One of the FBI's key undercover agents brought into the plot as an 'explosives' expert is expected to testify Monday.

The agent, known as "Red" was with the suspects during the nighttime surveillance of the Governor's cottage and offered to gather $4,000 in explosives to blow up a nearby bridge to slow response time.

Defense attorneys have previously argued "Red" tricked suspects to meet up with a promise of beer and wings at Buffalo Wild Wings the night the FBI arrested the suspects Oct. 7, 2020.

Under questioning by Daniel Harris's attorney Julia Kelly, Kaleb Franks said he had $23 in cash in his pocket when he was arrested for buying a bomb in a Ypsilanti parking lot but had no intention of buying a bomb.

"Red" is one of at least 12 informants prosecutors used in the kidnapping case, court records showed.

On Friday, a 24-year-old Detroit area carpenter Joshua Miller testified he left the Wolverine Watchmen in July 2020 after attending two training sessions with the group. Miler said he officially decided to leave the group when they talked about their concerns about a fed being in the group.

"It wasn't something I wanted to be a part of," Miller said in his testimony Friday.

FBI Special Agent Brian Clark testified he recovered flex cuffs, zip ties, an AR-15, a loaded Smith and Wesson and hundreds of rounds of ammo during the raid of Adam Fox's apartment, in the basement of a Grand Rapids vacuum shop.

3/29/22 Tuesday, Trial Day 11: Before testimony begins today, Judge Robert Jonker has already ruled that Daniel Harris' 15 notebooks (exhibit 407) found in his home the night of his arrest will not be admitted to evidence. He said there's not enough relevance...plus there's 15 of them.
Government witness: Thomas Szymanski, a special FBI agent from the Baltimore office who was investigating Barry Croft with Agent Christopher Long, who already testified. Several FBI agents (no info on names).

Prosecutors rest their case in Gov. Whitmer kidnap trial

One of the last witnesses for the government was the longtime companion of Barry Croft Jr., an alleged leader of the scheme.

“He was antigovernment,” Chastity Knight of Bear, Delaware, told jurors in Grand Rapids, Michigan. “He just thought the government’s not for him. The government doesn’t help the people out. They like to line their own pockets.

Knight, 40, cried as she identified one of Croft’s daughters as the person who offered him a chip during a training session with weapons in Luther, Michigan.

“Honey, I’m making explosives. Can you get away from me, please? ... I love you. Get out of here,” Croft said in secretly recorded remarks.

Prosecutors rested their case.
Defense lawyers asked for a direct acquittal, a standard step in a criminal trial, arguing there wasn’t sufficient evidence to give the case to a jury. But U.S. District Judge Robert Jonker quickly swept it aside & especially noted the detailed testimony of two star witnesses who pleaded guilty, Ty Garbin & Kaleb Franks.
Defense witnesses: Megan Cooley, friend of Harris. At least five people said they would assert their right to remain silent if called to the witness chair including Steve Robeson, who switched sides during the investigation & tipped off Croft that the FBI wanted to arrest him, according to the government. The others who invoked the Fifth Amendment had participated in training as well as discussions about the plot but have not been charged.
The judge pressed lawyers to indicate soon whether Fox, Croft, Harris or Caserta will testify. The attorneys claim the group was engaged in a lot of crazy talk fueled by agents, informants & marijuana but not a conspiracy. Daniel Harris might be taking the stand.

Jury handed case of 4 men charged in Michigan governor kidnapping plot

April 1 (Reuters) - A jury will begin deliberations on Monday in the trial of four men charged with conspiring to kidnap Michigan Governor Gretchen Whitmer, as one of the most closely watched trials in recent memory involving allegations of domestic terrorism neared its conclusion.

The 12-person jury was presented with dueling narratives during closing arguments that concluded late on Friday afternoon. Granted the option by U.S. District Judge Robert Jonker, jurors chose to start discussing the case on Monday.

On Friday, jurors heard a government prosecutor describe the defendants as "filled with rage" and bent on sparking a civil war, followed by defense attorneys who accused the FBI of entrapping their clients, who they said were often high on drugs and prone to "crazy" talk rather than concrete action.

The attorney for Fox, who prosecutors have accused of being the ringleader of the plot, argued that his client was lured into actions by FBI informants and was vulnerable to entrapment due to his heavy marijuana use.

GRAND RAPIDS, Mich. — The government’s accusations were jarring: Several men with militia ties had schemed to abduct Gov. Gretchen Whitmer of Michigan at her vacation home. The group, prosecutors and witnesses said, had held a series of “field training exercises” and discussed killing or stranding her in a boat in the middle of Lake Michigan.

The men on trial at the federal courthouse in Grand Rapids were among 14 arrested in October 2020, before there was any attempt to carry out a plan. Jurors briefly began deliberations on Friday afternoon and were scheduled to resume those discussions on Monday.

During closing arguments, defense lawyers asserted that there never was any firm plot to abduct Ms. Whitmer, a Democrat, and that the defendants, who could face life in prison if convicted, were lured into the discussions by a network of F.B.I. informants and undercover agents. Prosecutors described the defendants — Brandon Caserta, Barry Croft, Adam Fox and Daniel Harris — as threats to America’s democratic order who spoke openly about political violence as their frustration with Covid-19 restrictions mounted before the 2020 election. Ms. Whitmer, a first-term governor with a national profile, took a more restrictive approach to the pandemic in 2020 than some other Midwestern governors, keeping many rules in place even when case numbers dropped.
 
I know this case and their wacky ideas involves more than just Covid, but seriously, these guys were going to kidnap a sitting governor over wearing a dang mask and trying to keep people alive during a worldwide deadly pandemic. Because that is somehow tyranny?

It baffles me.

And you can talk crap any old time, it's when you do things like building a fake house to practice and trying to buy explosives that it becomes more than just crap talk.

It’s just bananas that we live amongst idiots like this. Thankfully they weren’t bright enough to pull this off. I haven’t followed this closely, but recall reading about it when it happened. Without the FBI informant, I wonder if it truly would have happened. I somewhat feel bad for some of these “kids” in that they seemed to get in over their heads, but I believe they would have followed thru. IMO they should all serve time in prison.

(Federal case) (@ 10am CT) - MI – Plot to kidnap Michigan Governor Gretchen Whitmer - *Adam Dean Fox (38/now 39) (born 1983) of Grand Rapids, *Barry Gordon Croft, Jr. (44/now 45) (no birth date given) from Bear, Delaware (waiting to be extradited to MI), *Daniel Joseph Harris (23/now 24) (born 1997) of Lake Orion & *Brandon Michael-Ray Caserta (32/now 33) (born 1988) of Canton arrested & charged (10/8/20) & indicted (12/17/20) with conspiracy to commit kidnapping. All charged with a federal crime. All are being held without bond. All plead not guilty (12/17/20).
*Adam Dean Fox additional charges (4/28/21) with knowingly conspiring to use weapons of mass destruction against persons or property in addition to the kidnapping conspiracy charged in October 2020. The superseding indictment further alleges that Fox, Croft & Harris intended to use the devices to destroy a nearby bridge, in effect, harming & hindering the governor’s security detail and any responding law enforcement officers.
*Barry Gordon Croft, Jr. additional charges (4/28/21) with knowingly conspiring to use weapons of mass destruction against persons or property in addition to the kidnapping conspiracy charged in October 2020. 3/31/22 Thursday, Trial Day 13-Addition: Joshua Blanchard, Croft's lawyer, did end up calling an FBI agent to testify: Special Agent Jayson Chambers, who testified that he texted a colleague that he would treat the Wolverine Watchmen as a terrorism enterprise investigation. The defenses rested their cases.

4/1/22 Friday, Trial Day 14: On Friday, jurors heard a government prosecutor describe the defendants as "filled with rage" & bent on sparking a civil war, followed by defense attorneys who accused the FBI of entrapping their clients, who they said were often high on drugs & prone to "crazy" talk rather than concrete action. The 12-person jury was presented with dueling narratives during closing arguments that concluded late on Friday afternoon. Granted the option by U.S. District Judge Robert Jonker, jurors chose to start discussing the case on Monday. Jurors briefly began deliberations on Friday afternoon & were scheduled to resume those discussions on Monday, 4/4/22.

*Ty Gerard Garbin (24) - plead guilty (1/27/21) to kidnapping conspiracy & was sentenced (8/25/21) to 6 years & 3 months in Federal prison. Garbin will testify at the trial of the other defendants. Lengthy testimony & repeated debriefings have been critical in building a case to counter defense arguments that revolve around free speech issues as well as accusations of entrapment by federal undercover informants, Nils R. Kessler, the lead U.S. attorney on the case.
Kaleb James Franks (26) – Plead guilty (2/7/22) to kidnapping conspiracy. Will testify at trial & will be sentencing afterwards.
(State: for Antrim County on 4/14/21 & Jackson County on 8/8/22 & trial starts 9/12/22).
