2017. He saw a photo of his tire, which was slashed.

Witness 8: WPD Officer Josh Rounkles, working on 8/11/2017 and responded to a call to the south Wichita house for a “disturbance with weapons” call.

He has his body cam on. Jury will get to see the video of that day when he responded to the call.

On 8/11, Carlo and his wife came to the house to ask about his son. Bodine allegedly had a hatchet, threatened the couple and slashed one of the tires.

In the video, Bodine won’t come out of his house to talk to police. Bodine tried to show surveillance camera video of the incident through the screen door I the front.

Bodine never came out of the house that night.

Witness 9: Sara Kirby (sp), Carlo’s wife.
The last time she saw Evan was in Feb 2017.

Sarah says “he was more aggressive...like to hit and yell” Evan used swear words such as “F...” and “B....”

Sarah was with Carlo on 8/11/2017 and recorded the two times they went to the south Wichita house that day. She recorded both encounters with her cell phone.

Jury will get to see both videos.

First incident: Bodine yells at Sarah telling her to get off his property. She also hears him say “shut up” to someone inside
Carlo is next to her, talking to 911 dispatch.

WARNING: Explicit language in this video. This is the second time Carlo and Sarah go to the south Wichita house to ask for Evan on 8/11/2017. Sarah says Bodine had a hatchet and slashed a tire.

Witness 10: Omaha Police Officer Brandon, was a #WPD Officer during the 8/11/2017 incidents. He responded to both calls that day. First call was to locate his son and Miranda. No violence then. Second call was to a disturbance with weapons call. And made contact with Bodine.

Officer says he didn’t locate a child during the first call. Half an hour later, he came back when there was a second 911 call.

Jury sees body cam video from that officer. Bodine wants to show police surveillance camera video of Carlo and Sarah coming to knock on his door. But Bodine doesn’t want to come out of the house.

Bodine says “he (Carlo) wants information... information I’m not going to give him” & admits he slashed a tire during the Aug 11, 2017 incident. Carlo last saw his son in March 2017. The concrete structure with Evan’s body was found on Sept 2, 2017 at the south Wichita house

Bodine tells police that Miranda left out of the state and not at the house.

Miranda has been ordered to appear in court but never showed up. Bodine says he’s looking after the property.

The south Wichita house is a rental property.

Officer says Bodine repeated that Miranda wasn’t at the house but never mentioned Evan.

Since they didn’t have a search warrant, they couldn’t see inside if Miranda or Evan were inside. Bodine was “agitated” & police didn’t know what weapons or what was inside the house, plus they didn’t have enough staff. They had a felony pick up but didn’t arrest him that night

Jury will take their afternoon recess at this time.

Witness 11: Keena Battle, former social worker for DCF and was there 15.5 years. She was assigned the Evan Brewer case.

In total there were 4-5 DCF cases regarding Evan.

She says the first DCF report was made in March 19, 2017.

Report shows that Evan had a nose injury.

Miranda told DCF that Bodine didn’t live at the south Wichita house in April 5, 2017. Social worker asked about the nose injury but in the end she determined the complaint was “unsubstantiated".

Another report comes back which says Evan would pretend to sleep because he was scared. Social worker last saw Evan on April 5. In May, social worker tried making contact with Miranda & Evan but was unsuccessful.

Social worker received another report in May after Carlo hadn’t seen his son since March. She says law enforcement became involved when she became concerned.

Witness 12: Karen Blank, patrol officer for WPD. She responded on Sept 2, 2017. Call came in that a concrete structure was suspicious and that the individual thought child’s body was inside. Jury will see her body cam video.

Witness 13: Miranda’s friend of 15 years and knew Evan.

Eva Mora asked for a photo of Evan in summer 2017.

Appears photo was not recent. She’s excused now.

Jury will be excused as well. Trial continues tomorrow at 8:45am.

Records that DCF released toThe Wichita Eagle in March showed that for more than a year, people reported to the state that Evan was suffering in a home of chronic methamphetamine users. The records also said Bodine abused Miller and bragged about choking her and the boy until they were unconscious.

'Simply put, the system is broken,' the former Wichita mayor said in April in a statement. 'And our children, the ones we should be protecting the most, are suffering.'

Miller has worked out a plea agreement with prosecutors the Kansas City Star reported, that will put her behind bars for 27-and-a-half years in exchange for testifying against Bodine.

Bodine’s defense attorney, Casey Cotton, argued that Bodine helped Miller dispose of Evan's body after he passed away, and that he was helping her with her son because 'she was having difficulty taking care' of Evan on her own.

Miller is expected to testify again as the trial goes on.

Others expected to take the witness stand include police officers who investigated Evan’s whereabouts and death, others who reported seeing signs of abuse against Evan, and Bodine’s own daughter, who has said he abused her when she was a child.

Kena Battle testified Wednesday at Stephen Bodine’s murder and child abuse trial that when she saw Evan on March 24, 2017, at her office that he had nose and facial injuries consistent with two abuse reports that DCF received about him a few days before.

Battle said when she asked Evan what happened, he told her “mommy hurt him.”

Battle said when she asked Miller to have a doctor examine Evan, Miller told her the injury “was fine” and pushed the boy’s nose back and forth in front of her.

Evan didn’t cringe or appear to be in pain, Battle testified, so she took Miller’s word.

“I’m not a medical doctor,” Battle said from the witness stand.

Eleven days later on April 5 when she made an unannounced visit to the rental house at 2037 S. Vine where Evan lived, she saw both Evan and Miller and was allowed inside of the home. During that visit, Miller told Battle that Bodine, her boyfriend, didn’t live with them.

Battle said in court that the living arrangements mattered because some of the abuse reports named Bodine as Evan’s suspected abuser.

But, Battle said, she took Miller at her word and didn’t inspect the house for signs that a man was staying there.
he reports that prompted the March and April visits with Battle were among at least eight DCF received concerning Evan in the 13 months before he died and his body was buried in a concrete tomb inside the house in May 2017.

Day 3 Stephen Bodine trial. He’s charged in the abuse and murder of 3yo Evan Brewer.

His body was found Sept 2, 2017 encased in a concrete structure at the south Wichita rental house that Bodine shared with his girlfriend, Miranda Miller (Evan’s mother).

Witness 14 is a retired police officer, who was with EMCU. On 5/22/2017, Carlo and his attorney came to him to report the case of his missing child.

First 911 call was 3/13 to check welfare of Carlo’s son, Evan.
Days later he made a report that he hadn’t seen his son in a month.

3/18 Bodine made a report that Carlo was threatening Miranda.

There were multiple reports made by Carlo to check the welfare of his son. (calls to 911, reports to police and reports to DCF)

Police Officers went to the house multiple times to try to make contact with people who lived at the south Wichita house....but no one ever answered.

“To serve someone” for stalking and abuse orders, they have to be personally served (meaning there has to be proof that they physically received it)

SCSO made numerous attempts to serve those orders but never made contact with anyone

On 7/6, judge granted full custody to Carlo of his child, Evan. The officer testified that LEO made multiple attempts to make contact with the people at the house, but it was evident that they were avoiding to get served.

July 2017: Police gave info to the Kansas Missing & Unsolved group after that judgement. Police then were told that Miranda May have moved to Texas or Oklahoma. Thus, it then became a national missing child case.

Officer is recounting the timeline of events including the Aug 11, 2017 incident. This is what was shared yesterday:

Bikers Against Child Abuse also assisted in being outside of the south Wichita house. Various groups, family, friends were all trying to locate Evan Brewer.

Aug 30 both Bodine and Miranda were arrested.

For months, Miranda hadn’t been seen by police but on Aug 30 she appeared driving her vehicle over her lawn of the house.

Bodine eventually surrenders and was arrested that same day.

There were three separate cases that police were investigation, but not homicide (because there was body) -interference with parental rights -suspected child abuse -aggravated assault

This former officer with EMCU became involved in the case when a 5/22/2017 phone call from relatives concerned with the welfare of Evan Brewer

The landlord last saw Evan on June 6 and a neighbor said the child was last seen in July

Witness 15 doesn’t want to be filmed. Laura Lively (sp) is the ex girlfriend of Bodine (dated between 2007-2011).

When asked if Bodine has changed. She said, “He got on drugs (meth).” She said when they dated, he was smoking marijuana.

She got to know Miranda (they all worked at the same company).
She also got to know Evan.
She visited the south Wichita house and saw the relationship between Bodine and Miranda.

She recalls a day she saw Miranda with a black eye. She claimed she ran into a door.
Lively offered to take her somewhere for help.

Miranda refused.
She also observed Evan looking scared around Bodine. Evan was walking by kitchen, he’d clench his teeth and close eyes as he passed Bodine. “It was not normal.”

Felt it was odd that he was wearing full diapers on, not pull ups. She found that odd.

She often came over the house before March 2017, but not after an incident (they’ll talk about that later). Evan was taught to sit still while watching tv in his room. She said Evan was quiet ...“unusually quiet” for a child.

She recalls Bodine telling her that he dragged Miranda by her hair. “To make her be submissive.”

They will show text messages between Laura (ex girlfriend) and Bodine.

One of the texts refers to Miranda being more obedient to Bodine. But... “The boy is tougher in mind” than his mom.

Refers to Evan as the boy and says he hasn’t earned anything. He says he wants Evan to be “polite and respectful.”

She recounts the abusive and controlling nature of Bodine towards Miranda and Evan.

She wrote a letter in May, in support of Carlo gaining custody of his child. She recounts how scared Evan was, the abused endured, and how Bodine claimed he beat both mother and child to the point of death and would bring them back by CPR.

She recalls an incident when she was dating him where she cried and he became violent.
“He didn’t like people crying”

She recalls recounting her concerns to DCF but says that individual, who testified yesterday, “didn’t take her seriously”

The last texts she received from him were hate-filled with many expletives. She says she remembers when they were together, he once brought up a situation that he did and then later denied. He said, “I drowned my daughter” did CPR & “brought her back to life”

“I don’t want to stay here anymore,” she remembers Evan telling her, while hugging her, as she left the house for the last time.

Cross examination now.
She says Bodine said the drowning of his daughter “was an accident”
She only saw physical injuries on Miranda but not on Evan

She never witnessed the abuse but was told about it.

She recalls Bodine say Evan slipped in the bathtub and needed to give him CPR to bring him back to life. Defense attorney is questioning her recollection of the events that were told to her by Bodine.

Prosecutors is reminding jury that she wrote the letter in May 2017... testified during prelim hearing almost a year later... and now having to remember during this jury trial. She says she did everything for Evan.

Jury is talking the morning break and will return at 11:20am

Witness 15: WPD detective who received evidence collected from Bodine when he was arrested.
Specifically, they’re looking at Bodine’s wallet.

Officer shows a piece of paper inside Bodine’s wallet. It’s a signed paper that says
Miranda changed her last name to Bodine and that “her master” is Bodine.

Witness 16 is a veteran of the #WPD, Officer Kempf (sp) who is patrol south
community policing officer His body cam video will be shown.

Officers came over to talk to him about the incidents at the house & then they asked about seeing Miranda. When officers ask to see inside his house, he says no. As they’re about to leave, officer thinks he hears he’s talking to someone inside. “I told them you weren’t here”

Witness 17 is Officer with #WPD & worked for patrol south (SCAT) in Aug 2017. He helped with the car stop and arrest of Miranda Miller.
Video will be shown of arrest.


This lady doesn't say "who" these officer are, so I'll probably have to find those in an article maybe.

Witness 18 is Duane Hacka (sp) the property owner of the south Wichita house, where Bodine, Miranda and Evan lived.

Spring 2017 was the last time he went inside the house until he was able to on August 30, after the arrests. Landlord says at that time it was not in bad condition but in August it “was more cluttered...dirty dishes”

He says the laundry room was very cluttered. The next day he came back and Carlo was allowed inside as well. They checked the attic but no signs of Evan.

Landlord remembers Sept 2, 2017 when he discovered “a large structure”.... he didn’t know why it was so heavy. “It looked like a work bench” and had tools on top of it. Noticed fresh concrete “This was a peculiar setup”

Landlord is “freaking out” because it might be “coffin” (he takes a moment and appears to be emotional)
I got the corner chipped off and I smelled an odor (of a dead body)
“I knew it was him” and immediately called 911

Landlord initially thought it was a work bench turned upside down & it was too heavy to move.
They have a graphic video of the concrete block....

Witness 19 is EMCU Detective Jason Wait (sp).

As part of the bomb squad, he uses an X-ray machine to gain insight inside objects (in this case, the concrete structure)

Jury will see the images captured from the X-ray machine.

The structure was eventually opened with the jaws of life, after chipping away concrete on the sides. “We saw the ninja turtle blanket” and from experience, knew the smell of a dead of body.

Witness 20 is a former WPD crime scene investigator.

The concrete structure measures at 2ft x 3.8ft, 1.7ft deep

The concrete structure was too heavy to lift, but was eventually transported to the forensic science center.

Eventually, they found a teenaged mutant ninja turtle bedding wrapping Evan’s body. Family is obviously emotional when seeing these photos.

Jury returns from afternoon recess and it appears physical evidence will be shown to the jury. The crime scene investigator is still on the stand testifying.

Witness 21 is general manager at ace hardware on Seneca. There was a receipt found that listed items bought, specifically, concrete.

Receipt was from May 26, 2017 Credit card used to buy the items was that of Miranda Miller

Witness 22 is WPD officer Bryan Knowles. He went inside to search in the house, mainly basement, after the concrete slab was found and removed from the south Wichita house. There was “a lot of stuff”

He noticed two small rolls of wire meshing (matching what he had learned was discovered inside the concrete slab). He also found a yellow bag of concrete mix.

He found printouts of an ACE Hardware receipt and a receipt of a Value Place hotel stay.

Witness 23 works for Woodspring Hotels, used to be Value Place. He recovered video from July 5 to July 18, 2017 of their south Wichita hotel.

47th and Broadway hotel video will be shown to jury

Witness is excused and video is not shown. He simply explains there were cameras at their south Wichita property.

Witness 24 is a WPD investigator for violent crimes. He went to the ACE Hardware to follow up on the receipt found in the south Wichita house that Bodine, Miranda and Evan lived in.

Witness 25 is a WPD crime scene investigator. She was looking for several items during follow-up of this case, including that of a scale and a day planner.

She found the day planner (one that Carlo alluded to during yesterday’s testimony ... he said that Miranda wrote down many things in her planner)

Various prescription bottles were found in the house.

Judge says they’re going to recess for the evening. The trial begins tomorrow at 8:45am.

*Trial continues (Day 5) (@ 8:45am CT) - KS – Evan Brewer (3) (July 7, 2017, Wichita; found encased in concrete Sept. 2, 2017) – *Stephen M. Bodine (40) (BF) indicted (12/5/17) with 2 counts of 1st degree murder & 1 count of felony child abuse & 1 count of aggravated child endangerment & 1 count of aggravated kidnapping. Indicted (11/7/17) with 1 count of aggravated assault & interference with parental custody & criminal damage to property (against Evan’s father); plead not guilty; $500K bond.
5/30/18: Trial was delayed from 5/20/18.
10/12/18 Update: Motion hearing 10/12: Motion in Limine. Motion for admission of evidence pursuant to K.S.A. 60-455. State's Moiton requesting jury to view evidence pursuant to K.S.A. 22-3418. Motion for Jackson v. Denno hearing. Motion to suppress all pre-miranda statements, ante mortem photos, to limit photo evidence. State's 2nd motion to endorse. Change of venue.

*Miranda R. Miller (36) “mom” charged (11/7/17) with aggravated interference with child custody; on 12/5/17 charged with 1st degree murder & felony child abuse; plead not guilty. $500K bond.
4/16/18 update Miller took plea deal – plead guilty to 2nd degree murder, aggravated kidnapping, abuse & aggravate endangerment of child. A plea agreement with prosecutors that will put her behind bars for 27-and-a-half years in exchange for testifying against Bodine. No sentencing date available.
