Peterson lawyers cite attorney, judge mistakes in appeal

Drew Peterson continued the uphill battle to overturn his murder conviction this week, as his lawyers filed an appeal arguing that both his former defense attorney and the trial judge made mistakes that prejudiced the jury against him.

In a filing mailed to the 3rd District Appellate Court late Monday, Peterson's team states that Will County Judge Edward Burmilla erred when he admitted controversial hearsay evidence and allowed a pastor to testify about conversations he had with Peterson's fourth wife, Stacy. It also criticizes Burmilla for permitting divorce attorney Harry Smith to testify about a telephone call in which Stacy indicated Drew had killed his third wife, Kathleen Savio.

These errors, taken in their totality, stripped Peterson of his right to a fair trial, the appeal states.

Drew Peterson facing loss of police pension

Under Illinois law, the board could revoke Peterson’s $79,000-a-year pension if it finds he used his law-enforcement powers or skills to drown his third wife, Kathleen Savio, in 2004.

"By reason of the aforesaid felony conviction, I believe there exists sufficient evidence, upon which the Board may proceed to conduct a hearing to consider termination of Peterson's pension benefits," Atwell wrote in the letter, which the Tribune obtained under the Freedom of Information Act.

Drew Peterson Tried to Hire Hit Man to Kill Will County State's Attorney: Officials

Attorney General Lisa Madigan and Randolph County State’s Attorney Jeremy Walker filed a two-count criminal information against Peterson, currently an inmate at the Menard Correctional Center, charging him with one count of solicitation of murder for hire and one count of solicitation of murder, both Class X felonies.

Drew’s back: Ex-Bolingbrook cop set for trial — again

"Drew Peterson once warned a judge, “I don’t do well in incarceration.” He made the comment in February 2013, having already spent nearly four years in solitary confinement. Within moments, the judge would sentence him to 38 years in prison for the 2004 murder of his third wife — a sentence Peterson has mostly served in downstate Menard Correctional Center, home to Illinois’ most violent criminals."

Attorney: Drew Peterson ‘Probably Better Off’ In Federal Prison

"The reason for convicted wife killer Drew Peterson’s transfer from an Illinois prison to a federal facility in Indiana remained a mystery.. IDOC's decision to transfer Peterson out of its custody had no connection to the ongoing investigation into Stacy Peterson's disappearance."

"SPRINGFIELD, Ill. • The use of hearsay testimony to convict former Chicago-area police officer Drew Peterson in the death of his third wife was proper, the Illinois Supreme Court ruled Thursday in upholding the conviction.

The high court, in a unanimous decision , found that hearsay testimony from Peterson's dead third wife and missing fourth wife did not violate his constitutional right to confront his accusers because of evidence that Peterson killed them to prevent their testimony."

Drew Peterson's Sister-in-Law Champions Mission to Help Abuse Victims

Norma Peterson is executive director of Document the Abuse, an organization that brings awareness to the Evidentiary Abuse Affidavit.

The Evidentiary Abuse Affidavit (EAA) is a prevention tool used to allow a victim of abuse to document information that could be used in an investigation if someone should be killed or go missing.

"It’s going to help the state’s attorney by having victims be able to assemble all of their facts, their figures, their pictures, all in one place," Norma Peterson said. "If you’re not here to speak on your own behalf, it is a powerful thing that a prosecutor can use and bring your own voice in."

Norma Peterson is partnering with the Kane County Sheriff and Kane County State’s Attorney to highlight the affidavit.

"Due to the intense trauma that a victim suffers, it is common that they forget incidents or specific details. The evidentiary abuse affidavit will make it easier for us to support and help victims through criminal prosecution,” said Kane County State’s Attorney Jamie Mosser. “We are eternally grateful for the work that Norma Peterson has done over the years to help give a voice to victims and survivors. We look forward to continue working with her while protecting the victims of Kane County.”

Norma Peterson said she has assisted victims to create their personal EAA and is currently working with local law enforcement and legislators to establish the EAA as part of their domestic violence protocol.
 
Drew Peterson Wants Conviction Tossed, Heads Back To Will County

JOLIET, IL — Acting as his own counsel, convicted killer Drew Peterson is hoping to overturn his first-degree murder conviction for the 2004 death of his third wife, Kathleen Savio, of Bolingbrook. Will County Judge Ed Burmila has scheduled a motion hearing for 9:30 a.m. Jan. 7 in Courtroom 801 at the new Will County Courthouse, Joliet Patch has learned.

In November, Judge Burmila issued the following ruling in Peterson's case: "After having considered the petition, exhibits and applying the law the Court finds that (the) Defendant has presented the 'gist of a constitutional' claim," court records show. "Defendant's request for the appointment of Counsel is reserved."

Nowadays, the 67-year-old former Bolingbrook police sergeant is serving his prison sentence at the Indiana State Prison in Michigan City. There, Peterson is known as Indiana Department of Corrections inmate #279193.
