    The arresting officer claims he told LM about his right to a lawyer. Not sure if they have to be told about their right to consular assistance?

    Anyway, it's the officer's word against LM's. Who you gonna believe? Even if the cop is lying, people would be more inclined to believe him. That's what happens when you're a lying murderer. :dunno:

    Didn't resist arrest or try to run. Cooperated. He knew he was outnumbered. The only times we've heard of him being violent were when he was killing little kittens or had already drugged JL unconscious and had him tied up.
    No reports of him ever losing his temper and starting a fight or punching anyone (except himself according to an ex).

    I recall that the Berlin police took him away from the Internet Cafe in a Mercedes Benz. At least this "movie star" got his Mercedes ride! :lol:

    I can see where he might have been pretty confident that no one would recognize him based on the Interpol picture...

    But I don't think he was counting on that internet café employee knowing more about him than just the Interpol alert. Didn't he say he knew of him from the cat killing videos and had been following that story online? So he'd likely seen hundreds of pics of him.

    Good thing too because it doesn't seem like any of the other people in the café had a clue.

    Arrogant, then nervous, then in defeat "you got me". But in the vehicle, smiling smugly. He made international news! But he looked like crap and was wearing that stupid ugly striped tank top (according to his rather smug looking booking photo) so NO PRESS! I bet he is glad no cameras are allowed in the court room, now that he is fat (according to everybody).

    His behaviour says a lot. He was definitely on the run from something he KNEW was wrong. It does sound like he was slightly frustrated, though. Perhaps he wasn't finished yet. He posted around the internet calling himself a 'serial killer'. He didn't have a chance to become one... luckily.

    But he was looking at pictures of himself! All anyone had to do was look at his face then at his computer screen and go hmmm... Plus he's so devastatingly good looking and famous doncherknow, and he gets hounded by the press all time and the FBI were already after him for the kitten videos - or wasn't he having that delusion on this day? :huh:

    Honestly... I just can't understand him, so I'm still :fence: about the NCR thing. I'm definitely leaning more towards totally criminally responsible murderer right now, because he seemed totally calm and rational according to all the evidence so far - but I'm sure we have days and days of testimony from his psychiatrist to come - he's been diagnosed with schizophrenia for at least 14 years so there's a LOT of history to hear.

    I have no doubt that mr. devastatingly good looking, world famous model and porn star has some severe mental health issues, but that doesn't make him NCR. Not everybody who deals with mental illness is a killer, and being mentally ill does not mean he had no idea what he was doing. If he is NCR, then every other killer should be NCR, too. It must take some serious problems to go out and kill people.
    NCR just doesn't work for me. Do I think he is entitled to psychiatric care? Yes. Do I think he should ever be released into the general public? Nope. Not a chance. He is dangerous. If he gets away with this (and being released into the general public at any time in his life IS getting away with it, just like his hero Homolka), he WILL reoffend. Without round-the-clock psychiatric care, people there to make sure he takes his medication, he will stop taking his medication, seeing psychiatrists, etc. It won't be pretty.

    He needs to be kept where the public is safe from him, he is safe from himself, and NO INTERNET!!! EVER AGAIN!!!! Googling himself would surely be a trigger.

    You know, if he had been found in his apartment surrounded by JL's blood, body parts, and the aftermath of his deed, cowering with fear and paranoia, in the days after this crime took place I could honestly entertain the notion of NCR.

    If he had said to the arresting officer in the café in Berlin "I am Kirk Trammel, cannibal extraordinaire, filmaker and occasional male escort. I live to kill" maybe even then.

    But to put on his arrogant and haunty expression and say "I am Luka, the man you are looking for...you got me". Nope. Life in prison, dangerous offender status.

    At least that remains my opinion at this stage. Let's see what goodies Leclair is going to be shelling out to us on Friday. Trick or Treat. :dracula:

    I can understand why Raye is on the fence about the NCR. For one reason is that we haven't heard any medical testimony about LMs psyche. Once we hear that it will be clear to us all. Another reason why one could have doubts about NCR is the different accounts on LM persona. There are several "witness" accounts who portrait LM as an absolute villian, like he was crazy all along, even from childhood he was the odd one. There are other "witness" reports ( like the one from that John guy and there are a couple more ) which do not rhyme with the LM portraited in MSM.
    Where lies the thruth? Is an opinion from someone who ,supposedly was a lover 10 years ago , a reliable source? Or is John McKennans opinion a valid one? He surely put quite some effort to write a lenghtly blogpost about LM. To me, that's to much work for a troll ( but not for a fan ), but then again... where lies the thruth? I think we can all agree on the fact that when someone comes forward with anything positieve to say about LM, it's crushed or highly doubted at least.
    Please let me clearify that I'm no fan or anything. I just try to have a critical eye and question some things and take nothing for granted. Ofcourse LM killed JL, he admitted that! No question or doubt about that. But what I've learned is that in court, it's not always Lady Justice who wins, but the one who has the better/believable story

    I think the major problem, in my opinion, with a NCR verdict is that there is a very high potential for Magnotta, or others who are dangerous, to be released back into public. Say he goes through his treatment, 'experts' say he is 'ok' and he is out in a couple years. Mental illness never really goes away. It is a life long struggle. It appears Magnotta has a history of not completing, or following through with, his treatments. So what happens next? It just doesn't seem like the ideal situation for anybody. The safety of the public OR even Magnotta and his mental health. So maybe after a few years in psychiatric care he is doing great. He is released, is inconsistent with ongoing treatment, and relapses. That is just as bad and dangerous for him as it is the general public.

    You are right about about that. Unfortunatly my knowlegde about Canadian/Quebec law concerning NCR or anything along those lines is pretty much non exsistent. In my country we have something like "Under his Majesty's service", i think thats the english term for it. It just means that you are forced to be treated and hospitalized for your mental illness by the command of the judge. And every two years there is an evaluation in court if the person may or may not return ( partially ) in society. But this doesn't mean you are fully NCR. There are plenty of cases where incarsination and "under his Majesty's service" were applied, so i.o.w partial NCR. Could that also happen in Canada, that you can get both? In jail as punishment and forced treatment as a measure/concequence? And isn't there any law that if an offender returns into society, he is placed under a supervision?

    Am I the only one who was surprised the Crown didn't have any experts on mental health issues and NCR? I would have thought that they would have requested a psychological evaluation of him. Or are they just hoping to be able to get results from cross examining the defense experts? Seems strange to me because we know they will only put on experts that support their claim that he is NCR.

    I'm thinking that La Colosse either doesn't exist, or was just some dude he met over the internet but never came forward.
