Whitmer kidnap case: Adam Fox says he was high in FBI meetings

"Throughout this four-month time-period informants and agents observed Fox regularly smoking marijuana. They were aware of Fox’s chronic marijuana use throughout the months of activity," Gibbons argues in his court filing, alleging the FBI took advantage of his client's weed-induced "condition."

Full disclosure: I smoke. I've never plotted to kidnap anyone. This is a ridiculous, laughable defense. Weed is also 100% legal in Michigan. Adam Fox, going with the waccy tobaccy defense. :rolleyes:

12/6/21 Update: Motions hearing rescheduled on 12/20/21.
12/20/21 Update: Morrison, Musico & Bellar appeared before Jackson Circuit Judge Thomas Wilson on Dec. 20 for a hearing on three motions related to their cases, including a motion from their attorneys to quash binding over of their cases from district court for trial in circuit court. Motions to dismiss the cases of three men charged with providing support in a plot to kidnap Gov. Gretchen Whitmer were denied by Judge Wilson. But the Judge permitted additional time for the attorneys to obtain & review discovery before filing legal motions on how their clients have purportedly been unjustly charged with crimes. Prosecutors presented their own motion to reinstate charges against Morrison & Musico for making a threat of terrorism, & also moved to add this charge to Bellar’s case as well. Judge Wilson denied this motion, agreeing with the defense attorneys that there was no evidence showing a threat had made to the public, as statements made by the defendants were made internally among the group. A follow-up motion hearing regarding an entrapment motion is scheduled to take place 2/23/22. In preparation, Kirkpatrick stated he will subpoena the FBI for information regarding the federal investigation into the Wolverine Watchmen. Judge Wilson agreed to grant a request from Bellar to travel to a brother’s wedding in Florida. The judge also approved a bond reduction request for Morrison to $5K cash/surety, providing he will wear a GPS tether.
Musico & Morrison are founding members of the Wolverine Watchmen. Morrison is considered Watchmen’s “Commander” & is known by the online moniker “Boogaloo Bunyan”.
Accomplices: Eric Molitor, Michael Null, William Null, Shawn Michael Fix & Brian Higgins – all charged with State crimes (Antrium County). Molitor, Null, Null & Fix on 4/14/21 & Higgins on 11/19/20.
Adam Dean Fox, Barry Croft, Kaleb James Franks, Daniel Joseph Harris, Brandon Caserta. Gerard Garbin plead guilty on 1/27/21 to kidnapping conspiracy & was sentenced on 8/25/21 to 6 years & 3 months in Federal prison. Kaleb James Franks plead guilty (2/7/22) to kidnapping conspiracy. Will testify at trial & will be sentencing afterwards. All charged with Federal crimes; trial to start on 3/8/22.

Although this group has not had much MSM publicity since 12/20/21, seems they did have motions hearing [Entrapement]on 2/23/22. The hearing resumes on Monday when the informant is expected to testify. But nothing on the calendar about future events.

Paul Bellar, middle, appears before Jackson Circuit Judge Thomas Wilson on Wednesday, Feb. 23, 2022 for a hearing on an entrapment motion. Bellar, Joseph Morrison and Pete Musico are accused of being involved in a plot to kidnap Michigan Gov. Gretchen Whitmer. Joseph Morrison and Musico, cofounders of the Wolverine Watchmen militia group, are accused of providing materials and assistance to group members by conducting tactical training on Morrison’s Munith property. The pair are charged with one felony count each of gang membership, providing material support for terrorist acts and felony firearms. Paul Bellar, 22, a member of the group, is charged with one felony count each of providing materials to support terrorist acts, attempt to commit felony as an associate or member of gang and felony firearms.

Side-by-side in a wooden pew, dressed in crisp suits and button-downs, three men looked on as spectators while their attorneys made their case for deliverance from the reported injustice of the accusations against them.

But their own reported utterances —“let’s get that b---- as she goes out the emergency exit,” “this is about pointing rifles at f----ing police officers and f---ing politicians and squeezing the f---ing trigger,” “heard we have the same goal”— at an armed rally, at a weapons training, and in secret group chats may determine the fate Jackson County Circuit Court Judge Thomas Wilson chooses for three men accused of supporting others in an alleged plot to kidnap Michigan Gov. Gretchen Whitmer.

Pete Musico, 44; his son-in-law, Joseph Morrison, 27, and Paul Bellar, 23, appeared Wednesday in Jackson County’s 4th Circuit Court to argue they were entrapped by the FBI and an informant and otherwise wouldn’t be facing charges of providing material support to a terrorist act, charges connected to gang membership, and charges of carrying a firearm in the commission of a felony. They are seeking to have the case dismissed ahead of trial.

Speaking after the hearing, after the defendants filed passed declining comment, Morrison’s lawyer, Nicholas Somberg, pointed to testimony from Impola that the specific plot hadn't been solidified until later in 2020.

Somberg said that was after Fox came to train at the Munith property with the men, and after the informant Dan left their Watchmen group.

As for the entrapment hearing, he said: "We'll see when we actually have Dan on the stand. I mean, it's a hard motion to win. But I'd still think we'll win at the end of the day."

Dan is expected to testify Monday when the entrapment hearing resumes.

In the meantime, the defense team got one win Wednesday, with Wilson granting Morrison the OK to leave his property to work with Musico for their chimney sweeping business. Morrison had remained locked up through December — the longest of the defendants — with prosecutors arguing he was the highest risk on release.

He'll remain on a GPS tether and Wilson promised to review records of his movements weekly.

Last hearing for everyone except Higgins was on 4/14/21 & Higgins was extradited on 8/4/21 from Wisconsin to Michigan which was appealed & last hearing on 11/19/20.

Yes -- last I recall [8/21] Brian Higgins was in Columbia County, WI but was to be extradited to Michigan despite an appeal. He was released on bond w/ankle monitor. I don't know any of the others. Seems they were part of the weakest link.

Going thru some oldies - was wondering about the State - Antrim County gang - that would be Eric Molitor, Michael & William Null, Shawn Fox & Brian Higgins.

Last hearing for everyone except Higgins was on 4/14/21 & Higgins was extradited on 8/4/21 from Wisconsin to Michigan which was appealed & last hearing on 11/19/20.

OK, found nothing for Shawn Fox in either Circuit or District Courts.

Please see case numbers and entries above for Higgins, Molitor, and the Null brothers. All are released on bond, and their cases are before Judge Stepka.

The case details above took me all afternoon to pull up-- the docket and case filters are extremely slow!

Except for Higgins with Dec 2021 competency report stipulation notes, the last update or activity was Oct 2021, There are no hearings/court dates on the record. I'll be surprised if these charges move forward. MOO

*Motions Hearing for all (State case-Jackson County) (@ 9am CT) - MI – Plot to kidnap Michigan Governor Gretchen Whitmerfor *Paul Edward Bellar (21/now 23) of Milford arrested & charged (10/7/20) & arraigned (10/20/20) with gang membership, providing material support for terrorism & carrying or possessing a firearm during the commission of a felony. Was arrested in Columbia, SC & Michigan attempting to have him extradited to Michigan. $500K Cash Surety Bond. Bond reduced to $75K (12/18/20) with restrictions. Bond @$150K (3/29/21). Out on bond.
*Charged (5/17/21) in Circuit Court with terrorist acts-provide MA, gang membership felonies & felony firearms.
for *Joseph Matthew Morrison (26/now 27) of Munith arrested & charged (10/7/20) & arraigned (10/9/20) with threat of terrorism (charge was dismissed on 3/29/21), gang membership, providing material support for terrorist acts & carrying or possessing a firearm during the commission of a felony. Bail set at $10M. Bond reduced (12/18/20) to $75K with restrictions.

Bail set at $10M. Bond reduced (12/18/20) to $100K with restrictions. Out of jail.

12/20/21 Update: Morrison, Musico & Bellar appeared before Jackson Circuit Judge Thomas Wilson on Dec. 20 for a hearing on three motions related to their cases, including a motion from their attorneys to quash binding over of their cases from district court for trial in circuit court. Motions to dismiss the cases of three men charged with providing support in a plot to kidnap Gov. Gretchen Whitmer were denied by Judge Wilson. But the Judge permitted additional time for the attorneys to obtain & review discovery before filing legal motions on how their clients have purportedly been unjustly charged with crimes. Prosecutors presented their own motion to reinstate charges against Morrison & Musico for making a threat of terrorism, & also moved to add this charge to Bellar’s case as well. Judge Wilson denied this motion, agreeing with the defense attorneys that there was no evidence showing a threat had made to the public, as statements made by the defendants were made internally among the group. A follow-up motion hearing regarding an entrapment motion is scheduled to take place 2/23/22. In preparation, Kirkpatrick stated he will subpoena the FBI for information regarding the federal investigation into the Wolverine Watchmen. Judge Wilson agreed to grant a request from Bellar to travel to a brother’s wedding in Florida. The judge also approved a bond reduction request for Morrison to $5K cash/surety, providing he will wear a GPS tether.
2/23/22 Update: Morrison, Musico & Bellar appeared before Jackson Circuit Judge Thomas Wilson on Wednesday for a hearing on an entrapment motion. Present: Assistant Attorney General Sunita Doddamani, defense attorney Nicholas Somberg (Morrison's attorney), defense attorney Kareem Johnson (Musico's attorney) & defense attorney Andrew Kirkpatrick (Bellar's attorney). FBI special agent Henrik Impola testified. Judge Wilson granted Morrison the OK to leave his property to work with Musico for their chimney sweeping business. Morrison had remained locked up through December with prosecutors arguing he was the highest risk on release. He'll remain on a GPS tether & Wilson promised to review records of his movements weekly. Informant Dan is expected to testify Monday, 2/28/22 when the entrapment hearing resumes.
Musico & Morrison are founding members of the Wolverine Watchmen. Morrison is considered Watchmen’s “Commander” & is known by the online moniker “Boogaloo Bunyan”.
Accomplices: Eric Molitor, Michael Null, William Null, Shawn Michael Fix & Brian Higgins – all charged with State crimes (Antrium County). Molitor, Null, Null & Fix on 4/14/21 & Higgins on 11/19/20. No update as of 2/28/22
Adam Dean Fox, Barry Croft, Kaleb James Franks, Daniel Joseph Harris, Brandon Caserta. Gerard Garbin plead guilty on 1/27/21 to kidnapping conspiracy & was sentenced on 8/25/21 to 6 years & 3 months in Federal prison. Kaleb James Franks plead guilty (2/7/22) to kidnapping conspiracy. Will testify at trial & will be sentencing afterwards. All charged with Federal crimes; trial to start on 3/8/22.
