An advocacy commission named after missing child Harmony Montgomery failed to make it into this year’s state budget, 25 Investigates has learned.

The Budget Conference Committee stripped an amendment that would have created the Harmony Montgomery Commission out of the FY23 budget.

On Wednesday, a judge signed off on dismissing the one count of welfare fraud that led to that arrest.

The charge was dismissed because no indictment had been returned from a grand jury before the deadline set by the New Hampshire Rules of Criminal Procedure.

I don't think this action should surprise anyone given this was obviously all that authorities had to hold KM with the hope that having her in custody would result in information leading to the recovery of Harmony.

Too bad the State already spent 10-fold the value of the food stamp benefits KM fraudulently received for Harmony and authorities appear no closer to recovering Harmoney. MOO :(
 
Exactly! If your going to hold them - indict them!! She clearly committed that crime, why allow it to slip away when you've already spent the month to hold her? You d@&n sure aren't doing her or her children any favors letting her go! More time MIGHT save her from further choosing to use - if she gets the help that she needs to get & stay clean. No way she doesn't know what happened with this child!
 

Lawyers for the father of a missing Manchester girl are asking a court to suppress statements he made to police.

Harmony Montgomery, 8, has not been seen in two years. Her father, Adam Montgomery, was arrested in January and charged with assault, interference with custody and endangering the welfare of a child.

Adam Montgomery's attorney has filed two motions to suppress statements he made to police on Dec. 31, 2021, and Jan. 4 of this year.

In the court filings, Montgomery's attorney is asking the court to suppress the statements because law enforcement officers allegedly failed to honor his assertion of his right to silence. The defense also claims officers didn't read him his Miranda rights.

Police found Adam Montgomery in his car in a parking lot on Dec. 31 shortly after they began their search for Harmony. According to court documents, Adam Montgomery told police he "had nothing to say" and was not read Miranda warnings.

On Jan 4, he was arrested and taken to an interrogation room where he was read his Miranda rights, according to court documents. A few minutes into questioning, he told police he had nothing else to say, the documents said.

The defense filings said police continued to press Adam Montgomery after he asserted his right to silence.

The defense is also requesting more time to possibly file one more motion to suppress, asking for the deadline to be extended to Aug. 10.

Adam Montgomery is not facing charges related to Harmony's disappearance.

I just saw that the Update will be at 2PM tomorrow. Anyone have any thoughts on why a US Marshal will be present at the update but not FBI? Could be nothing…or something. I have sinking feeling about this little one.
 
Formella is scheduled to hold a news conference at 2 p.m.

Last month, law enforcement officers from state and federal agencies swarmed a Manchester, New Hampshire, apartment building where girl's father, Adam Montgomery, and his estranged wife Kayla Montgomery, previously lived.
 
I wonder if this is why one of the charges against KM was dropped. KM may have given them information on Harmony, and now the results are in from the investigation into the last place they all lived. KM may have directed LE to where they could find evidence. The Union Leader is reporting that part of the news conference is to inform the public that this is now a homicide investigation. If that's true, then LE would have to be sure there was evidence of a homicide. Source: Harmony Montgomery case moving to homicide investigation
 
anxious for this update. I think it will simply confirm that LE has enough to now believe, as many of us have for some time, that Harmony is no longer living and was murdered :(
Biological evidence in a refrigerator and in floorboards would do it (MOO). Tragically that might be all that remains of this precious little girl.
