Mark Sievers - Jury Selection

Typically the jurors will be from either the county, where the offense occurred, or they will be from another county, but they still have to be brought to the original place / county of where the offense was committed. You may want to ask AZLawyer.

2005 Florida Code - :: CRIMINAL PROCEDURE AND CORRECTIONS :: JURISDICTION AND VENUEChapter 910

..and specifically on Chapter 910 sub.ch. 910.03 Place of Trial generally:

(3) If a court finds that a fair and impartial jury cannot be impaneled in the county where the offense was committed, and the court determines that once a jury is selected it shall be sequestered, the court on its own motion, or upon a motion of any party, may elect to select a jury from a county other than where the offense was committed. The selection of the alternative county will be governed by the requirements of subsection (2). Upon completion of jury selection, the jury shall be brought for trial to the county where the offense was committed.


(Or the judge orders a change of venue, then this s.ch. applies)

(2) After a court orders a change of venue and in order to protect the defendant's due process rights, the court, upon a motion of any party, shall give priority to any county which closely resembles the demographic composition of the county wherein the original venue would lie.

*Trial continues with Jury Selection (Day 5) (@ 8:30am ET) – FL – Dr. Teresa Ann Grace Sievers (46) (June 29, 2015, Bonita Springs) – *Mark D. Sievers (50) arrested & charged (2/26/16) & indicted (5/4/16) with 1st degree premeditated murder & conspiracy to commit 1st degree premeditated murder. Plead not guilty. No bond. DA will seek DP.
Trial set to begin on 11/12/19 with jury selection. Trial expected to last 5 weeks.

11/15/19 Day 4 of Jury Selection: 64 potential jurors for today’s Round 2 of questioning on DP. Judge Kyle told a group of about 20 people who came in this morning to come back instead on Monday afternoon. Judge Kyle: "The panel has shrunk". And shrinking quickly this morning. 10 potential jurors have already been sent home since 8:30am. Some for being against death penalty, others now with work or medical issues that weren't brought up earlier in questioning. Jury selection continues to Monday, 11/18.
*Jimmy Ray Rodgers (28) – Trial 10/23/19: Jury found Rodgers guilty of second degree murder, not guilty of conspiracy, guilty of trespassing. Sentencing on 12/12. Motion for new trial-denied.
*Curtis Wayne Wright, Jr. (41) arrested (10/14/15) & charged (10/20/15) & indicted (5/5/16) with 2nd degree premeditated murder. Plead not guilty. No bond. Took plea deal (2/26/16) plead guilty to 2nd degree murder; serving 25 years, waives all rights to appeal. Will testify at trials. Sentencing on 12/2.

Judge says 22 more potential jurors will be questioned today.

24 have already passed to general voir dire phase.

Court will need to keep at least 20 potential jurors from today's pool to meet their goal of just over 40 potential jurors for general voir dire.

First potential juror questioned is excused after privately discussing some matters with both parties and the judge.
