Investigators have been scouring all over Florida looking for the girl since she disappeared, but family told Fox 4 that they don't know where the investigation stands at this point, and that they get most of their information from the media.
"We've been kept in the dark about a lot of things," said Diana's cousin NM (redacted). "We would just like a little bit more cooperation from law enforcement at this point."

LCSO looks in Osceola County, finds no new info in Diana Alvarez case

The family of missing Diana Alvarez said Lee County Sheriff’s Office detectives searched an area in Osceola County this week but turned up no new evidence of 9-year-old Diana.

LCSO detectives were in the Yeehaw Junction area on Wednesday as part of an ongoing investigation into the girl’s disappearance.

“Our detectives are continuing their active investigation regarding the Diana Alvarez case,” a public information officer for the LCSO confirmed and added that detectives had concluded their activities and were not there on Thursday.

A pretrial conference for Guerrero-Torres is scheduled May 9 with jury selection and trial scheduled for May 11.

Child *advertiser censored* case proceeds for man suspected in Alvarez disappearance

A federal judge will allow lewd photos of missing 9-year-old Diana Alvarez to be shown at trial in the child *advertiser censored* case against Jorge Guerrero-Torres.

U.S. District Judge Sheri Polster Chappell on Friday denied a motion to suppress evidence of pornographic images that investigators say they found on the defendant's smartphone.

Guerrero-Torres said in court that on a day in early June when detectives contacted him for an interview about Diana, he threw his phone away in a ditch near an apartment complex in Orlando, where he had moved for work, after heavy rains made the phone wet and rendered it useless.

Case law states that when a person voluntarily abandons property, that person's expectation of privacy is lost and he or she can’t seek to suppress evidence seized from the property.

[Prosecutor] Casas additionally argued that Guerrero-Torres didn’t intend to get his phone back even after learning that someone found the phone and that it was functional. The prosecutor went as far as to call a witness on Thursday who testified that the defendant was planning on fleeing to Texas or the Mexican border.

Lee County Sheriff’s deputies had probable cause to arrest a man on kidnapping charges after the disappearance of a 9-year-old girl from her San Carlos Park home, court documents show.

But Jorge Guerrero, who was named in the AMBER Alert for Diana Alvarez, was instead arrested in a child *advertiser censored* case. Graphic images of Alvarez were found on a cellphone belonging to Guerrero.

The lack of an arrest related to Alvarez’s May 29, 2016 disappearance could be a strategic move related to a possible plea agreement, said Lance Dunford, a Fort Myers attorney who isn’t connected to the case.

A jury was seated Friday afternoon in the federal child *advertiser censored* trial against Jorge Guerrero, also accused in the disappearance of Diana Alvarez.

In opening statements, the government described it as a case of betrayal after Guerrero lived in Diana's family home and took advantage of the circumstances. The defense suggested the jurors should consider whether the photos involved are in fact pornographic images that involved a child.

We do know before the trial started, Guerrero had no interest in accepting a plea deal that would ensure him a lower sentence.

The jury was released for the weekend after the government moved through a quick four witnesses before 5 p.m.

The court is in recess now until first thing Monday morning. It's expected to last nearly a week.



'A case about betrayal': Trial begins for Diana Alvarez suspect

[U.S. Attorney Jesus] Casas’ opening statement told the story of Guerrero-Torres, a man who “claimed he loved Diana and that she loved him,” Casas said. Guerrero-Torres, the prosecutor said, rented a room in the home of Diana’s parents and during that time he would go into Diana’s room and “the two would do things."

Keep an open mind,” Roger Azcona, Guerrero-Torres’ attorney, said during opening statements. “When you see and hear the evidence, you will see the government will not meet their burden.”

A Florida Department of Law Enforcement agent had already interviewed Guerrero-Torres once on the day Diana went missing. Two days later, on May 31, 2016, Lee County Sheriff's Office Detective Fortunato “Fred” Mazzotta boarded a helicopter and landed in an Orlando municipal airport. He was scheduled to meet with the man about the missing child case.

But in the almost 20-minute ride from the airport to Guerrero-Torres' home, the defendant fled, Mazzotta testified. But, Guerrero-Torres left behind his phone. He threw it into a flooded swill about a mile away from his apartment, Mazzotta said. It was later found by a landscaper.

Guerrero-Torres was finally captured in Okeechobee on June 3 after a woman who was asked to help him flee turned him in instead, Casas said. Her husband saw Guerrero-Torres was wanted by law enforcement after he fled his Orlando apartment to Okeechobee. The woman, named Antonia Aguilar, was directed to pick him up and after she did, the vehicle they were in was pulled over by waiting law enforcement.

She testified in Spanish about what she called an affectionate relationship that had been developing between defendant Jorge Guerrero and Diana Alvarez, the missing girl. Guerrero is accused of possessing lewd images of Diana, who was 9 when she went missing nearly a year ago. He has not been charged in her disappearance.

The prosecution plans to show those photos to the jury on Tuesday. Prosecutors will also be allowed to show interrogation video of Guerrero admitting to a sexual relationship with Diana.

The family of Diana Alvarez spent Wednesday celebrating their oldest daughter, despite the continued search for the now-10-year-old.

Rita Hernandez, Diana's mother, cracked a quick smile as she reminisced about Diana's birthday last year, when the little girl asked for her favorite dish and then the family had cake. Two weeks later, she was gone.

Hernandez had a plea for Guerrero's brother, whom she thinks may know something.

"Jorge's brother, Teto, if he knows where Diana is at, to come forth and say where she is at."

Hernandez said she's in pain but will never give up hope, and on her daughter's birthday, she had a wish.

"For my daughter to come back to me, to us, to the family. My only wish is to see her."
