CENTREVILLE, Mich. (WOOD) - Phone records were on center stage in early testimony Wednesday in Doug Stewart's murder trial.

As soon as a representative from Cox Communications took the stand, the defense objected. Attorneys Jeffrey Schroder and Kymberly Schroder wanted the phone records not to be allowed into evidence. They claim they did not get them in advance and introducing them in court is an "unfair surprise."





Prosecutor John McDonough then brought Lauren Newell to the stand. She works for Langley Federal Credit Union in Newport News, Virginia, and testified about Doug's bank records.

She said there was a debit made at a Wendy's restauratn on April 15, corresponding to what Rick Spencer testifed earlier. The prosecution also entered a picture of Doug taking money out of a Virginia ATM.

The Wal-Mart employee identified the man as DS.

ETA: What day did R. Spencer say was the original day of the plan but DS decided not to do it because he got pulled over??? Wasn't it April 15? If so, this is very interesting.

My husband came home three days ago after being away with work for three months... so haven't really had much time!!

It is a receipt from register #74 in the garden center where the customer made the purchase of the shovel and the tarp.
The store # is on the recipt. Store #1333
Unable to read the date. Reciept is damaged.
Time is 6:44 pm.

Defense objects because the date can not be read.

A duplicate reciept was pulled up and given to LE during the investigation from Wal-Mart's electric journal.
The date on the duplicate receipt was 4/25/2010.

Evidence is being challenged due to lack of foundation and that it is hear say.

Judge says reciept can be accepted and it matches. It's not hear say.
#171 can be admitted as evidence.

Only the UPC for shovel is readable.
Some of the UPC can be read for gloves.
Very little of the UPC for the tarp and cap can be read.

Witness is being shown packaging for Ozark Trail tarp. Blue.
8' x 10'

Tarp on receipt was 8' x 10' tarp.
The UPC on tarp wrapper match the numbers that can be read on the receipt.

Witness says no way to tell for certain that wrapper is from a tarp purchased at that store.

Multiple Walmart employees describing their interactions with Doug. Everyone remembers the shorts Doug was wearing that day. He was wearing bright color swim type trunks with flowers on them so they stood out, especially in late April in Ohio. He bought the tarp, shovel, gloves and duct tape, and asked an employee about buying lime, which they didn't have.

I'm thinking if I was him I dang sure would not be smiling right now!

IMO there was a lot of evidence brought forward today that may just put him away for life.

Did Ricky Spencer's parents testify on Mon 2/28 or was reporter just mentioning them?

What is the name of the OH trooper who pulled Doug over 4/15?

What is the name of the MSP trooper who testified the first day 2/23 (one is Todd Peterson, who is the other)?
