Trial delays continue for man charged with killing SPD officer (with clip)

    January 16, 2019

"...Grover Cannon’s defense team requested a change in venue, saying that because of recent police deaths in Caddo Parish a jury here may be easily swayed.

Now, rescheduled for Jan. 24 at 1:30 p.m., the hearing will determine this possible change in venue. Motions and arguments will be heard as well...."

In the Courts: Change of venue approved for accused cop killer

    Jan 24, 2019

"SHREVEPORT, LA - UPDATE: The change of venue motion for the man accused of killing a Shreveport Police Officer was approved late this afternoon....

Lawyers for Cannon requested the change, claiming the shooting death of Officer Chatéri Payne would prejudice a jury against Cannon. ...

The jury will be selected from a parish outside the viewing area of local broadcast media, and will be brought back to Caddo Parish.

They will then be sequestered in local hotel until a verdict is reached.

Cannon will be back in court on Feb. 1 for a hearing on an evidentiary motion."

A jury from outside the Shreveport area will be selected for the trial of a man accused of killing Shreveport officer Thomas Lavalley.

Once the jurors are selected, they will be brought back to Caddo Parish and decide the death penalty case.

Cannon’s trial could begin as soon as seven days after the jury is paneled.

In the Courts: Judge denies accused cop killer's attempt to suppress evidence

    Feb 08, 2019

"SHREVEPORT, La. - The man accused in the 2015 death of a Shreveport Police officer today lost his bid to keep the jury from seeing certain evidence gathered by police.

Attorneys for Grover Cannon hoped to keep evidence confiscated at the time of Cannon’s arrest out of his first-degree murder trial....

Dwight Doskey, Cannon’s lead attorney, argued Cannon was unfairly searched at the time of his apprehension in the 3800 block of Jackson Street on the afternoon of August 6, 2015, and therefore things found in his pockets and taken by police should not be admitted.

Doskey passionately argued the items found in Cannon’s pockets were inadmissible in court, because Cannon was arrested in a shed behind property police did not have permission to search.

Doskey claimed that because the police only had a search warrant for Cannon, they couldn’t search places controlled by third parties without expressed permission or specific search warrants. But Prosecutor Bill Edwards countered the police had "every reason to be there," after the mother of Cannon's child told them she had taken food to Cannon on that street two weeks earlier.

Other items were removed from the shed during the investigation after Cannon’s arrest, but a search warrant specific for the area and the shed was issued....

The Cannon, team, however said they plan to file a writ with Louisiana’s Second Circuit Court of Appeals asking them to overturn Emanuel’s denial."

Although the jury will be empaneled in Baton Rouge, once jurors and alternates are selected, they will be brought back to Caddo Parish by bus where they will be sequestered in a local hotel for the duration of the trial.

Cannon jury selection progresses with hardship requests completed

    Mar 27, 2019

"...Court officials on Wednesday completed hearing hardship requests from the pool of potential jurors who will decide the case. Starting Thursday morning, attorneys begin the death qualification process.

That means they’ll quiz the rest of the possible jurors on whether they can consider voting for a death sentence if Cannon is convicted. Life in prison is the other option for a first-degree murder conviction; however, District Attorney James Stewart will ask the jury to put Cannon to death if they find him guilty.

But that decision won’t be made in Baton Rouge. Once the jury is seated, the jury will be brought to Caddo Parish, where the trial proceedings will be held...."

Jury selection continues on Day 4 of accused cop killer's trial

    Mar 28, 2019

"BATON ROUGE, La. - (KTAL/KMSS) Jury selection will continue Friday morning in the 1st Degree Murder trial of Grover Cannon, who is accused in the August 2015 shooting death of Shreveport Police Officer Thomas LaValley.

Prosecutors and defense attorneys began interviewing prospective jurors at 9 this morning and continued throughout the day until court recessed at 5 p.m. ..."

...on Monday, Emanuel denied a motion to stop jury selection before it started because the defense didn’t think there was enough minority representation, after listening to arguments from the defense and the prosecution.

On Tuesday, the Second Circuit Court of Appeal upheld Emanuel’s denial of a defense motion to stop prosecutors from admitting evidence seized at the time of Cannon’s arrest. The motion claimed the arrest affidavit used to obtain the search warrant for Cannon did not cover the evidence...."

Another motion to halt jury selection denied in trial of accused cop killer

    Mar 31, 2019

"BATON ROUGE, La. - (KTAL/KKMSS) Defense attorneys for accused cop killer Grover Cannon late last week submitted another motion to try to halt Cannon’s 1st Degree Murder trial. ...

This motion claimed jury selection violated Cannon’s constitutional rights to a fair and impartial jury because 18-to-25-year-olds were not included in the jury pool of 450 jurors called, meaning the pool was not a good cross section of East Baton Rouge voters.

In the motion, the defense submitted statistics from the 2010 census, claiming 18-to-25-year-olds represented 21 percent of the population.

According to court minutes, the motion was argued and denied. ...

Jury selection will resume at 9 a.m. Monday in Baton Rouge. "

Absence of youth from Baton Rouge jury pools prompts Louisiana Supreme Court to order hearing

    APR 7, 2019

"The Louisiana Supreme Court has ordered a state judge to pause jury selection in a capital murder trial to conduct a hearing on why young people in East Baton Rouge Parish appear to have been categorically excluded from jury service for years.

The state’s highest court directed Caddo Parish District Judge Ramona Emanuel to hold a hearing “expeditiously” over a claim by defense lawyers for accused cop-killer Grover Cannon that the 566 people summoned for his trial included no one under the age of 26....

As of Saturday, Emanuel, the judge, had not set a date for the hearing ordered by the high court."

Ruling expected Thursday on whether Cannon jury pool should be tossed

    Apr 10, 2019

"...Jury selection began March 25 in Baton Rouge in the capital murder trial of Grover Cannon, who is accused of fatally shooting Shreveport Police Officer Thomas LaValley in August 2015.

But Cannon's defense team filed a motion to halt it, claiming the lack of 18 to 25-year-olds in the pool of 566 potential jurors violate his constitutional rights to a fair and impartial jury because it was not representative of East Baton Rouge demographics.

Court administrators say a computer glitch has prevented anyone under the age of 26 from being chosen to report for jury duty in the parish since 2011.

The state's supreme court ordered District Court Judge Ramona Emmanuel pause jury selection and hold Thursday's hearing. ..."

Jury selection remains uncertain in accused cop killer’s trial

Updated April 12 at 11:05 AM

"BATON ROUGE, LA (KSLA)...According to court officials in the 19th Judicial District Court, defense attorneys for Grover Cannon have asked the Louisiana Supreme Court and the Second Circuit Court of Appeal to throw out the current jury pool....

“In any case, the Louisiana Supreme Court has the final say so. If it denies the writ, the jury selection process will move forward. If the writ is granted, then the jury selection process will end and the whole thing will have to start over again.,” said Ann McCrory, 19th JDC Administrator.

At last check, it is unclear when either court will hand down a decision. But for now, according to McCrory, the Caddo parish court officials are returning to Shreveport...."

Louisiana’s 2nd Circuit Court of Appeal in Shreveport has denied Grover Cannon’s request to restart the jury selection process in Baton Rouge.

Although jury selection was moved to Baton Rouge, the trial will take place in Caddo Parish.

Cannon’s lawyers also have filed a request with the Louisiana Supreme Court.

There is no word on when that decision will be made.

D.A. wants Cannon jury selection moved back to Caddo Parish

    April 24, 2019

"SHREVEPORT, La. -- The Caddo Parish District Attorney’s office wants jury selection in the Grover Cannon trial returned to Caddo Parish.

And prosecutors also want a gag order to stop anyone in District Attorney James Stewart’s office, the defense team and law enforcement from talking about the case, in addition to prohibiting a telephone poll of registered voters to gauge public perception about the case.

Stewart’s request is outlined in a motion filed Wednesday in Caddo District Court in response to the recent delay in Cannon’s capital murder trial....

The D.A’s motion points out the passage of time since LaValley’s death. Since the case likely would not be scheduled for trial before the summer, sufficient time will have passed to allow for impartial jury to be picked from Caddo Parish, the motion states...."

'We're kind of starting over': East Baton Rouge Parish jury pool issue resolved

    APR 29, 2019

"Jury trials that have been on hold in East Baton Rouge Parish since earlier this month will resume May 28 now that the parish's jury pool has been updated to include 18- to 25-year-olds, a court administrator said Monday.

A recently discovered computer glitch that had excluded persons under age 26 from serving on East Baton Rouge juries since 2011 caused the local District Attorney's Office to halt jury trials April 18 until the problem was fixed....

That flaw was revealed during jury selection in Baton Rouge for the Caddo case, which involves the killing of a Shreveport police officer. Jury selection in the trial of the accused killer, Grover Cannon, was moved to East Baton Rouge Parish because of pretrial publicity in the Shreveport area.

During the middle of jury selection in that case, the Supreme Court halted the proceedings and said a jury from a new jury pool that included 18- to 25-year-olds had to be picked...."

Caddo DA seeks June trial for accused cop killer

    May 10, 2019

"SHREVEPORT, La. – A June 17 trial in Caddo Parish is being eyed for accused cop killer Grover Cannon.

At least, that’s the date and place Caddo Parish District Attorney James Stewart is working towards. Defense attorneys are not on board with date – neither are they in agreement to move the trial back to Caddo Parish, according to court documents.

It’ll be up to a Caddo district judge to make the call. A date has not been set for a hearing on the matter....

Prosecutors estimate their part of the trial will take five days, and the defense says their side will last four to five days. Added to the start of that, however, is jury selection, which could take up to three weeks...."
