    Warrants: Heather Elvis kidnapped, murdered at Peachtree Landing

    Capt. Dale Buchanan with Horry County Police said, "We have evidence that will be processed with us. SLED is assisting us with processing some of the forensic evidence. Is some of that evidence DNA? Yes."

    The murder charges were announced at a news conference Monday morning, and comes in addition to the kidnapping, obstruction of justice, and indecent exposure charges against the couple arrested Friday. Authorities confirmed in a news release that both Moorers are accused of murdering 20-year-old Heather Elvis.

    Sounds like that is a possibility. Praying Heather is found soon so all charges and penalties are open for consideration.

    I wish it was on the table now. I understand why it isn't but IMO someone would roll if they were facing the DP. Roll in hopes of getting LWOP instead. JMO

    I posted this yesterday in thread 30 right before it was shut down to open up all these other threads! :scared: Still trying to figure this all out, as I'm sure a lot of you are as well. Just wanted to discuss this as a possible theory and see if it has been disproven in any way.

    I wonder if it takes the place of the preliminary hearing.

    I sure hope not.

    If the grand jury meets and returns an indictment on the case then the magistrate court loses jurisdiction and a preliminary hearing is no longer available.

    Isn't that good news? I imagine it would at least indicate that the grand jury felt the state's evidence is strong enough to proceed in court? Right?

    The charges are listed as: obstruction of justice, two counts of indecent exposure, murder, and kidnapping. Troy Large with the Horry County Police Department is listed as a witness on the indictments for obstruction of justice and indecent exposure, and Jeffery Cauble of the HCPD is listed as a witness on the murder and kidnapping indictments.

    The bad news is there is no preliminary hearing which means we get no discovery.

    Not sure if the info used by the GJ is kept private since it is a private proceeding.

    The only bad part is as most lawyers like to say "a grand jury will indicte a ham sandwich" ;)

    Also, completely secret. We get no discovery, bad for us!

    However, it could take it to another level right? I would expect having this business completed, now on 3/28 they will have to enter a plea. Trying to stay positive, maybe one of them will do an about face & realize the reality they are facing and start talking.

    This is good news! And it furthers the theory that LE has a strong case. If the grand jury doesn't have enough evidence to indict then the case goes to a PH for a judge to hear testimony to determine if it should be set in for trial. So it seems there was enough evidence to clear this hurdle.
    Hurdle 1-search warrant-clear
    Hurdle 2-arrest warrant and charges-clear
    Hurdle 3-keeping them with a no bond status-clear
    Hurdle 4-grand jury indictment-clear
    Next up making it through any and all motions hearings

    I have faith LE has a strong case and these two will not see the outside of a jail for a very very very long time.

    Until pretrial hearings I have serious doubts that prior to discovery their lawyers would have them plead due to a GJ indictment. What happens during a GJ is one sided, prosecution puts on evidence/testimony to see if they think charges will stick, etc. It's secret from the defense too :)

    I did read that the transcripts from the GJ are given to the defendant. Is that not correct?
