NH - Seven motorcyclists dead when truck collided with them, Randolph, June 2019 *not guilty*

"The U.S. Immigration and Customs Enforcement Agency is taking steps to ensure a Ukrainian-born truck driver whose collision with motorcyclists in New Hampshire left seven dead remains in custody even if his criminal case were dismissed...

Jail Superintendent Ben Champagne said ICE placed a detainer on Zhukovskyy on Tuesday. A detainer means even if the case were to be dismissed, Zhukovskyy would be turned over to ICE for possible deportation. A spokesperson for ICE confirmed that a detainer was issued. Messages were left for ICE and Zhukovskyy's public defender, Melissa Davis, seeking comment."

"For at least 15 months, Registry of Motor Vehicles officials ignored tens of thousands of alerts that Massachusetts-licensed motorists had broken driving laws in other states — including for drunken driving and other serious infractions — and instead stuffed them, apparently unread, into mail bins inside a Quincy office building.

As a result, at least 540 drivers who should have had their Massachusetts licenses suspended for driving under the influence elsewhere were allowed to stay on the road, and officials still don’t know the total number of notifications that were ultimately missed, according to a still-unfolding review into the bureaucratic failures within the RMV...

Officials launched the review in response to the case of Volodymyr Zhukovskyy, a 23-year-old West Springfield truck driver who faces seven counts of negligent homicide after allegedly crashing into a group of motorcycle riders, killing seven, last month in Randolph, N.H."

Reading through the linked article, it looks like they need to update some of their computer software, etc. States should exchange this information digitally, instead of sending notices in the mail. Local governments/small counties are also behind the times on this stuff.

A friend who likes to go camping and hiking often travels through small towns with speed traps. A couple of times, they've gotten speeding tickets, paid them by mail and still had their license revoked by the state for non-payment. Took almost a year after hiring a lawyer to get all the paperwork straightened out. Many of these little towns don't even have web sites or email capability.

As I was out driving today I noticed a flatbed trailer next to me. I immediately thought of this awful tragedy & the horror of driving along & having one of those jackknife - and then to see it coming right at you. There was absolutely no time to react I’m sure, and there probably wasn’t anywhere to go even if they could. So sad.

Not surprising. Also not a surprise that the truck/trailer had many violations. This (at the article linked) is concerning:

A spokesman for the Federal Motor Carrier Safety Administration declined to comment, saying the agency doesn’t discuss crashes publicly. The Globe obtained the inspection report through a public records request.

No, I don't think that's accurate. That information is supposed to be made public. It used to be.

Many companies are trying too hard to maximize profits by hiring the cheapest transportation options. Some of those carriers need to be shut down. The cheapest ones are usually ignoring safety regulations and hiring bad drivers.

Did law enforcement draw blood at the scene to test if he was drunk or high ?
So many unanswered questions.

Yeah he was on drugs.

A Massachusetts truck driver who has been charged with negligent homicide in a June crash that killed seven motorcyclists in New Hampshire was on drugs and reaching for a beverage just before the tragedy, The Boston Globe reported Thursday.

Truck driver in New Hampshire crash that killed 7 bikers was on drugs, report says

In May, Connecticut prosecutors said Zhukovskyy was arrested in a Walmart parking lot after failing a sobriety test. Zhukovskyy's lawyer in that case, John O'Brien, said he denies being intoxicated and will fight the charge.

Snips:

In addition, a New Hampshire State Police report on the crash was “deeply flawed,” Duguay alleged in the filing.

Crash Labs determined that the motorcycle of Albert “Woody” Mazza Jr., one of the bikers who died in the crash, was “protruding over onto the center line” of traffic when it struck the truck that Zhukovskyy was driving, the station reported.

The Crash Labs report also says the state provided information that Mazza had been looking behind him at other bikers prior to the crash and that an autopsy revealed he had a blood-alcohol level above the legal limit, the station reported.

This is absurd. His defense attorney (like many others), is attempting to blame the victim(s).

What about the fact packets containing what is believed to be heroin were in his home when he was arrested? What about the fact witnesses claimed he was driving erratically shortly before the accident? What about the fact he claimed he was reaching down for a drink and took his eyes of the road? What about the numerous charges of DUII prior to the accident? What about the fact he overturned a tractor trailer 1 month before? What about the fact his licence was suspended and he shouldn't have been driving at all?

What a tragedy for the families. Too bad he isn't man enough to accept responsibility for his actions and plead guilty. He and his attorney should be ashamed.

I don’t disagree. This move by his defense team was expected tho. The evidence, and science of the recreation of the event, will bear out the facts. It may show the first rider was in error as far as placement on the road. The toxicology is already known.

What is a relief to me is, this little twit is off the streets, no more being part of the drug trade. He should do life, or get the death penalty for the murder of the bikers, in addition to drug running. His attitude and past behavior proves he cannot be reformed. JMO

Evidence of Volodymyr Zhukovskyy’s erratic driving before deadly New Hampshire motorcycle crash can be presented, court rules

A New Hampshire court ruled Friday that some evidence related to the driving and drug use of the pickup driver whose collision with a group of bikers last year left seven motorcyclists dead was admissible in his criminal case.

The Superior Court decided that evidence of Volodymyr Zhukovskyy, of West Springfield, Massachusetts, driving erratically earlier in the day of the crash was admissible. It also allowed prosecutor’s request to admit evidence of the defendant’s criminal past including an instance of illegal drug use.

This is just laughable. He will disappear immediately. He will leave the country never to be seen again.

A New Hampshire judge has denied Volodymyr Zhukovskyy’s bid to be released while he awaits trial in connection with a crash that left seven motorcyclists dead.

Zhukovskyy, 24, of West Springfield, wanted a new bail hearing and his lawyers were seeking his release under conditions, but a judge in New Hampshire denied the motion, according to court documents.
Yup, they're correct, he'll flee the US.

Prosecutors contend that Zhukovskyy should remain in custody while awaiting trial. One of their arguments is that they are concerned he would flee the United States and head to Ukraine if he is released.

Prosecutors in the New Hampshire case also noted Zhukovskyy is a Ukrainian national with a status as a long-term permanent resident in the U.S. There is a detainer from immigration officials for Zhukovskyy in order to have him deported as well.

“Moreover, upon information and belief, the defendant has immediate family members currently living in Ukraine,” prosecutors wrote in previous court filings while calling Zhukovskyy a “significant flight risk.”

The pickup truck driver charged with causing the deaths of seven motorcyclists in New Hampshire last year told authorities he had drug problem, regularly used heroin and cocaine but believed he was not impaired at the time of the crash.

The admission by Volodymyr Zhukovskyy, of West Springfield, Massachusetts, was included in a trove of documents released Wednesday by federal investigators related to the the June 21, 2019, crash in Randolph.
The National Transportation Safety Board also announced that it will hold a hearing Dec. 1 to discuss probable cause, findings and any safety recommendations from its investigation.

Zhukovskyy told Massachusetts State Police after his arrest he was using three or four bags of heroin a day and had used both heroin and cocaine the morning of the crash. He acknowledged that he could feel the effects of the cocaine after his last delivery but that he was “fine and okay to drive.”
