Kidnapping, murder case of Hania Aguilar to be discussed in court this week
The case of 13-year-old Hania Aguilar who was authorities said was kidnapped and murdered will be discussed in court this week.

The man accused in the case, Michael McLellan was on the superior court docket for Monday, Oct. 7. WMBF News was told by court officials that administrative hearings will be held in the case this week, but McLellan is not expected to appear for those hearings.

The case against Michael McLellan, 34, is listed on the Robeson County Court docket for Monday and Tuesday of this week.

The State of North Carolina announced back in June that it was seeking the death penalty against McLellan in the killing of 13-year-old Hania Aguilar last November in Lumberton.

Man accused of killing Lumberton teen appointed second attorney
Michael McLellan, 34, has been appointed a second attorney in the killing of 13-year-old Hania Aguilar last November in Lumberton.

McLellan was listed on the Robeson County Court docket for this week, but Robeson County District Attorney Matthew Scott said the case won’t be heard. Scott said McLellan’s attorneys have been given his case file to prepare for his defense.

A judge granted that request in April, just one month before McLellan was indicted by a grand jury.

In June, District Attorney Matthew Scott announced the state's intention to seek the death penalty.

Part of "Sexual Act" was repealed on Dec 1, 2018 but I believe "Sexual offense" still includes penetration, however slight, by any object into the genital or anal opening of another person's body-- in addition to cunnilingus, fellatio, analingus, or anal intercourse.

There are so many things going on with this case only serving to delay real justice for Hania:

Defense requested defendant's DSS records which Judge granted in April; Defense announced state's intent to seek death penalty in June; and by August McLellan's new attorney filed a bombshell motion demanding his client's right to a speedy trial.

Not sure I understand your meaning of a "predictable spot."



Hania was kidnapped from the Lumberton mobile park where she resided with family on Nov 5 and was not located until Nov 28 -- several miles away in a swamp.
