    A couple of observations from Aubrey Trail’s testimony yesterday— one of the Falls City hotel clerks who claimed they saw Sydney Loofe with Trail there said she carried go-go boots ...

    And dressed like a “hooker.” The sighting would give credence to Trail’s testimony but doesn’t square with earlier testimony that Loofe liked to dress in sweatshirts and jeans and her go-to dress-up item was a blouse.

    I’m sure we’ll hear more about the sighting today in court.

    And Trail claimed the witchcraft talk in his group and talk of ‘breathing’ someone’s last breath came from a Stephen King book. Tho Trail said he believes in spiritual witches and incarnation.

    Some more testimony expected this morning followed by closing statements by the attorneys in the Aubrey Trail murder case. A little delay in the start of proceedings this morning

    Both sides rest. Closing statements to come shortly. Prosecutors brought witnesses earlier to shoot holes in statements by Trail and hotel clerks in Falls City that Loofe had been there

    Work records show that Loofe was working on most of those days, and a selfie taken by Bailey Boswell appeared to show a different blond girl with them

    Thanks JenniD - I’m not sure I could have sat through AT’a testimony without wanting to rush him and beat the crap out of him. He is so disgusting.

    From Terra Gehrig’s testimony, I get the impression Sydney has met other women on dating apps who were looking for someone to join for a threesome with their boyfriend, or were bi-curious. It seems like she had no interest in those kind of relationships, much less with a fat old man.

    I’m still mystified why AT is continuing to cover for BB, even though he inadvertently threw her under the bus.

    Also it’s curious to me the prosecution didn’t drill into AT. I’m sure they were prepared for this scenario based on AT’s love of attention. I will be looking for the video to see the cross exam as well and come to my own conclusions.

    Prosecutors laid out a timeline of people involved throughout the year of 2017.


    Trail/Boswell in the apartment in June of 2017.


    (A.H.) came into the group soon after that. Boswell told A.H. she would have a sugar daddy (Trail) if she joined.

    . A.H. met Boswell through Tinder, Trail was the one who picked her up first. Prosecutors say within the first conversation with A.H., Trail was already discussing killing.


    A.H. told him she was abused by her step-father, she told Trail that she would like him dead.

    . We’ve heard discussion of torture, witch craft, gaining power, etc. Testimonies show A.H. was going to be the 13th witch of the group.

    Prosecutors say A.H. and Trail’s deminere when talking about killing/torturing would be happy and they would be laughing.


    Trail showed A.H. a “Kill Bag” with a sauna suit and other tools. “You will own yours when you get your first kill.”

    There was a trip to Walmart in Beatrice - “The frist kill” would have been at Walmart.


    Boswell and A.H. stood off to the side while Trail talked to the blonde woman at Walmart that they were planning to kill.


    Took a trip from Wilber to Beatrice to pick out the woman.

    A.H. said she no longer wanted to be involved because it was becoming to real for her.


    As A.H. left and got a new job. A new woman A.G. was found between August-October.


    Trail and Boswell set up a meeting with A.G. to talk about what they could offer her if she joined.

    Boswell/Trail told A.G. about the witchcraft - A.G. told them she didn’t believe it. Instead, it turned into a “snuff” video - the reward is a million dollars.

    A.H. and A.G. would continue to get money from Trail/Boswell but left before Loofe was ever brought up.


    K.B. then came into the picture -Prosecutors said she wanted companionship with Boswell.


    K.B. knew Trail was a package deal with Boswell so she goes with it

    K.B. was involved in the discussion on Nov. 13th about killing someone (A.G.)


    Boswell showed K.B. a picture of A.G. as the person they were going to kill.


    Prosecutors talked about K.B. having sex with Boswell and talking dirty to her (torture techniques).

    On Nov. 13th, Boswell would get off to torture techniques a few days before Loofe's death.


    Loofe is dead two nights later (15th)/her body is dumped out in Clay County a few nights later.

    Prosecutors said people at the Grand Weaver hotel tried to help Loofe.


    Trail told them to take the pictures down to Fall City and show John Cummings (the man who worked at the antique auction house)


    Prosecutors said Trail lied constantly to help take the focus off of him.

    Nov.13th - texts show Boswell trying to get Loofe’s address so she could pick her up for the next day.


    Nov. 14th, Boswell and Trail are seen checking into the Best Western Plus in Lincoln.


    There is no evidence of Loofe going into the Best Western.

    Prosecutors said Loofe asked the question to over messages Boswell before the date.


    “It’s just going to be you and me?” Boswell responds with “Of course. I will protect you, I don’t play games.”

    . Boswell is seen at the end of the night coming back to the hotel, without Loofe.


    Prosecutors said Loofe had no idea it was the same woman she had met back in March.


    Trail previously saw Loofe in Menards (in March) crying about financial issues & Trail giving her $100.

    . Nov. 15th, Boswell doesn't say if she has a boyfriend or not.


    Texts from Boswell/Loofe show the two were messaging each other the morning of the 15th about how excited they were about the date.

    . “It takes two to Tango,” said prosecutors.


    Prosecutors told jury members that Boswell is not the one on trial but you need two people to conspire to kill someone/commit a crime together.

    . Video shows Trail and Boswell are seen at the home depot store buying a knife, heavy duty tin snips and a hacksaw.


    Trail testified that those items were used for antiques but prosecutors say “but they are even better to cut up a body.”

    . Trail said the tarps and drop cloths were used for cleaning antiques and Boswell’s orgasms because "they were messy."

    . Investigators searched the antique mall, while that was happening, Trail said he was on his way to talk to Loofe about recruiting her.


    When Trial showed up to her home, Loofe had already gone off to work.

    . Surveillance showed Trail going to Menards where Loofe worked.


    Prosecutors said he walked right past her & Loofe acts like she didn’t know Trail.


    Prosecutors said Trail was planning her death by checking in on her.

    . Surveillance video shows Boswell going to the dollar store and going to buy three bottles of bleach before Loofe died.


    Trail testified yesterday he used the drop cloths and some towels to make sure Loofe’s blood did not get everywhere.

    . Prosecutors: “Boswell and Trail prepared for the date by buying a hack saw, bleach and other tools to kill her.”

    . Nov. 15th- Boswell starts to travel up to Lincoln to pick up Loofe from her apartment after she got off work at Menards.


    Prosecutors: “Loofe stepped into the car and she stepped into her death sentence.”


    Boswell/Loofe arrived around to the apartment at 8 PM in Wilber.

    . Prosecutors said they believe Loofe was dead within the first 40 minutes; Loofe died on the living room floor, trying to get away.


    Prosecutors said Loofe was targeted to be killed. This death was composed as a personal attack.

    . Prosecutors to the jury: "Did you catch that statement Trail made yesterday?"


    “There was no fantasy,” said Trail during his testimony. “Maybe ours.”

    . Prosecutor: "Trail and Boswell threw out Loofe’s body like it was trash and for the coyotes to get it."


    Prosecutors said animals did get into it and maybe that’s where her other arm went.


    Prosecutors showed Trail’s shirt with bleach marks on it from bleaching the crime scene.

    . “The two did a good job cleaning up,” said prosecutors.


    “Boswell’s blue star pants from the Tinder photo were found bleached and now that’s why they are orange.”

    . K.B. is brought back into the picture and is seen going to hotels/casinos with Trail and Boswell after Loofe’s death.


    The police called K.B. and Trail admitted he freaked out when K.B. got the call.


    Trail said he traded cars with K.B. to help disguise himself and Boswell.

    . Prosecutors talk about the bruising found on her Loofe’s body was from Trail and Boswell were holding Loofe down, strangling her.


    Anthropologists didn’t find any tool marks used on Loofe’s neck or her ankles.


    Prosecutors “She was trying to survive, she didn’t want to die.”

    In closing argument, prosecutor Mike Guinan tells the jury, "By 8:40, she was dead. Not by mistake, not by accident. she was intentionally killed." He said she fought to survive but it was 2 against 1 and one was a 300 lb man. "If you’re the size of Sydney Loofe, it’s game over."

    Aubrey Trail trial: FBI agent called to testify again; defense, prosecution both rest

    On Wednesday, the prosecution had one more chance to call witnesses and chose call FBI Agent Mike Maseth once again.

    The prosecution also called a man who ran an auction house in Falls City, who Trail told investigators would have seen Loofe there.

    Both sides rested their case after the witness.

    After closing arguments, the jury will get instructions regarding deliberations and what they can find Trail guilty of. He is charged with first-degree murder but could be found guilty of a lesser crime.

    The jury will be sequestered during deliberations.

    I know yesterday she was a defense witness.

    ETA - It doesn't sound like the defense called anyone this morning or that Trail was on the stand again.

    Was the same "gray electrical cord" used on Sydney used on Bailey beforehand (according to Trail?)

    Any marks on Bailey?

    They had no safety measures in place (safeword, hand signal, (both of which would be ineffective when choking someone and not giving them the use of their arms anyway; a bell to ring etc) or at least, Aubrey didn't mention any of these things in his testimony it seems. The only time safety measures aren't a concern is if you don't care about the outcome :( or if the entire erotic asphyxiation story is made up. :mad:

    This was no accident.

    Curious though as to why people feel that he is throwing Bailey under the bus? His doing away with the "two other women were there and an agreement of monetary compensation" story doesn't implicate Bailey any more or any less. He says he accidentally killed and then dismembered Sydney and they both cleaned up and disposed of her. Cell data was what led LE to the disposal site. What things has he implicated Bailey of doing that he wasn't aware of or present for that weren't known? I feel like I must have missed something vital in this crazy court case and his testimony where he is implicating her instead of himself....what was it?

    I think it's when he said that he was in it for the money, but BB was in it for the sex. I guess that could sound like it was BB's idea. I don't know, I also didn't get the impression that he said anything to throw her any more under the bus than she already is. If he did, I'm sure he didn't do it intentionally.

    I also didn’t understand the “throwing Bb under the bus. He changed his story from “ she wasn’t in the room” to she was having sex with SL - but didn’t see that it implicated BB any more or less

    Yesterday when AT testified they were taking him through the timeline from the 14th until they were arrested. At one point he said that he ,BB and KB returned to the clay center dumping site and they moved a few of the bags to a more secluded area. He indicated that was how KB got scratches on her legs. I have not read all the news reports or watched the available video yet so not sure if that was included anywhere. I think he said that it was the 18th or 19th which could have been on their way to Grand Island. If he threw anyone under the bus it was KB. I have heard nothing more of this statement???

    One more thing. Can the jury find trail guilty of a lesser crime than which he is accused? For example he is accused Of first-degree murder, could they find him guilty of seconddegree murder or manslaughter?

    Murray laid out the possible options for the jury members to decide on: 1st Degree, 2nd Degree or Involuntary manslaughter.

    I guess I felt that he finally admitted she was there. All along he has proclaimed that she wasn’t there and now he finally did. We all KNEW she was but it seemed to me he was gonna die trying to convince everyone she wasn’t.
