Expecting to learn the trial date of her 11-year-old daughter's accused killer, the mother of Abbiegail Smith instead met with disappointment Monday when the defendant's attorney asked for a delay in the proceedings so he can continue an investigation.

It was the second such extension granted since May.

Prosecutors have not offered a plea bargain to the accused killer and have said they are seeking life in prison without the possibility of parole.

Erazo's next court date for Aug. 20.

Abbiegail Smith murder trial: Accused asks for new lawyer

Andreas Erazo, 19, appeared in court this morning. He was expected to get a trial date in June, but his attorney, a public defender, asked for a delay in the proceedings so he could continue an investigation.

The prosecution is expected to file a motion opposing Erazo's request for a new attorney by Aug. 24. The motion will be heard in court on Sept. 7.

Andreas Erazo, 20, of Keansburg, pleaded guilty Tuesday to first degree Murder and first degree Aggravated Sexual Assault in connection with the death of Abbiegail “Abbie” Smith, who was found deceased on July 13, 2017, just hours after she was reported missing from her Hancock Street apartment.

Erazo is scheduled to appear in Superior Court for sentencing for his crimes before Presiding Criminal Judge David F. Bauman on May 31, 2019. He remains incarcerated in the Monmouth County Correctional Institution, where he has been detained since his arrest.
 
Court: Admitted killer of Keansburg girl can retract guilty plea

The Keansburg man who pleaded guilty to raping and murdering his 11-year-old neighbor in summer of 2017 will be allowed to withdraw his guilty plea and go to trial because a judge should have suppressed his confession to killing the girl, an appeals court ruled Monday.
 

TRENTON, N.J. (TCD) -- The Supreme Court of New Jersey reversed an appellate court’s ruling that said a man did not knowingly confess to killing his young neighbor, which would have sent him back to court for a retrial after he pleaded guilty.

According to the high court’s opinion, the appellate court previously ruled that Andreas Erazo’s confession to killing Abbiegail Smith, which was "obtained during a second interview, five hours after his initial 90-minute interview, was not knowing, intelligent and voluntary, and should have been suppressed."

The Supreme Court, however, disagreed and argued Erazo was not actually in custody when he admitted to the slaying.
